A. "Yes."

Q." When did you first hear that fhe pretended to "have any Knowledge?"

A. "I was acquainted by a Friend of Colonel Pow"lett's juft previous to this Divorce Bill coming on in "this Houfe, that if I made Application to Mrs. Barber, "that fomething material might be obtained from her; "I accordingly fent my managing Clerk to Bath, who did obtain Information, but I have never myfelf quef❝tioned her upon the Fact."

Q. "Was that Information obtained before or dur"ing the Time that the Proceedings were carrying on "in this Houfe?"

A. Before the Proceedings commenced in this. "Houfe."

Q. "Did your Clerk communicate to you, before the "Proceedings commenced in this House, what Informa"tion he had received?"

A. "He did."

Q." What Information did he state to you that he "had received?"

A. "The Information varies certainly from the Evi"dence fhe has given at this Bar, inafmuch as I under"ftood from him that fhe had not examined Mrs. Pow"lett's Linen, or feen any Marks on her Linen, till she "arrived at Alresford; that was the Impreffion made upon my Mind from what the Clerk ftated."

Q. "Is your Clerk in Town?"

A. "He is not."

Q." Where is he?"

A." He is at Southampton."

Q. "What is your Clerk's Name?"

A. "Thomas Gillingham, an Attorney at Law."

Q. "You mentioned that fome Gentleman had told you, that you might get fome Information from Joan "Barber?"

A. "That was Richard Crewe Efquire, an Acquaintance of Mr. Powlett's."

Q. "Was it communicated to you by any Perfon "confidentially, fo as to make you object to give Evi"dence?"

A. "No."

Q. "Do you recollect having furnished Mr. Bur"roughs and me, as Counsel, with the Subftance of the fuppofed Evidence of Mrs. Barber, who appeared at "Bar?"

A. "I do."

Q. "Do you recollect that we thought it beft to con"fine our Cafe to the Evidence that had been given in "the Court below?"

A. "I do."

Q. "As far as you know or believe, was that the "Reason why that Evidence was not tendered at this "Bar?"

A. "I certainly understood that that was the only "Reason why it was not."

(Question by a Lord.) "When you communicated to your Counfel what you had heard refpecting Joan "Barber, did you communicate it in Substance as you "then understood it ?"

A. "I certainly did, as I then understood it; I wish "to ftate, that I had no Communication with Mrs. Bar"ber respecting her Teftimony. I relied on the In"formation I had received from my Clerk; and upon my Arrival in Town, and feeing her here, I thought "it not neceffary to examine her as to the Facts." The Witness was directed to withdraw.

A. "Before the last Time that the Witneffes came to "Town."

Q. "Who was the Person that you first mentioned it " to ?"
