of His Majefty's Plantations, from whence fuch Ship or Veffel fhall be difpatched, are and is hereby impowered and required to take fuch Entries and Bonds, and adminifter fuch Oaths, and receive fuch Duties; and on Demand made by the faid Company, and on their Behalf, to pay the fame to the faid Company, or their Order, for the Ufes as before directed, and every other Matter and Thing to do, mutatis mutandis, as is and are herein and hereby directed and appointed, touching Masters, Owners and Traders, trading or intending to trade between Cape Mount and Cape Good Hope; and that all Goods and Merchandize (Negroes excepted) that fhall be laded or put on board any Ship or Veffel on the Coast of Africa, between Cape Blancho and Cape Mount, and fhall be imported into England, or into any of His Majefty's Plantations or Colonies aforefaid, fhall anfwer and pay the Duties aforefaid; and that the Mafter or Chief Officer of every fuch Ship or Veffel that shall lade or receive any Goods or Merchandize (Negroes excepted) on board of his or their Ship or Veffel, between Cape Blancho and Cape Mount, fhall, upon making Entry at any of His Majefty's Cuftom-houfes aforefaid, of the faid Ship or Veffel, or before any Goods or Merchandize be landed or taken out of the faid Ship or Veffel (Negroes excepted) deliver in a Manifeft or Particular of his Cargo, and take the following Oath; (videlicet)

A. B. do fwear, That the Manifeft or Particular, now by me given in and figned, to the beft of my Knowledge and Belief, doth contain, fignify and exprefs all the Goods, Wares and Merchandizes (Negroes excepted) which were laden or 'put on board the faid Ship, called the

during her Stay and continuing on the Coaft of Africa, between Cape Blancho and Cape Mount, whereof I A. B. am Master.' (a) [See as to Abolition of the Slave Trade 47 G. 3. Seff. 1. c. 36.] VIII. And that the Owner or Importer of all Goods and Merchandize (Negroes excepted) which fhall be brought to England, or any of His Majefty's Plantations, from any Port of Africa between Cape Blancho and Cape Mount aforefaid, fhall make Entry of all fuch Goods and Merchandize, at one of His Majefty's Chief Cuftom houfes in England, or in fuch of His Majesty's Plantations where the fame fhall be imported, with the Collector or other Chief Officer of the Cuftoms there, upon Oath, and fign the fame, of the Quantity, Quality and true Value of all fuch Goods and Merchandize, as they are worth to be fold at the ad pay Duty. Place of Importation, and pay the Duty for the fame, as aforefaid: And the Collector or other Chief Officer of His Majefty's Custom-houfes in England, or in any of His Majelly's Plantations, where every fuch Ship or Veffel fhall arrive, are and is hereby impowered and required to take the Entries and Manifefts, and adminifter the Oaths, and take and receive the Duties aforesaid, and on Demand made by the Company, or on their Behalf, to pay the fame to the faid Company or their Orders, for the Ufes afore directed, and fhall render and deliver to the faid Company or their Affigns, a true and fair Duplicate of all fuch Entries and Oaths made and figned as aforefaid.

IX. Provided always, The faid Collector or Officer shall deduct, for his or their Trouble, five Pounds for every hundred

Pounds for all the Duties arifing and to be received by virtue of this Act, excepting what Duty fhall arife from the Exports and Exception Imports of the faid Royal African Company, which fhall be exempted from the faid Allowance; any Thing in this Act contained to the contrary thereof in any wife notwithstanding: And that the faid Company and their Succeffors fhall give and render a particular Account in Writing of all the Monies by them received, and alfo by their Exports and Imports arifing for the Duties aforefaid, and how and in what Manner they have difpofed and laid out the fame yearly, within three Months after the Expiration of every Year, unto the Curfitor Baron of the Court of Exchequer; and the faid Curfitor Baron of the Court of Exchequer is, for the better difcovering the Truth of fuch Account, hereby impowered to examine fuch Perfon or Perfons as they judge neceffary, upon Oath, touching the Articles or Particulars in fuch Account expreffed, or as many of them as the faid Curfitor Baron of the Exchequer fhall think fit; and that all Goods and Merchandizes (Negroes excepted) which fhall be Goods landed brought from any Part of Africa, between Cape Blancho and Cape before Entry, Mount aforefaid, which fhall be unladen or landed, before Entry made and figned, and Oath of the true and real Value thereof made, and the Duty paid, as aforefaid, fhall be forfeited, or the Value thereof.

X. And for the true Performance of the Payments, Duties and Directions in this Act ordained; be it further enacted by the Authority aforefaid, That every Ship or Veffel which fhall, contrary to the true Intent and Meaning of this Act, fail from any Port or Place in England, or from any of His Majefty's Plantations or Colonies in America, to or for the Coast of Africa, as aforefaid, without being duly entred, Oath made and Bonds given, as hereinbefore is directed, fhall be forfeited, or the Value thereof, and every the Goods and Merchandize, which fhall, contrary to the true Intent and Meaning of this Act, be put on board any Ship or Veffel whatsoever, failing from England, or from any of His Majelty's Plantations or Colonies in America, to the Coaft of Africa as aforefaid, before due Entry be made of the faid Goods and Merchandize, and of the Value thereof, and the Duties paid for the fame as is before directed, fuch Goods and Merchandize fhall be forfeited, or the Value thereof; and that every Ship or Veffel, and all and every the Goods and Merchandizes therein, or belonging and appertaining to any of His Majefty's Subjects, that fhall fail or be conveyed from any other Part or Place than from England, or His Majefty's Plantations and Colonies, to the Coast of Africa as aforefaid, shall be forfeited.

XI. XII. And be it enacted by the Authority aforefaid, That for and recovered. the Recovery and obtaining all and every the Forfeitures and Penalties by this Act inflicted, it fhall and may be lawful to

and for all and every Perfon and Perfons whatsoever to fue for the fame, or any Part thereof, in any of His Majefty's Courts of Record of this Kingdom, or in any of His Majefty's Planta. tions or Colonies in America, by Bill, Plaint, Information or otherwife, wherein no Effoin, Wager of Law or Protection fhall be allowed, nor any more than one Imparlance.

XIII. Provided nevertheless, That if any Ship or Veffel trading to the Coaft of Africa, and the Goods exported therein, fhall be caft away or otherwise loft or deftroyed, before fuch Ship or Veffel fhall arrive at her Port or Place of Delivery, then the Proprietors or Exporters of the faid Goods and Merchandize in fuch Ship or Veffel fo loft or deftroyed as aforefaid, fhall, upon the ir fending any other Ship or Veffel to the Coast of Africa, be allowed fo much as was paid to the faid Company for the Goods and Merchandize so loft as afore said; any Thing hereinbefore contained to the contrary hereof in any wife notwithftanding.

XIV. Provided always, and be it enacted by the Authority aforefaid, That all Perfons being the natural-born Subjects of England, trading to the Coaft of Africa as aforefaid, and paying the Duties by this Act impofed, fhall have the fame Protection, Security and Defence for their Perfons, Ships and Goods by, from and in all the faid Forts and Caftles, and the like Freedom and Security for their Negociations and Trade, to all Intents and Purposes whatsoever, as the faid Company, their Agents, Factors and Affigus, and their Ships and Goods have, may or shall have; and that all and every Perfon and Perfons trading to Africa, and paying the Duties as aforefaid, may and are hereby impowered, at their own Charge, to fettle Factories on any Part of Africa, within the Limits aforefaid, according as they fhall judge necefary and convenient for the carrying on their Trade, without any Lett, Hindrance or Moleftation from the faid Company, their Agents, Factors or Affigns; and that all Perfons not Members of the faid Company, fo trading and paying the faid Duties, as aforefaid, fhall, together with their Ships and Goods, be free from all Molestation, Hindrances, Reftraints, Arrefts, Seizures, Penalties or other Impofitions whatfoever from the faid Company, their Agents, Factors or Affigns, for or by reafon of their fo trading; any Charter, Ufage or Cuftom to the contrary in any wife notwithstanding.

XV. Provided always, and be it enacted by the Authority aforefaid, That if any Goods or Merchandizes, which fhall be exported for the Coaft of Africa, and fhall have paid the Duties due and payable by this Act, fhall be brought back again to England, or to any of His Majefty's Plantations, it shall and may be lawful to export the fame Goods again for Africa, without paying any Duty, Oath being firft made by two credible Pèrfons not having any Property in fuch Goods, that the fame Goods have already, upon their firft Exportation, paid the Duty by this Act impofed, and a true Copy of the Entry of fuch Goods, made upon the former Exportation thereof, being first produced and attefted upon Oath of two credible Perfons as aforefaid.

XVI. And be it further enacted by the Authority aforefaid, That all the Duties and Impofitions arifing and collected and pald

paid by virtue of this Act, fhall be and are hereby appropriated taining the Forts wholly to the Maintenance of the Forts and Caftles on the Coaft and Castles in of Africa, that now are or hereafter fhall be in the Poffeffion of Africa, &c. the faid Royal African Company, and for keeping them always in good Condition and well repaired, and for the providing Ammunition and all needful warlike Stores, and a fufficient Number of Soldiers to defend the fame, and for paying the faid Officers and Soldiers belonging to them, and to no other Ufe or Purpose whatsoever; and that a juft and true Account of the faid Duties, Accounts, &c. to and laying out the fame for the Ufes above mentioned, fhall be be kept in a kept in a Book or Books for that Purpofe; which Book or Books-fhall lie open at the African Houfe fituate in London, to be perufed at all feafonable Times by all Perfons trading to Africa; and that an Account shall be stated and made up yearly and every Year at Michaelmas, or within twenty Days after, and be recorded in the Court of Exchequer.

XVII. Provided always, and be it enacted and declared by Provifo. the Authority aforefaid, That no Duty impofed by this Act fhall be required, levied or collected in England or any of the Colonies aforefaid, for any Gold or Silver imported from Africa, but that the fame may be landed without Eutry or Declaration thereof; any Thing in this Act contained to the contrary in any wife notwithstanding.

XVIII. Provided always, That nothing contained in this Act Provifo. fhall be interpreted to hinder or exclude any Perfon or Persons from trading to that Part of Africa commonly called Barbary, extending foutherly as far as Cape Blancho.

XIX. And whereas by an Act of Parliament made in the fifth and fixth Years of the Reign of His prefent Majesty and the late Queen Mary, amongst other Things it was enacted, That no other Copper than what is made of English Ore only, should be exported(); which proving very prejudicial to the Trade of England, by enabling Foreigners to export Copper much cheaper than it can be carried from England;' Be it enacted by the Authority aforefaid, That it fhall and may be lawful to Copper Bars may and for any of His Majefty's Subjects to export from England be exported. all fuch Copper Bars as have or fhall be imported into England from foreign Parts, and upon Exportation fhall draw back all Drawback. Duties or vacate the Securities; faving the half of the whole Subfidy, as is ufual in other Commodities (b).

XX And be it enacted by the Authority aforefaid, That no Governor, &c. Governor or Deputy Governor of any of His Majesty's Colonies not to be a or Plantations in America, or His Majefty's Judges in any Courts Factor, &c. there for the Time being, nor any other Perfon or Perfons, for the Ufe or on Behalf of fuch Governor or Deputy Governor or Judges, from and after the nine and twentieth Day of September One thousand fix hundred ninety eight, fhall be a Factor or Factors, Agent or Agents for the faid Company or any other Perfon or Perfons, for the Sale or Difpofal of any Negroes, and that every Person offending herein thall forfeit five hundred Penalty.

CA P. XXVII.

An Act for licencing Hawkers and Pedlars, for a further Provifion of Intereft for the Tranfport Debt, for reducing of Ireland.

WHER

THEREAS towards paying the Intereft of the Transport Debt for reducing of Ireland, an Act was made in the • Seffion held in the eighth and ninth Years of His Majefty's Reign, intituled, An Ad for licencing Hawkers and Pedlars, for a further Provifion for Payment of the Intereft of the Tran•Sport Debt for the reducing of Ireland; by which feveral Impoitions were laid upon feveral Hawkers, Pedlars, and petty • Chapmen therein mentioned; which faid Act, and the Impofitions therein, were to have Continuance only to the four and twentieth of June One thoufand fix hundred ninety eight ;' We Your Majefty's dutiful and loyal Subjects, the Commons in Parliament affembled, being willing that a further Provision be made for the Intereft of the faid Tranfport Debt, do humbly befeech Your Majesty that it may be enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the four and twentieth Day of June One thoufand fix hundred ninety eight, until the four and twentieth Day of June which fhall be in the Year of our Lord One thousand seven hundred and one, there shall be answered and paid to His Majefty, His Heirs and Succeffors, by every Hawker, Pedlar, petty Chapman, or any other trading Perfon or Perfons, going from Town to Town, or to other Men's Houses, and travelling either on Foot, or with Horfe, Horfes or otherwife, within the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed, (except as hereinafter is excepted) carrying to fell, or expofing to Sale, any Goods, Wares or Merchandizes, a Duty of four Pounds for each Year; and that every Perfon fo travelling with a Horse, Ass or Mule, or other Beaft bearing or drawing Burden, fhall pay the Sum of four Pounds for each Year (a) he or she fhall fo travel with over and above the faid firft mentioned Duty of four Pounds. II. And be it enacted by the Authority aforefaid, That every Pedlar, Hawker, petty Chapman and other trading Perfon or Perfons fo travelling as aforefaid, upon receiving his or her Licence, as is hereafter expreffed, fhall pay or caufe to be paid unto fuch Perfons as the Lord Treafurer, or Lords Commiffioners of His Majefty's Treasury for the Time being, or any three of them, fhall nominate, authorize and appoint to be Com
