complaining of a Decree of the Court of Chancery, of
the 24th Day of April 1807, and of an Order of the
faid Court of the 9th Day of May 1809, affirming the
fame, made in a certain Caufe, wherein William Willan,
Nephew and Devifee of John Willan Efquire deceafed,
and John James Willan an Infant, by the faid William
Willan his Father and next Friend, were Complainants;
and John Willan, Elizabeth Willan Widow, William Har-
rifon Whittington, William Chriftopher Stewart, and Tho-
as Thorpe, were Defendants; and praying, "That

"Whether a Perfon, duly convicted in His Majefty's Court of King's Bench fitting at Westminster, of a Mifdemeanor committed in the County of Middlefex, punishable by Imprisonment, can be lawfully adjudged by the faid "Court fitting at Westminster, to be imprisoned "for his Mifdemeanor in any of His Majefty's "Gaols in England, other than that of the County "in which the Offence was committed, or in "that of the County where the Court fits, or "that of the Court itself; and whether by Law "the said Court can, by their faid Judgment, "alfo adjudge fuch Perfon to give Security for "his good Behaviour for a reasonable Time, "to be computed from and after the Expiration "of fuch Imprisonment, himself in a Sum named "in fuch Judgment, with two fufficient Sureties, "each in a Sum therein also mentioned ?"

The fame was agreed to, and the faid Question was accordingly put to the Judges.

And the Lord Chief Juftice of the Court of Common Pleas having conferred with the reft of the Judges prefent, delivered their unanimous Opinion upon the faid Question in the Affirmative.

Whereupon the following Order and Judgment was made:
