Form of Proteft.

Proteft or Notice thereof to be

and by the Authority of the fame, That from and after the
four and twentieth Day of June next, which fhall be in the Year
One thousand fix hundred ninety eight, all and every Bill or Bills
of Exchange drawn in, or dated at and from, any trading City
or Town, or any other Place in the Kingdom of England,
Dominion of Wales, or Town of Berwick upon Tweed, of the
Sum of five Pounds Sterling or upwards, upon any Person or
Perfons of or in London, or any other trading City, Town or any
other Place (in which faid Bill or Bills of Exchange shall be ac-
knowledged and expreffed the faid Value to be received) and is
and shall be drawn payable at a certain Number of Days, Weeks
or Months after Date thereof, that from and after Presentation
and Acceptance of the faid Bill or Bills of Exchange (which
Acceptance fhall be by the underwriting the fame under the
Party's Hand fo accepting) and after the Expiration of three
Days after the faid Bill or Bills fhall become due, the Party to
whom the faid Bill or bills are made payable, his Servant, Agent
or Affigns, may and fhall caufe the faid Bill or Bills to be
protefted by a Notary Publick, and in Default of fuch Notary
Publick, by any other fubftantial Perfon of the City, Town or
Place, in the Presence of two or more credible Witneffes, Re-
fufal or Neglect being first made of due Payment of the fame;
which Proteft fhall be made and written under a fair written
Copy of the faid Bill of Exchange, in the Words or Form fol-
lowing:

II. Which Proteft fo made as aforefaid, fhall within fourteen Days after making thereof be fent, or otherwife due Notice fhall given in 14 Days be given thereof, to the Party from whom the faid Bill or Bills were received, who is, upon producing fuch Proteft, to repay the faid Bill or Bills together with all Intereft and Charges from the Day fuch Bill or Bills were protefted; for which Protest shall be paid a Bum not exceeding the Sum of Six pence; and in Default or Neglect of fuch Proteft made and fent, or due Notice given within the Days before limited, the Perfon fo failing or neg lecting thereof, is and fhall be liable to all Cofts, Damages and Intereft, which do and fhall accrue thereby.

III. CA P. XXI.

An Act for the better preventing the counterfeiting, clipping and other diminishing the Coin of this Kingdom.

WHEREAS the preventing the Currency of clipt and

unlawfully diminished, and counterfeit Money, is a more 'effectual Means to preferve the Coin of this Kingdom intire and pure than the moft rigorous Laws for the Punishment of fuch as diminish or counterfeit the fame: And whereas by the known Laws of this Kingdom no Perfon ought to pay, or knowingly tender in Payment, any counterfeit or unlawful diminished Money, and all Perfons not only may refuse to ' receive the fame, but may, and by the ancient Statutes and Ordinances of this Kingdom have been required to destroy and 'deface the fame; and more especially the Tellers in the Receipt of the Exchequer, by their Duty and Oath of Office, are required to receive no Money but good and true; and to the end the fame might the better be difcerned and known, by the ancient Course of the faid Receipt of the Exchequer all Money ought to be received there by Weight as well as by Tale: For the restoring of which Courfe, together with other Things, an Act was made in the laft Seffion of this prefent Parliament, intituled, An Ad for the better Obfervation of the Courfe 8 & 9 W. 3. • anciently used in the Receipt of the (a) Exchequer, whereby c. 28. § I. • amongst

amongst other Things it is enacted, That the refpective Tellers of the faid Receipt of Exchequer, when any Money fhall be brought to the faid Receipt of the Exchequer, to be there paid, fhall without Delay receive it, weighing the fame in intire Sums or otherwife, and making due Entry of the Weight and Tale thereof, according to the ancient Course; but no Provifion is made in the faid Act, that the faid Teilers fhall refuse to receive the faid Money, in cafe it fhall not be of its due Weight: And the former and ancient Laws being grown into Defuetude, whereby unlawfully diminished and counterfeit Money receive a Currency, and wicked and traiterous Perfons are encouraged to diminish and counterfeit the fame: Now to the end the Kingdom, after fo vait a Charge and Expence for the Reformation of the Silver Coin, and restoring it to its due Weight and Purity, may not relapfe into the fame Evil, from which it hath been fo lately delivered with great Difficulty and Hazard, and that counterfeit and unlawfully diminished Money, which already begins to increase, may be defaced and deftroyed,' Be it declared and enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in Parliament affembled, and by Authority of the fame, That it is and fhall be lawful to and for any Perfon, to whom any Silver Money fhall be tendred, any Piece or Pieces whereof fhail be diminifhed, otherwife than by reafonable Wearing, or that by the Stamp, Impreffion, Colour or Weight thereof, he fhall fufpect to be counterfeit, to cut, break or deface fuch Piece or Pieces; and if any Piece fo cut, broken or defaced, fhall appear to be counterfeit, the Perfon tendring the fame fhall bear the Lofs Who fhall bear thereof; but if the fame fhall be of due Weight, and appear to

be lawful Money, the Person that cut, broke or defaced the fame, thall, and is hereby required to take and receive the fame at the Rate it was coined for; and if any Queftion or Difpute fhall arife, whether the Piece fo cut be counterfeit, it shall be heard and finally determined by the Mayor, Bailiff or Bailiffs, or other Chief Officer of any City or Town Corporate, where fuch Tender fhall be made; and if fuch Tender fhall be made out of any City or Town Corporate, then by the next Juftice of the Peace of the County, inhabiting or being near the Place where fuch Tender fhall be made; and the faid Mayor, or other Chief Officer, and Justice of the Peace fhall have full Power and Authority to administer an Oath as he fhall fee convenient, to any Perfon, for the determining any Queftions relating to the faid Piece. II. And be it further enacted by the Authority aforefaid, That the Tellers of the Receipt of the Exchequer, and their Deputies and Clerks, and Receivers General of every Branch of His Majefty's Revenue, Aids, Impofitions, Duties and Taxes, given or granted, or to be hereafter given or granted, fhall and are hereby required, to cut, break or deface, or caufe to be cut, broken or defaced, every Piece of counterfeit, or unlawfully diminished Silver Money, that fhall be tendred in Payment to them to the Ufe of His Majefty, His Heirs or Succeffors, or for any Part of the Revenue, Aids, Impofitions, Duties or Taxes

of His Majefty, His Heirs or Succeffors; and the better to difcover Silver Money that is counterfeit, or unlawfully diminished, from that which is good and true, the Tellers and Receivers General, and their refpective Deputies and Clerks, fhall weigh in whole Sums, or otherwife, all Silver Money by them received; and if the fame, or any Piece thereof, fhall, by the Weight or and to weigh all otherwife, appear to be counterfeit, or unlawfully diminished, Silver Money the fame fhall not be received by or from them in the faid Receipt of the Exchequer, nor be allowed them upon their respective Accounts.

III. And be it further enacted by the Authority aforefaid, That an Act made the laft Seffion of this prefent Parliament,

An Act to repeal an Act made in the nine and thirtieth Year of the Reign of Queen Elizabeth, intituled, An A to refrain the exceffive making of Malt, and to discharge and vacate Orders made by Juftices of Peace by virtue thereof, for restraining Malíters from making Malt.

prefent Parliament, intituled, An Act for granting to His c. 22. Majefty certain Duties upon Malt, Mum, Sweets, Cyder and Perry, as well towards carrying on the War against France, as for the neceffary Expence of His Majefty's Houfhold, and other Occafions, a Duty of Six pence per Bufhel was laid upon Malt

made in the nine and thirtieth Year of the Reign of Queen 39 Eliz. c. 16. Elizabeth, intituled, An Ad to refrain the exceffive making of repealed. • Malt, and there hath been fome Doubt, whether the fame Act ⚫be now in Force, by reason the Title of the faid A&t was mistaken in the Act of Parliament whereby it was defigned to have been continued; yet nevertheless several Juftices of • Peace at their Quarter Seffions have taken upon them to make • Orders to fupprefs and restrain Maltters from buying of Barley to convert into Malt, and from ufing and exercising the Employ of Malting by the Space of one Year, which is a great Damage to His Majelty, by leffening the Revenue, and a Difcouragement to Malfters: For Remedy thereof, Be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the said Act made in the nine and thirtieth Year of the Reign of Queen Elizabeth be repealed, and all Orders Juftices Orders) made by Juftices of Peace for reftraining Malfters from making of Malt, fince the faid Duty of Six pence a Bufhel was laid upon Malt, are hereby vacated and discharged.

CA P. XXIII.

An Act for granting to His Majesty a further Subfidy of Tunnage and Poundage, towards railing the yearly Sum of feven hundred thousand Pounds, for the Service of His Majesty's Houfhold, and other Ufes therein mentioned, during His Majesty's Life.

WHEREAS (a) Your Majefty's most dutiful and loyal Subjects the Commons of England in Parliament affembled, being deeply fenfible of the great Bleffings which, by the Goodness of Almighty God, we and all other the Subjects of Your Majesty's Realms and Dominions, in the free Exercife of the true Chriftian Religion (the most valuable Benefit which can be bestowed on any Nation or People) as also in our Liberties and Properties, do fully enjoy under Your Majefty's moft aufpicious Government; and being defirous to make a grateful Acknowledgment of Your Majefty's unparalleled • Grace and Favour to us Your Commons, and particularly for the great and fuccefsful Undertakings and Atchievements, whereby Your Majefty hath been the happy Inftrument of fecuring the aforefaid Bleffings to us and our Pofterities;' have therefore freely and unanimouйly refolved to increase Your Majefty's Revenue during Your Majefty's Reign (which God long continue) and do give and grant unto Your Moft Excellent Majefty the further Rates, Duties and Sums of Money, hereinafter mentioned; and do humbly befeech Your Majefty that it may be enacted; and be it enacted by the King's Moft Ex cellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and of the Commons, in this prefent Parliament affembled, and by Authority of the fame, That over and above all Subfidies of Tunnage and Poundage, and over and above all additional Duties, Impofitions and other Duties whatsoever, by any other Act or Acts of Parliament, or otherwise howsoever, already due or payable, or which ought to be paid to His Majefty, for or upon any Wines, Goods or Merchandizes what foever, imported or to be imported, there shall be raised, levied, collected, paid and fatisfied unto His Majefty, one other Subfidy called Tunnage, for and upon all Wines, which from and after the laft Day of January, which fhall be in the Year of our Lord One thousand fix hundred ninety nine, at any Time or Times, during His Majefty's Life, fhall be imported or brought into the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed (that is to fay) § 1.
