"Hereditaments, in the County of Norfolke, to be fettled "to the fame Ufes as the Warwickshire Estate stands "fettled ;" and to acquaint this House, that they have agreed to the fame, without any Amendment.

After hearing Counsel, this Day, at the Bar, upon Torbuck et al. the Petition and Appeal of Katherine Marbury Spinfter, Benjamine Woodroffe Doctor in Divinity and Mary his Wife, Gilbert Thacker Efquire and Elizabeth his Wife, which faid Katherine, Mary, and Elizabeth, are the Sifters and Coheirs of William and Richard Marbury, late of Marbury, in the County of Chefter, Efquire, deceased, from a Decree made in the Court of Chancery, the Thirteenth Day of August One Thoufand Seven Hundred and One, on the Behalf of George Torbuck and others, Mortgagees and Bond and Simple Contract Creditors of the faid William Marbury, who contended for Sale of the Estate in Queftion; as alfo upon the feveral Answers of Sir Roger Hill, Sir Streynsham Mafter, Cecilia Fyennes, and Elizabeth Horfey, Refpondents, by the Denomination of Mortgagees; the Anfwer of Francis Painter, Richard Spour Executor of William Noy deceased, Anne Andrews, Nathaniel Hodges Administra tor of John Couch deceafed, John Ifherwood, Creditors by Bond of William Marbury, late of Marbury, in the County of Chefter, Efquire, deceased; the Anfwers of Thomas Frith, Samuel Minfhall, Robert Naylor Executor of Peter Downall, Thomas Birkinhead Adminiftrator of John Birkinhead, John Torbuck and Deborah Torbuck Executors of George Torbuck deceased, and Richard Smith Executor of John Worrall deceased; and also the Anfwer of Richard Earl Rivers, put in thereunto; and due Confideration had of what was offered thereupon:
