PROVIDED always, and it is hereby declared and agreed by and between the said parties to these presents, that the faid M. T. fhall not act as receiver of the rents and profits of the faid premises, until default fhall be made by the faid C. N. of and in payment of the faid annual fum or yearly rent charge of fome part thereof, for the space of twenty days next after the same shall become due and payable. AND the faid M. T. for himself, his heirs, executors, and adminiftrators, doth covenant, promife, and agree to and with the faid C. N. and also to and with the faid S. I. and each of them, their, and each of their executors, adminiftrators, and affigns, that he, the said M. T. or any future receiver, to be appointed as hereinafter is mentioned, in collecting and receiving, or recovering, or in paying or applying upon the trufts and in manner aforefaid, the rents, iffues, and profits of the faid premises, or any of them, or any part thereof. And also that in cafe the faid M. T. fhall happen to die, or fhall refufe or neglect to act in the faid receivership, during gleet to aft, anthe life of the faid C. N. it shall and may be lawful appointed. to and for the faid C. N. his executors, adminiftrators, and affigns, to nominate and appoint another receiver, at the nomination of the said S. I. his executors, administrators, or affigns, but at the cofts, charges, and rifque of the faid C. PROVIDED also that if the faid C. N. or his affigns, fhall neglect or refuse so to nominate or appoint fuch future receiver, or receivers, then and in such case, and so often as the like case shall happen, it fhall and may be lawful for the faid S. I. his executors, administrators, and affigns, but at the fole rifque of the faid C. N. his executors, administrators, and affigns, to appoint fome fit perfon or perfons to collect the faid rents, iffues, and profits, upon the trufts aforefaid. C. and his affigns, peaceably and quietly to have, hold, occupy poffefs and enjoy the faid meffuages, &c. hereby released with their appurtenences, and to take the rents, iffues, and profits thereof, to and for his and their own use and benefit, without any interruption of or by them the said S. I. and F. F. or either of them, their or either of their executors, adminiftrators, or affigns, or by the faid M. T. or any future receiver to be appointed as aforefaid.

Appointment of Stewards of a Manor.

KNOW all men by these prefents, that I. 7. O. of-, efq. for divers good caufes and confiderations, me thereunto moving, and trusting to and confi. ding in the integrity of S. N. F. N. and A. N. of &c. have given and granted, and by these presents do give and grant unto the said S. N. F. N. and A. N. or either of them, the office of fteward of the court of my manor of, in the county of aforefaid, and do hereby make, ordain, nominate, conftitute, and appoint them the faid S. N. F. N. and A. N. or either of them, steward of the court of the faid manors. TO HAVE AND TO HOLD the faid office of fteward of the faid court and of the faid manors to them the faid S. N. F. N. and A. N. to be executed by them the faid S. N.

F. N. and A. N. or either of them, for the time STEWARDS. being, as occasion may require, with all usual and accustomed falaries, fees, profits, and perquifites of courts belonging to the faid office of steward of the faid court, and of the said manor, or by reason thereof, heretofore usually received and enjoyed by any former steward or ftewards of the faid court; and I do hereby also nominate, constitute, and appoint, and in my place and ftead, put them the faid S. N. F. N. and A. N. or either of them, to be my true and lawful attorney and steward in manner aforefaid, and for me, and in my name, and for my own proper use and benefit, to ask, demand, fue for, recover and receive, of and from all and every my tenants of the faid manor, all and every fuch fum and fums of money, iffues and profits whatsoever, and of what nature or kind foever, which at any time hereafter, fhall, can or may become duc, owing or payable, or anywife arife, and belong to me, out of my faid manors, as former ftewards have collected and received; and in default of payment of all or any part of the fame, to take all fuch lawful ways and means for the recovery thereof, or of every part thereof, by action, bill, plaint, or otherwise is they fhall think proper, or be advised, and for me and in my name, upon receipt of all or any part of the fame, by the ways and means aforefaid, to give proper and fufficient receipts and discharges for the fame, and generally to do, or cause to be done all and every fuch further and other lawful and reasonable act and acts, thing and things, whatfoever belonging to the
