IV. Provided, That it fhall and may be lawful to and for them the faid Lord Archbishop, Lord Bishop, and Lord Mayor, to deduct yearly out of the faid Sums fo to be by them paid to the faid Commiffioners, as is aforefaid, any Sum not exceeding one fixth Part of what they the faid Archbishop, Bishop and Lord Mayor fhall yearly pay, during the Continuance of this Act, to their Deputics and Officers, for and in Confideration of their collecting and receiving the Duties hereby continued, and for infpecting the Coal Meters and their Deputies in their Work.

• V. And forafmuch as it is neceffary that a confiderable Sum be expended, towards the immediate repairing the faid Collegiate Church,' it is hereby further enacted, That the faid Commiffioners, or any two of them fhall be, and are hereby impowered, by Indenture under their Hands and Seals, to engage the Profits arifing out of the Sums of Money hereby granted, and to them directed to be paid, for and towards the repairing the faid Collegiate Church, or any Part or Parts of fuch Profits, as a Security for any or Sums of Money by them to be borrowed for the Intent and Purpose aforefaid, to any Perfon or Perfons who fhall or will advance any Sum or Sums upon fuch Security; all which Money fo to be borrowed, fhall be imployed in, for and towards the repairing the faid Collegiate Church of Saint Peter in Wefiminfter according to the true Intent and Meaning of this Act.

VI. And whereas the Parish Church of Saint Thomas in Southwark is fo much decayed, that of neceffity it must be rebuilt, and it being incumbent upon the Hofpital to rebuild the fame, which after fo great Charge as the Governors have been at to new build the Hofpital itself, they are not able to do, without expending a great Part of that Revenue which now is laid out for the Cure of fick and wounded Seamen and Soldiers, which in great Numbers, together with other poor People, are every Year fent thither for Help and Relief:' Be it further enacted by the Authority aforefaid, "That a Sum not exceeding three thoufand Pounds, Part of the Duty hereby granted, fhall in four Years be paid towards the building the faid Church of Saint Thomas aforefaid, according to fuch Directions as the Prefident, Treasurer and Governors of the faid Hospital, with Allowance of the Archbishop of Canterbury, the Bishop of London, and the Lord Mayor of London, for the Time being, or any two of them, fhall approve and allow; any Thing in this A&t to the contrary in any wife notwithstanding.

VII And whereas there is an annual Stipend or Allowance to the Perfon who is or fhall be Supervifor or Surveyor General of the Building of the faid Cathedral Church of Saint Paul's :' For the Encouragement of fuch Supervifor or Surveyor General, with the utmoft Diligence and Expedition to finish the fame, be it enacted by the Authority aforefaid, That from and after the nine and twentieth Day of September, which fhall be in the Year of our Lord One thoufand fix hundred ninety feven, the faid Stipend or Allowance fhall be paid in the Manner and Proportions following; that is to fay, one Moiety thereof yearly, as aforefaid, and the other Moiety in one intire Sum, within fix

An Act for paving and regulating the Hay Market in the Parishes of Saint Martin in the Fields and Saint James within the Liberty of Westminster.

HEREAS by an Act of Parliament made in the 13 & 14 Car. 2 thirteenth and fourteenth Years of Charles the Second, c. 2. late King of England, intituled, An Act for repairing the Highways and Sewers, and paving and keeping clean the Streets, in and about the Cities of London and Westminster, and for reforming of Annoyances and Disorders in the Streets of, and Places adjacent to the faid Cities, and for the regulating and • licencing of Hackney Coaches, and for the enlarging of feveral ftrait ⚫ and inconvenient Streets and Paffages (a), it was among other • Things enacted, That every Load of Hay, which from the firft Day of May One thoufand fix hundred fixty and two, fhould be brought, and ftand to be fold upon any the Ways in that Act expreffed and adjudged fit to be new paved, fhould Six pence for Load, and likewife every Cart of Straw to be fold in the faid Places fhould, after the faid Day, pay Two pence, which faid Sums fhould be paid to the Commif⚫fioners which should be appointed for the paving and mending the Highways and Streets, or fuch as they should appoint, for. and towards the paving of the Streets and Highways; And • forafmuch as the faid Act is now expired, the Owners of fuch Hay Carts and Straw Carts, which are daily brought into • and ftand in a Street commonly called the Hay Market, lying and being in the Parishes of Saint Martin's in the Fields and Saint James's within the Liberty of Weflminfter, by reason • whereof the Repairs of the faid Street are grown a great Charge to the Parishioners there inhabiting, and cannot by Law be compelled to contribute towards the paving, repairing and ⚫ amending the faid Street, to the great Grievance of the faid Parishioners:' May it therefore please Your Moft Excellent Majefty that it may be enacted, and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the five and twentieth Day of March, which Owner to pay fhall 3d, for every

fhall be in the Year of our Lord One thousand fix hundred ninety feven, the Owner of every Cart-load or Parcel of Hay, which fhall be brought into and ftand to be fold in the faid Street commonly called the Hay Market, fhall pay to fuch Perfon or Perfons as fhall be appointed by the Juftices of the Peace of the County of Middlefex, and City and Liberty of Westminfter, the Sum of Three pence, and likewife that the Owner of every Cart-load or Parcel of Straw, which fhall be brought into and stand to be fold in the faid Street, fhall after the faid Day pay the Sum of one Penny, in Ease of the Parishioners of the faid Parishes, to fuch Perfon or Perfons who fhall be appointed from Time to Time, for and towards the paving, repairing and amending the faid Street called the Hay Market. And be it further enacted by the Authority aforefaid, That the Owner or Owners of any fuch Cart-load or Parcel of Hay or Straw, having paid the refpective Sums aforefaid, and the fame being then not fold, but remaining to be brought to be fold the next Market Day, fuch Cart-load or Parcel of Hay or Straw fhall not pay again the like Sum as above, the next Market Day, for ftanding there to be fold.

III. And be it further enacted by the Authority aforefaid, That in cafe any Owner or Owners of fuch Cart-load or Parcel of Hay or Straw fhall, after the faid five and twentieth Day of March, refufe to pay the Sum of Three pence for every fuch Cart-load or Parcel of Hay, and the faid Sum of one Penny for every fuch Cart-load or Parcel of Straw, brought into, and ftanding in, the faid Street called the Hay Market, as aforefaid, it fhall and may be lawful, after Demand thereof made by fuch Perfon or Perfons as fhall be thereunto lawfully authorized, to levy the fame upon the Goods and Chattels of the Offender or. Offenders, by Warrant of Diftrefs, which any Juftice of the Peace of the County of Middlefex, or the faid City and Liberty of Wefiminfter, is hereby authorized to grant under his Hand and Seal, on Oath to be made before him by the Party who demanded the fame, that the fame is refused to be paid, and that it is not Sale of Goods. paid; which faid Goods and Chattels fhall and may be fold within three Days after the Diftrefs made, and the Overplus to be returned to the Owner, the Charge of the Distress being only deducted.

IV. And for preventing all Difputes concerning the Extent of the faid Street; Be it further enacted by the Authority aforefaid, That it shall be conftrued to extend in Length from the old Toll Poft at the upper End of the Hay Market, over against a House lately called Coventry Houfe, to the Phanix Inn at the lower End of the faid Hay Market, and the Houfe over against it, and in Breadth from the Channel running by the Houfes on the Eaft-fide to the Channel running by the Houses on the Weftfide, at which Places Poits or Stones fhall be fet up by the Direc tions of the faid Juftices of Peace, which fhall be efteemed to be the Bounds and Extent of the faid Market.

• V. And whereas by an A&t made in the second Year of His prefent Majefty and the late Queen Mary intituled, An Aa for paving and cleanfing the Streets in the Cities of London and Weftininfter, and Suburbs and Liberties thereof, and Out-Parishes • in the County of Middlesex, and in the Borough of Southwark,

and other Places within the weekly Bills of Mortality in the County of Surrey, and for regulating the Markets therein mentioned, it was amongst other Things enacted, That from and § 17. after the fifteenth Day of December One thousand fix hundred and ninety, no Perfon or Perfons whatsoever should permit or fuffer his or their Waggon, Cart or Carr, to ftand or be in the Place called the Hay Market near Piccadilly, in the Parishes • of Saint Martin's in the Fields and Saint James's within the Liberties of Westminster, loaden with Hay or Straw, to fell the fame, from Michaelmas to Lady Day, after two of the Clock in the Afternoon and from Lady Day to Michaelmas • after three of the Clock in the Afternoon, on Pain to forfeit for every Offence and Neglect five Shillings refpectively: And Penalty. whereas divers Perfons ufing the faid Place called the Hay • Market, near Piccadilly aforefaid, have had several Informations against them for offending against the faid Statute, and paid the Penalties thereof, which hath been chiefly occafioned by the Want of convenient Notice before the Times limited by the faid Act did determine, and feveral Informations on the faid Act have been given long after the fuppofed Offences committed, whereby the feveral Perfons ufing the faid Hay Market, by the Length of Time, have not been able to dif prove fuch Informations, which hath been a great Mischief and Difcouragement to the Perfons ufing the faid Hay Market: For Prevention of which Mischiefs and Inconveniencies for the Time to come, Be it enacted by the Authority aforefaid, That the faid Perfon or Perfons, fo to be from Time to Time appointed to collect the faid Toll, do twice on every Market Day, to wit, on Tuesday, Thurfday and Saturday in every Week, ring, or cause to be rung, a large Hand Bell round the faid Place called the Hay Market, before any Forfeiture of five Shillings for the faid Offence shall be incurred, whereof the first Time to be an Hour before, and the laft Time at the Expiration of the faid respective Hours in and by the faid recited A&t appointed for all Perfons using the faid Market, as aforefaid, to leave the fame;

VI. VII. And to the end a true Account may be given of the Toll to be gathered and received by virtue of this Act, Be it enacted by the Authority aforefaid, That the Perfon and Perfons that shall collect and difpofe of the Money by virtue of this A& arifing by the faid Toll, fhall yearly, every Eafter Seffions, give the Juftices of the Peace of the faid County and City, (who are hereby impowered to require the fame) a particular Account upon Oath (which the faid Juftices are hereby impowered to adminifter) of all Monies collected by virtue of this Act, and how the fame is or fhall be from Time to Time difpofed of; and in cafe on the Foot of any fuch yearly Account any Money fhall remain undifpofed of, according to the true Intent of this Act, fuch Remainder fhall be difpofed of for the Benefit of the faid County of Middlefex, in fuch Manner as the faid Juftices at fuch Seffions fhall think fit.

An Act for Relief of Creditors, by making Compofitions with their Debtors, in cafe Two-thirds in Number and Value do agree.

CA P. XIX.

An Act for repealing a Claufe in a former Act relating to Party Guiles, and for the better preventing Frauds and Abuses in Brewers and others chargeable with the Duties of Excife.

WHEREAS in one Act made in the laft Seffions of this

prefent Parliament, intituled, An Ad for laying feveral Duties upon Low Wines, or Spirits of the firft Extraction, and for preventing the Frauds and Abufes of Brewers, Difillers, and other Perfons chargeable with the Duties of Excife, it is amongst other Things enacted in the Words, or to the Effect following, (videlicet) That all common Brewers, Innkeepers or Victuallers, who after the five and twentieth Day of March One thoufand • fix hundred ninety fix, fhall brew or make a Party Guile, shall declare to the Gauger or Gaugers appointed to gauge and take an Account of the fame, how much of fuch Guile he or they intended to make into Strong Beer or Ale, and how much into fmall, before any Part of fuch Guile is cleanfed, and shall continue all the faid Strong Beer in their Tuns until the faid Small Beer fhall be carried out and delivered; and in case such Brewers, Innkeepers or Victuallers, or their refpective Servants, brewing or making fuch Guile of Beer or Ale, fhall refuse to declare to fuch Gauger or Officer, how much of their Guile or Brewing they intend to make into Strong Beer or Strong
