And be it further enacted, That it fhall be lawful
"for the faid Commiffioners to fet out, allot, and award
"any Lands, Tenements, or Hereditaments whatsoever,
"within the faid Township of Skelton, or within the faid
"Parish of Howden, in lieu of and in exchange for any
"other Lands, Tenements, or Hereditaments whatsoever
"within the faid Township or Parish, or within any
"adjoining Parish, Manor, Hamlet, or Place; provided
"that all fuch Exchanges be afcertained, fpecified, and
"declared in the Award of the faid Commiffioners, and
"be made with the Confent of the Owner or Owners,
"Proprietor or Proprietors of the Lands, Tenements, or
"Hereditaments which fhall be fo exchanged, whether
"fuch Owner or Owners, Proprietor or Proprietors, fhall
"be a Body or Bodies Politic, Corporate, or Collegiate,
"or a Tenant or Tenants in Fee Simple or for Life, or
"in Fee Tail, General or Special, or by the Courtesy
"of England, or for Years determinable on any Life or
"Lives, or with the Consent of the Guardians, Trustees,
"Feoffees for Charitable or other Ufes, Husbands,
"Committees, or Attornies of or acting for any fuch
Proprietors or Owners as aforefaid, who at the Time
"of making fuch Exchange or Exchanges, fhall be re-
"fpectively Infants, Femes Covert, Lunatics, or under
any other legal Difability, or who fhall be beyond
"the Seas, or otherwife difabled to act for themselves,
"himself or herself; fuch Consent to be testified in
Writing, under the Common Seal of the Body Politic,
"Corporate, or Collegiate, and under the Hands of
"the other confenting Parties refpectively; and all and
every such Exchange and Exchanges fo to be made,
"fhall be good, valid, and effectual in Law, to all In-
"tents and Purposes whatsoever: Provided always ne-
"vertheless, that no fuch Exchange fhall be made of
any Lands, Tenements, or Hereditaments held in
"Right of any Church, Chapel, or other Ecclefiaftical

Viscount, became extinct; and Petitioner fubmits that by Means thereof the Male Defcendants of Francis the "Fourth Son of the faid First Viscount are next en"titled to the Title and Dignities.

"That faid Francis the Fourth Son of Nicholas the "First Viscount, who was Francis Barnewall of Beggs"town and Woodpark, in the County of Meath, inter"married with Jane Daughter of Philip Fitzgerald

"That faid Nicholas who was Nicholas Barnewall "of Beggstown and Woodpark, and Petitioner's Grand"father, intermarried with Catherine Daughter of Ro"bert and Sister of John Lord Trimleftown, by whom " he had Iffue Four Sons, Mathew his Eldeft Son, "John his Second, Robert his Third Son, Edward his Fourth, and Two Daughters Elizabeth and Mar. garet.
