An Act to repeal the Act made in the laft Seffion of Parliament, intituled, An Act for Relief of Creditors, by making Compofition with their Debtors, in cafe two Thirds in Number and Value do agree.

WHEREAS an Act made in the fecond Seffion of this

prefent Parliament, held in the eighth and ninth Years of His Majefty's Reign, intituled, An Ad for Relief of Creditors, by making Compofitions with their Debtors, in cafe two • Thirds in Number and Value do agree, hath not answered the End for which the fame was intended, in regard that notwithftanding the Provifions in the faid Act for preventing Frauds in the making fuch Compofitions, many fraudulent Practices have been committed, by making pretended Agreements with Perfons ⚫ who were not real Creditors, and for greater Advantages than what were expreffed in fuch Compofitions; which Practices have (as there is just Caufe to fear) occafioned much Perjury' For Remedy whereof be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this present Parliament affembled, and by the Authority of the fame, That from and after the twenty-fourth Day of June in the Year of our Lord One thoufand fix hundred ninety and eight, the faid Act, and every Claufe, Matter and Thing therein contained shall be repealed, determined and of no Force.

An Act for increasing His Majesty's Duties upon Luftrings and Alamodes.

WHEREAS the wrought Silks, commonly called Luftrings

and Alamodes, under the Name of wrought Silks, in and by the Book of Rates referred to in the Act of Tunnage and Poundage, which was made and paffed in the twelfth Year of the Reign of His late Majefty King Charles the Second, were valued at forty Shillings the Pound Weight, containing fixteen Ounces; and according to that Valuation are and will be • liable to pay feveral Subfidies, additional and other Duties or Impofitions to Your Majesty, by virtue of feveral Acts of Parliament fince that Time made and paffed, referring to the faid Book of Rates for the Value of the faid Silks' We Your Majefty's moft dutiful and 1yal Subjects, the Commons of England in Parliament affembled, being fenfible that the faid Silks, called

Luftrings and Alamodes, were much undervalued in the faid Book, and that the fame are ordinarily of a much higher Value than forty Shillings for fuch a Pound Weight as aforefaid, do therefore in all Humility grant, that Your Majefty's Duties for and upon all Luftrings and Alamodes imported, now payable by or according to the faid Valuation of forty Shillings the Pound Weight, fhall be increased, anfwered and paid according to the Valuation hereinafter mentioned, and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament affembled, and by Authority of the fame, That all Luftrings and Alamodes, which from and after the four and twentieth Day of June One thousand fix hundred ninety eight, hall be imported or brought into the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed, fhall be valued at four Pounds for every Pound Weight, containing fixteen Ounces as aforefaid: And His Majefty's feveral Subfidies, additional and other Duties and Impofitions as aforefaid, during the Continuance of the fame refpectively, fhall be collected, paid and answered for and upon the faid Luftrings and Alamodes, according to the faid Valuations of four Pounds for every Pound Weight, as if the fame had been originally inferted in the faid Book of Rates, and had been particularly referred to (inftead of the faid Rate of forty Shillings) in the feveral Acts before mentioned: And that according to the fame Rules and Methods, and with fuch or the like Allowances, and under fuch Penalties and Forfeitures, as are by the faid Acts, and every or any of them prefcribed, for the respective Duties on the faid Commodities; any Thing therein contained to the contrary notwithitanding.

in this prefent Parliament affembled, and by the Authority of the fame, That if any Perfon or Perfons, having been educated in, or at any Time having made Profeffion of the Chriftian Religion within this Realm, fhall by Writing, Printing, Teaching, or advifed Speaking, deny any one of the Perfons in the Holy Trinity to be God, or fhall affert or maintain there are more Gods than one, or fhall deny the Chriftian Religion to be true, or the Holy Scriptures of the old and New Teftament to be of Divine Authority, and fhall upon Indictment or Information in any of His Majefty's Courts at Westminfler, or at the Affizes, be thereof lawfully convicted by the Oath of two or more credible Witneffes; fuch Perfon or Perfons for the firf Offence fhall be adjudged incapable and difabled in Law, to all Intents and Purposes whatfoever, to have or enjoy any Office or Offices, Employment or Employments, ecclefiaftical, civil or military, or any Part in them, or any Profit or Advantage appertaining to them, or any of them: And if any Perfon or Perfons fo convicted as aforefaid, fhall at the Time of his or their Conviction, enjoy or poffefs any Office, Place or Employment, fuch Office, Place or Employment fhall be void, and is hereby declared void: And if fuch Perfon or Perfons fhall be a fecond Time lawfully convicted as aforefaid, of all or any the aforefaid Crime or Crimes, that then he or they fhall from thenceforth be disabled to fue, profecute, plead or ufe any Action or Information in any Court of Law or Equity, or to be Guardian of any Child or Executor or Adminiftrator of any Perfon, or capable of any Legacy or Deed of Gift, or to bear any Office, civil or military, or Benefice ecclefiaftical for ever within this Realm, and fhall alfo fuffer Imprisonment for the Space of three Years, without Bail or Mainprize, from the Time of fuch Conviction.

II. Provided always, and be it enacted by the Authority aforeno Profecution. faid, That no Perfon fhall be profecuted by virtue of this Act, for any Words fpoken, unless the Information of fuch Words fhall be given upon Oath before one or more Jultice or Justices of the Peace, within four Days after fuch Words fpoken, and the Profecution of fuch Offence be within three Months after fuch Information.

III. Provided alfo, and be it enacted by the Authority afore. faid, That any Perfon or Perfons, convicted of all or any of the aforefaid Crime or Crimes, in Manner as aforefaid, fhall for the firft Offence (upon his, her or their Acknowledgment and Renunciation of fuch Offence or erroneous Opinions, in the fame Court where fuch Perfon or Perfons was or were convicted, as afore. faid, within the Space of four Months after his, her or their Con viction) be difcharged from all Penalties and Diabilities incurred by fuch Conviction: any Thing in this Act contained to the contrary thereof in any wife notwithstanding.

An Act for preventing Frauds and Abufes in the charging, collecting and paying the Duties upon Marriages, Births, Burials, Batchelors and Widowers.

FOR

OR the better preventing of Frauds and Abufes in the
charging, collecting, levying, paying and accounting for

the feveral Duties granted by an Act of Parliament made and

paffed in the fixth Year of His Majefty's Reign, intituled, An 6 & 7 W. 3

Ad for granting to His Majefly certain Rates and Duties upon c.6.

• Marriages, Births and Burials, and upon Batchelors and Widowers, for the Term of five Years, for carrying on the War against France with Vigour; and which by an Act made and paffed in the eighth Year of His Majefty's Reign, intituled, An Ad for making good the Deficiencies of feveral Funds therein mentioned, and for enlarging the Capital Stock of the Bank of England, and for raifing the publick Credit, are continued until the first Day of Auguft, which fhall be in the Year of our Lord One thousand feven hundred and fix: And to the end the Produce of the faid Duties may be answered (better than the fame hath been hitherto) into the Exchequer, for or towards the Satisfaction of the Principal and Interest Monies charged thereupon: Be it enacted, &c.

CA P. XXXVI.

An Act for the Increase and Prefervation of Timber in the
New Foreft in the County of Southampton.

ORASMUCH as the Woods and Timber, not only in the faid New Foreft, but in this Kingdom in general, hath of late Years been much wafted and impaired, and the faid Foreft, that might be of great Ufe and Conveniency for Supply of His Majesty's Royal Navy, is in Danger of being deftroyed, if fome fpeedy Course be not taken to reflore and preferve the Growth of Timber there:' Be it therefore enacted by the King's Most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament affembled, and by the Authority of the fame, That two thousand Acres, Part of the Wafte Lands Foreft in Hamp of the faid New Foreft, fhall be inclofed and kept in Severalty for the Growth and Preservation of Timber, for Supply of His Majefty's faid Navy Royal; and that it fhall and may be lawful to and for His Majefty, His Heirs, and Succeffors, to inclose, fever and improve, within and out of the Parts or Places of the Wafte Lands of the faid New Foreft (the whole containing by Eftimation eighty five thousand four hundred fifty four Acres) the full Quantity of two thoufand Acres, Statute Measure, the fame to be fet out by virtue of His Majefty's Commiffion to be directed to fix or more fuch Perfons as His Majesty shall think fit (whereof two, which fhall execute fuch Commiffion, to be Juftices of the Peace for the faid County of Southampton, not being Officers of the faid Foreft) out of fuch Part and Places in the faid Foreft as fhall be found or efteemed by the faid Commiffioners, or any three or more of them, to be most convenient to be inclosed, and to be most apt and meet to produce Wood and Timber, for the future Benefit of the Kingdom, and may be beft fpared from the Commons and Highways of the County: Inclofures, how which faid Inclosure of two thousand Acres fhall be made in to be made.

Manner following; that is to fay, one thousand of the faid Acres fhall be forthwith admeasured by a fworn Surveyor, and set out and iuclofed, butted and bounded, and the Quantities, Butts and Boundaries thereof returned into His Majefty's Court of Exchequer, there to remain of Record for ever; and the remaining one thousand Acres from and immediately after the Determination of the firft Seffion of Parliament, which fhall be held after the Year of our Lord One thousand fix hundred ninety nine, fhall be in like Manner admeasured by a fworn Surveyor, and fet out and inclofed, butted and bounded, and the Quantities, Butts and Boundaries thereof returned into the faid Court of Exchequer, there to remain of Record; and alfo it fhall be lawful in like Manner to inclofe two hundred Acres more of the Waste in the faid Foreft, yearly and every Year, for the Term or Space of twenty Years, from and after the Time that the feveral Inclofures of the faid two thoufand Acres, above mentioned, fhall be made Poffeffion of the and compleated, as aforefaid; and the faid Inclosures so set out and made, as aforefaid, to remain in Severalty in the actual Pof feffion of the Crown for ever, freed and discharged of and from all Manner of Right, Title and Pretence whatfoever, according
