VII. And for the better levying and raising the faid feveral Commiffioners Duties and Sums of Money by this Act impofed upon fuch of of the Cuftoms the faid Coals and Culm as fhall be imported or brought in from Scotland, or any Parts beyond Sea, as alfo upon fuch of the faid Coals and Culm as fhall or may be shipped or water-born to be fhipped and carried by Sea from any Part of the faid Kingdom of England, Dominion of Wales or Town of Berwick upon Tweed, to any other Part of the fame as aforefaid, it is hereby enacted, That the fame fhall be from Time to Time under the Management and Government of the Commiffioners of the Cuftoms for the Time being, who fhall caufe thefe Duties from Time to Time to be raised, levied, collected and paid, so that the Monies arifing thereby (except the neceffary Charges of receiving, collecting, levying and managing the faid Duties) fhall be anfwered and paid from Time to Time into His Majefty's Exchequer, diftinct and apart from all other Branches of the publick Re

venues.

VIII. And for the better afcertaining and fecuring of the faid Duties upon Coals and Culm imported from Foreign Parts,

or fhipped or water-born to be shipped and carried by Sea from any Part of England, Wales or Berwick, to any other Part of the fame as aforefaid; Be it further enacted, That the said several paid before Bulk Duties and Sums of Money for fuch Coals and Culm, fhall from Time to Time, during the faid Term of five Years, be answered and paid unto His Majefty, His Heirs and Succeffors, or to fuch Collector or Perfon as fhall by His Majefty, His Heirs or Succeffors, or by the faid Commiffioners of the Customs, or any four or more of them for the Time being, under their Hands and Seals, be thereunto appointed, before Bulk of the Ship or Veffel in which they are imported, brought or carried, fhall be broken, or any of the Coals or Culm therein fhall be unladen, and before any Meter, Measurer or Weigher in that Behalf appointed or to be appointed, shall measure or weigh the fame; upon Receipt whereof the Party appointed to receive fuch Duties fhall, without Delay, Fee or Reward, deliver a Receipt under his Hand, to the Perfon or Perfons who fhall pay the faid Duty, which Receipt fhall for fo much be a fufficient Difcharge; of all which Ships and Veffels, and of the Coals and Culm therein imported or brought, due Entries fhall from Time to Time be made in the Cuftom-Houfe, of or belonging to fuch Port or Place where fuch Importation fhall be made (if any Custom House be there) or elfe in the Cuftom-Houfe of the next Port or Place where fuch Importation fhall be. And in cafe any of the faid Coals or Culm fo imported, brought or carried by Sea, fhall be unfhipped to be laid on Land, before the Impofitions, Duties or Sums aforefaid refpectively due for the fame fhall be paid or fecured, that then as well the faid Coals and Culm fo unfhipped, as alfo the Ship or Veffel out of which the fame fhall be fo unfhipped, with all her Guns, Tackle, Furniture and Ammunition shall be forfeited and loft; one Moiety of which Forfeitures fhall be unto His Majefty, His Heirs and Succeffors, and the other Moiety to fuch Perfon or Perfons as shall seize, fue or inform for the fame, to be recovered in any of His Majefty's Courts of Record at Weflminfler, by Action of Debt, Bill, Plaint or Information, wherein no Effoin, Protection, Wager of Law, or more than one Imparlance fhall be admitted.

IX. And to the end that the faid Impofitions and Duties may be duly anfwered and paid without Fraud or Covin, and for the better levying and Collecting thereof, and for the Discovery of the juft Quantities of all Sorts of Coals and Culm, from Time to Time fhipped or water-born to be shipped or carried by Sea, imported or unladen as aforefaid; Be it further enacted by the Authority aforefaid, That it fhall and may be lawful to and for His Majefty, His Heirs or Succeffors, or to or for any four or more of the faid Commiffioners of the Cuftoms for the Time being, by Writing under their Hands and Seals, from Time to Time, to affign and appoint, within every or any Port or Place within the faid Kingdom of England, Dominion of Wales or Town of Berwick upon Tweed, fuch and fo many Meters, Weighers or Meafurers of the faid Coals and Culm as fhall within the Term aforefaid be imported, brought or landed in fuch Port or Place, wherein or for which fuch Meters, Weighers or Mea Duty of Meters, furers fhall be affigned or appointed as aforefaid; who fhall from Time to Time measure and weigh ali fuch Coals and Culm fo

imported or brought; and when and as foon as any fuch Ship or Veffel fhall be unladen, shall forthwith deliver a true Certificate in Writing, under his or their Hand or Hands, unto the Perfon or Perfons appointed to receive the faid Impofitions or Duties within fuch Port or Place of the Sorts, Quantities and Numbers of Chalders or Tuns of Coals or Culm refpectively, which shall be measured or weighed, and delivered from on board any fuch Ship or Veffel, under the Penalty of one hundred Pounds: And Certificate. in cafe it shall appear by fuch Certificate, or otherwise, that there was on board any fuch Ship or Veffel a greater Number of Chalders or Tuns of Coals or Culm, than for which the faid Impofitions or Duties hereby impofed fhall have been answered and paid as aforefaid, that then in every fuch Cafe there fhall be

Refufal to pay the fame, fuch Ship or Veffel, with the Tackle, Furniture and Apparel thereof, or any Part thereof, fhall and may be attached and detained by the Officer or Officers for the Time being, in fuch Port or Place appointed to receive the faid Impofitions or Duties, or to measure or weigh the faid Coals or Culm, until Payment thereof, and to fell the faid Ship or Veffel, Tackle, Furniture and Apparel, or any Part thereof, in cafe all the faid Impofitions, Duties or Payments before mentioned, for the faid concealed Coals or Culm, fhall not be paid and satisfied, with reasonable Cofts and Charges for fuch attaching, detaining or felling, rendring the Overplus; which Sale fhall be good and effectual in the Law.

X. Provided nevertheless, That if the Importer, upon fuch Provife. XI. And for the Manifeftation of the Truth, and Certainty in Duty of Officers the Premiffes, be it further enacted by the Authority aforefaid, of the feveral That the Officers to be appointed in each Port and Place for the Ports as to keeping true Ac receiving of the faid Impofitions or Duties, and for the weighing and measuring of the faid Coals and Culm fhipped, or water-born to be shipped, imported or landed as aforefaid, fhall respectively keep one or more Book or Books for every fuch Port or Place, wherein they fhall refpectively enter down a true Account of all fuch Sums of Money, which fhall be paid or received for or upon account of the faid Impofitions or Duties, and of all the Payments and Disbursements of the fame, and also a true Account of the Numbers of Chalders and Tuns of Coals and Culm fo imported, landed and unladen in any fuch Port or Place, and of the refpective Sorts thereof.

XII. And it is hereby further enacted by the Authority Three Months aforefaid, That there fhall be allowed to every Mafter or Owner allowed for Duof any Ship or Veffel three Months Time for the Payment of ties, on the Duty impofed by this Act, for fuch Coals and Culm, from

Time to Time imported, brought or carried by Sea as aforesaid, good and fufficient Security being given for the fame, such as the Collector or other Chief Officer of the Port or Place where fuch Goods fhall be imported or brought fhall approve of; or if fuch Mafter or Owner fhall for the fame pay prefent Money, there fhall be allowed him after the Rate of ten Pounds per Centum per Annum, for fuch prompt Payment; and if any of the Coals or Culm, for which the Duty hereby granted fhall be once paid or fecured at the Importation or Landing thereof, shall be again exported and carried to any other Place of this Kingdom, there fhall be no further Duty by this A&t paid or demanded for the fame; and if any of the Coals for which the Duty by this A&t fhall be once paid or fecured as aforefaid, fhall be afterwards carried to any Parts beyond the Seas, then an Allowance out of the Over-fea Duties or Repayments, fhall be made of fo much as was before paid by this Act for the fame Coals or Culm.

XIII. Provided alfo, and be it enacted, That if any Perfon or Perfons fhall at any Time be fued or profecuted for any Thing by him or them done in Execution of this Act, he or they may plead the General Lfue, and give this Act in Evidence; and if a Verdict pafs for the Defendant, or the Plaintiff be nonfuit, or forbear Profecution, the Defendant fhall have Treble Costs, to be recovered as in other Cafes where Cofts are given by Law to Defendants.

An Act for continuing the Duties upon Coffee, Tea and Chocolate, and Spices, towards Satisfaction of the Debt due for Tranfport Service for the Reduction of Ireland.

An Act for determining Differences by Arbitration.

WHEREAS it hath been found by Experience, that Re

much to the Eafe of the Subject, in the determining of Controverfies, because the Parties become thereby obliged to fubinit to the Award of the Arbitrators, under the Penalty of Imprifonment for their Contempt in cafe they refufe Submiffion :' Now for promoting Trade, and rendring the Awards of Arbitrators the more effectual in all Cafes, for the final Determination of Controverfies referred to them by Merchants and Traders, or others, concerning Matters of Account or Trade, or other Matters; Be it enacted by the King's Most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in Parliament affembled, and by Authority of the fame, That from and after the eleventh Day of May, which fhall be in the Year of our Lord One thou. fand fix hundred ninety eight, it fall and may be lawful for all Merchants and Traders, and others defiring to end any Controverfy, Suit or Quarrel, Controverfies, Suits or Quarrels, for which there is no other Remedy but by perfonal Action or Suit in Equity, by Arbitration, to agree that their Submiffion of their Suit to the Award or Umpirage of any Person or Perfons fhould be made a Rule of any of His Majefty's Courts

of Record, which the Parties fhall choose, and to infert fuch their Agreement in their Submiffion, or the Condition of the Bond or Promife, whereby they oblige themselves respectively to fubmit to the Award or Umpirage of any Perfon or Perfons, which Agreement being fo made and inferted in their Submiffion or Promise, or Condition of their respective Bonds, fhall or may, upon producing an Affidavit thereof made by the Witnesses thereunto, or any one of them, in the Court of which the fame is agreed to be made a Rule, and reading and filing the faid Affidavit in Court, be entred of Record in fuch Court, and
