paid off and cleared; and out of the Revenue of the General Letter Office, or Poft Office, or the Office of the Poftmaster General, after all the Tallies charged upon the Weekly Sum of • fix hundred Pounds, iffuing out of that Revenue, pursuant to the faid Act of Parliament of the feventh Year of His Majefty's Reign, and ftill remaining unfatisfied, and all the Intereft thereof fhall be fully paid and difcharged; and out of the small Branches of His Majefty's Revenues hereinafter mentioned and expreffed, that is to fay, The First Fruits and Tenths of the Clergy; the Fines for Writs of Covenant and • Writs of Entry payable in the Alienation Office; the Poft Fines; the Revenue of the Wine Licences; the Monies arifing by Sheriffs Profers and Compofitions in the Exchequer, and by the Seizures of uncuftomed and prohibited Goods; the Revenue of the Duchy of Cornwall, and any other Revenue arifing by the Rents of Lands in England or Wales, or for Fines of Leafes of the fame, or any of them; and the Duty of four and an half per Centum in Specie, arifing in Barbadoes and the Leeward Islands in America; and out of the Monies which from and after the Commencement of this Act shall arise by the further Subfidies and Duties hereby granted;' Be it therefore further enacted, &c.

"If the aforefaid Revenues produce more than 700,000l. per “Annum, Overplus not to be disposed of but by Parliament. [Repealed as to the Overplus, 12 & 13 W. 3. c. 12. §4.]

An Act for the enlarging the Time for purchafing certain Eftates or Interefts in feveral Annuities therein mentioned.

cheerfully and unanimously prefent unto Your Majefty a further

it enacted, &c.

"Perfons having or not having Annuities for Life at 141. per
"Cent. per Annum, 6 & 7 W. 3. c. 5. may advance for every
"100l., &c. 561. for changing the fame into a certain Term
"for the Refidue of ninety fix Years, &c. or to take Effect
"after the faid Eftate for Life, &c. Perfons on Payment
"intitled to fuch Annuities charged on the refpective Funds,

An Act for granting to His Majefty, His Heirs and Suc-· ceffors, further Duties upon Stampt Vellum, Parchment and Paper.

WE

E Your Majesty's molt dutiful and loyal Subjects, the Commons in Parliament affembled, being defirous to raise fuch Aids and Supplies as may be proportionable to Your Majesty's great and extraordinary Occafions, do humbly present Your Majefty with the free Gift of the further Rates and Duties hereinafter mentioned; and do befeech Your Majefty that it may be enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons in Parliament affembled, and by Authority of the fame, That from and after the first Day From 1 Aug. of Auguft in the Year of our Lord One thousand fix hundred 1698, for ever ninety eight, there fhall be throughout the Kingdom of Eng- fhall be paid to land, Dominion of Wales, and Town of Berwick upon Tweed, the King, his raifed, collected and paid unto His Majefty, His Heirs and Suc. Heirs, &c. ceffors, for ever, for the feveral and refpective Things hereinafter mentioned, which fhall be written or ingroffed at any Time or Times after the faid firft Day of Auguft One thoufand fix hundred ninety eight (over and above the Rates and Duties, and Sums of Money, now due and payable to His Majefty, or to any Perfon or Perfons, Bodies Politick or Corporate whatfoever for the fame) the feveral and respective Rates, Impofitions, Duties, Charges and Sums of Money hereinafter expreffed, in Manner and Form following (that is to fay) [Several of the Duties granted by this Aa § 1-40 are repealed by divers Aŭs, and fuch of them as remained made to ceafe, 44 G. 3. c. 98. § 1. 48 G. 3. c. 149.]

VII. For every Skin or Piece of Vellum or Parchment, or Presentation, Sheet of Paper, upon which any Presentation or Donation which &c. fhall pass the Great Seal of England, or upon which any Collation to be made by any Archbishop, or other Bishop, or any Prefentation or Donation to be made by any Patron whatsoever, of or to any Benefice, Dignity or Spiritual or Ecclefiaftical Promotion whatsoever, fhall be ingroffed or written, the Sum of forty Shillings; Provided fuch Benefice, Dignity or Promotion be of the yearly Value of ten Pounds or above in the King's Books.

IX. For every Skin or Piece of Vellum or Parchment, Sheet or Piece of Paper, upon which Admittance of any Fellow of the Admittance to College of Phyficians, or of any Attorney, Clerk, Advocate, Fellowship, &c. Proctor, Notary, or other Officer or Officers in any Court what

foever, fhall be ingroffed or written, the Sum of forty Shillings.

X. Provided, That this A&t fhall not be extended to charge, Corporations. with the Duty laft mentioned, any annual Officer in any Corporation or inferior Court, whofe Office is under the Value of ten Pounds per Annum in Salaries, Fees, or other Perquifites, but the faid annual Officer is hereby exempted and difcharged from the faid Duty.

XXIV. For every Skin or Piece of Vellum or Parchment, or Sheet of Paper, upon which any Warrant, Monition, or perfonal Decree, in any Court of Admiralty, or the Cinque Ports, shall be ingroffed or written or upon which any Beneficial Warrant or Order under the Sign Manual of His Majefty, His Heirs or Succeffors (except Warrants or Orders for the Service of the Navy, Army, and Ordnance) fhall be ingroffed or written, the Sum of two Shillings and Six pence.

XXVIII. For every Piece of Parchment or Paper, upon which any Affidavit fhall be ingroffed or written (except Affidavits taken pursuant to feveral Acts made in the thirtieth and two and thirtieth Years of the Reign of King Charles the Second, for burying in Woollen; and except fuch Affidavits as fhall be taken before the Officers of the Cuftoms, or any Juftice or Juftices of the Peace, or before any Commiffioners appointed or to be appointed by any Act of Parliament for the affeffing and levying any Aids or Duties granted or to be granted to His Majefty, His Heirs or Succeffors, and which Affidavits fhall be taken by the said Officers of the Customs, Juftices or Commiffioners, by virtue of their Authority as Juftices of the Peace or Commiffioners respectively, and not otherwife) the Sum of Six

pence.

XXX. For every Skin or Piece of Vellum or Parchment, or Sheet of Paper, upon which fhall be written or ingroffed any Indenture, Leafe or Deed Poll, not hereby otherwife charged, the Sum of Six pence; except Indentures for binding poor Parish Children Apprentices.

XXXI. For every Piece of Vellum or Parchment, or Piece of Paper, upon which any Original Writ, (except fuch Original on which a Writ of Capias iffues) Subpana, Bill of Middlefex, Latitat, Writ of Capias, Quo Minus, Writ of Dedimus Poteftatem to take anfwers, examine Witnesses, or appoint Guardians, or any other Writ whatsoever, or any other Process or Mandate that fhall iffue out of or pafs the Seals of any the Courts at Westminfler, Courts of the Great Seffions in Wales, Courts in Counties Palatine, or any other Court whatsoever, holding Plea where the Debt or Damage doth amount to forty Shillings or above, or the Thing in Demand is of that Value, fhall be ingroffed or written, (Writs of Covenants for levying Fines, Writs of Entry for fuffering Common Recoveries, and Writs of Habeas Corpus alway excepted) the Sum of Six

pence.

XL. For every Skin or Piece of Vellum or Parchment, or Sheet of Paper, upon which any Depofitions taken in the Court of Chancery, or other Court of Equity (except the Paper Draughts of Depofitions, taken by virtue of any Commiffion, before they are ingroffed) which are not herein before charged, or upon which any Copy of any Bill, Anfwer, Plea, Demurrer, Replication, Rejoinder, Interrogatories, Depofitions or other Proceedings whatsoever, in any Court of Equity, shall be ingroffed or written, the Sum of one Penny.

XLII. And for preventing Abufes committed by arresting Perfons without any Writ or legal Process to juftify the fame, by Means whereof the Duty hereby given for ever to the Crown upon fuch Procefs will be loft; Be it enacted by the Authority

aforefaid, That from and after the faid firft Day of August One
thousand fix hundred ninety eight, every Officer or Clerk be-
longing, or which fhall hereafter belong, to the Court of King's
Bench, Common Pleas or Exchequer, who fhall fign any Writ or
Procefs before Judgment, to arrest any Perfon or Perfons there-
upon, shall, at the Signing thereof, fet down upon fuch Writ or
Procefs, the Day and Year of his figning the fame, which shall
be entred upon the Remembrance, or in the Book where the
Abstract of fuch Writ or Process fhall be entred; upon Pain to
forfeit the fum of ten Pounds for every Offence or Neglect of Penalty.
fuch Officer or Clerk aforefaid, to be recovered by any Perfon
who fhall fue for the fame, in any Court of Record of His Ma-
jefty, His Heirs or Succeffors, by Action of Debt, Bill, Plaint
or Information, wherein no Wager of Law, Protection or Effoin
or more than one Imparlance fhall be allowed.

XLIII. Provided always, That this A&t or any Thing therein contained fhall not extend to charge with the faid Duties or any of them, any Bills of Exchange, Accounts, Bills of Parcel, Bills of Fees or any Bills or Notes (not fealed) for Payment of any Money at Sight, or upon Demand, or at the End of certain Days of Payment.

XLIV. Provided, That nothing in this Act contained fhall extend to charge with the faid Duties, or any of them, the Probate of any Will, or Letters of Adminiftration, of any common Seaman or Soldier, who fhall be flain or die in the Service of His Majefty, His Heirs or Succeffors, a Certificate being produced from the Captain of the Ship or Veffel, or Captain of the Troop or Company, under whom fuch Seaman or Soldier served at the Time of his Death, and Oath made of the Truth thereof, before the proper Judge or Officer, by whom fuch Probate or Adminiftration ought to be granted; which Oath fuch Judge or Officer is hereby authorized and required to adminifter, and for which no Fee or Reward shall be taken. XLV. Provided alfo, That this Act, or any Claufe therein Provifo for War contained, fhall not be conftrued to charge with any Duty, any rant of Justice of Warrant made by, or Recognizance taken before any Juftice or Peace, &c. Juftices of the Peace, or any Surrender of any Copyhold Eftate, or Copies of fuch Eftate, or any Proceedings of any Court Martial, which relate to any Trial of any common Soldier; or any Orders, Decrees or Proceedings before any Commiffioners of Sewers, or in the Court of Stannaries; but fuch Warrants, Recognizances, Surrenders, Copies, Orders, Decrees and Proceedings, fhall and are hereby declared to be exempted from the Payment of any of the Duties before mentioned in this Act.

XLVI. Provided alfo, and it is hereby enacted and declared Sea Officers to by the Authority aforefaid, That the Officers at Sea fhall by pay the fame this A&t pay the fame Duty for their Stamps that the Officers Duty as Land of the Army at Land pay by this Act, and no more upon the fame Act only; any Thing herein contained to the contrary notwithstanding.

XLVII. And it is hereby declared, That all the Duties by Duties redeemthis A&t granted to His Majefty, His Heirs and Succeffors, fhall able by Parlianevertheless be subject and liable to fuch Condition and Power of ment

Redemption by Parliament, as by any A&t of this Seffion is or fhall be declared and provided.

XLVIII. And be it further enacted by the Authority aforefaid, That for the better and more effectual levying, collecting and paying unto His Majefty, His Heirs and Succeffors, the feveral and respective Duties hereby granted for or upon stamped Vellum, Parchment and Paper, it fhall and may be lawful for His Majefty, His Heirs and Succeffors, and to and for the Commifoners of the Treasury, or any three or more of them, or the High Treafurer of England for the Time being, from Time to Time to nominate and appoint fuch Perfons as they fhall think fit, to be Commiffioners, or Officers for the ftamping and marking of Parchment, Vellum and Paper, and managing the Duties thereupon, pursuant to this Act; and that the Commiffioners fo to be appointed, fhall keep their Head Office in fome convenient Place within the Cities of London or Weftminfler; and fuch Commiffioners, or the major Part of them, are hereby impowered, under their Hands and Seals, to appoint fuch other inferior Inferio 1 Officers. Officers for the marking or ftamping of Vellum, Parchment and Paper, or for the better collecting or levying the Duties hereby granted to His Majefty, His Heirs and Succeffors, as they in their Difcretion fhall think fit; and the fame Commiffioners fhall provide from Time to Time Marks or Stamps proper for the marking and ftamping of Vellum, Parchment and Paper, according to which Marks or Stamps the King's Duties ought to be paid.

· XLIX. And whereas fuch' or the like Duties as are by this Act charged for ever upon the feveral Skins, Sheets or Pieces of Vellum, Parchment and Paper, herein before enumerated or mentioned, are alfo charged upon and payable for the fame refpectively, until the firft Day of August One thousand seven hundred and fix, by feveral former Acts of Parliament in that Behalf; fo that in Effect the Duties (as to Skins, Sheets or Pieces of Vellum, Parchment and Paper in this Act before particularly expreffed) are doubled until the faid firft Day of Auguft One thousand feven hundred and fix, but the faid Duties by the faid former Acts, and thofe by this thereupon, are appropriated or applicable to different Purpofes, fo that it is neceffary to have diftinct Accounts kept of the fame:' New for the better fecuring His Majefty's Dues, and for diftinguifhing of fuch Skins, Sheets or Picces of Vellum, Parchment and Paper as are doubly charged as aforefaid, from thofe which remain liable only to the fingle Duties on the faid former Acts; and to the Intent that the faid Duties arifing upon this and the faid former Acts, upon Vellum, Parchment, and Paper, may be iffued and applied to the refpective Ufes to which they are feverally appropriated or intended; Be it further enacted by the Authority aforefaid, That all Vellum, Parchment and Paper, be ftamped with herein before charged, and whereof the Duties are hereby intended to be doubled for a Time, as aforefaid, fhall, before any of the Matters or Things herein before mentioned to be thereupon ingroffed or written (fuch Writing or Ingroffing being after the faid firft Day of Auguft One thousand fix hundred ninety eight, and before the faid firft Day of August One thoufand feven hundred and fix) be firft brought to the Head Office for the faid
