The following Order and Judgement was made:

After hearing Counfel as well on Wednesday the 18th as Friday the 20th Days of May laft, upon the Petition and Appeal of William Hepburn, refiding at Hailes, Executor of Mrs. Agnes Hepburn, otherwife Cunninghame, fometime refiding at Haddington, deceafed; complaining of Two Interlocutors of the Lord Ordinary in Scotland, of the 18th of June and 14th of July 18c6; and alfo of Two Interlocutors of the Lords of Seffion there, of the 4th of March 1808, and 16th of January 1810; and praying, "That the fame might be reverfed, varied or "amended, or that the Appellant might have fuch other "Relief in the Premifes, as to this Houfe, in their Lord

fhips great Wisdom, should seem meet;" as alfo upon the Anfwer of Robert Brown and Walter Lockhart, Trustees under the Deed of George Cunninghame and George Milne, put in to the faid Appeal; and due Confideration had this Day of what was offered on either Side in this Caufe;

It is DECLARED, by the Lords Spiritual and Temporal Interlocutors in Parliament affembled, That in the Circumftances of Reverfed with this Cafe, the Poft-Nuptial Contract between George Cunninghame and Agnes Hepburn is not to be confidered as gratuitous, or as being, or as intended to be, a Donation between Husband and Wife, but that the faid Con tract, in the Circumstances of this Cafe, ought to be confidered as containing Grants or Agreements between the Spouses, in Confideration of each other, binding upon both, and not revocable by the Hufband; And it is therefore Ordered and Adjudged, That the faid Interlocutors complained of in the faid Appeal, fo far as they are inconfiftent with this Declaration, be, and the fame are hereby Reverfed: And it is further Ordered, That the Cause be remitted back to the Court of Seffion in Scotland, to do what is meet and just consistent with this Declaration and Reversal.
