veral Acts of Parliament, Relation being thereunto feverally had, may more fully appear: And whereas it is found by Ex⚫perience, that the faid Rates and Duties upon Glafs and Glafs Wares are too great, fo that the Makers of those Manufactures in this Kingdom are thereby difcouraged; and that the faid Duties upon Stone Bottles, Earthen Bottles and other Stone and Earthen Wares, and the faid Duties upon Tobacco Pipes • are vexatious and troublesome, and very chargeable in the levying and collecting of the fame:' Be it therefore enacted,

II. And be it enacted by the Authority aforefaid, That from and after the tenth Day of July One thousand fix hundred ninety eight, there fhall be answered and paid to His Majefty, His Heirs and Succeffors, for and during the Term of eight Years from thence next enfuing, for and upon all Whale Fins and Scotch Linens hereinafter mentioned, as fhall be imported or brought into the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed, (over and above all Impofitions, Duties and Charges already impofed and payable upon and for the fame, by the Book of Rates or otherwife) the further Rates and Duties following; that is to fay,

III. For all Whale Fins that are or fhall be taken, caught For Whale Fins and imported in and by any Ships or Veffels whatfoever, of or imported by the belonging to the Company established for the Greenland Trade, Greenland Com. the Sum of Three pence for every Pound Weight thereof; and any. after that Rate for a greater or leffer Quantity: And for all Whale Fins which are or fhall be taken, caught, or imported by Foreigners, or by any Ships or Veffels not belonging to the faid Company, the Sum of Six pence for every Pound Weight thereof; and after that Rate for a greater or leffer Quantity; to be paid by the Importer or Importers of the fame. For all Linen of the Manufacture of Scotland, commonly For Scotch Linen called by the Name of Twill, which fhall be imported or brought for Scotch in as aforefaid, the Sum of ten Shillings for every Hundred, Ticking im containing one hundred and twenty Ells; and for all Linen of ported. the Manufacture of Scotland, commonly called by the Name of Ticking, which fhall be imported or brought in as aforefaid, the Sum of fix Shillings and eight Pence for every Hundred, containing one hundred and twenty Ells; and after those Rates for any greater or leffer Quantities; to be paid alfo by the Importer or Importers of the fame. V. And be it further enacted by the Authority aforefaid, 12 Months to That for the additional Duties hereby impofed upon the afore- pay Duties.

mentioned Goods, the Importer, giving Security at the Cuftom Houfe, fhall have Time, not exceeding twelve Months (a), for the Payment of the fame, from the Importation, to be paid by four equal and quarterly Payments; or in cafe fuch Importer fhall pay ready Money, he fhall have after the Rate of ten Pounds Goods exported per Centum of the faid Duty for a Year abated to him; and if the Goods and Merchandizes aforementioned, imported as aforefaid, for which the Duties hereby granted fhall be paid or fecured at the Importation thereof, be again exported by any Merchant English within twelve Months, or by Strangers within nine Months after the Importation, then the aforefaid Duty fhall be wholly repaid or the Security vacated as to what shall be fo exported (b). VIII. And it is hereby further enacted by the Authority aforefaid, That no Maker or Makers of the faid Manufactures of Glafs or Glafs Wares, or any of them, from and after the faid first Day of Auguft One thoufand fix hundred ninety eight, fhall draw, or caufe or fuffer to be drawn or removed from their refpective Kilns or Surrores, any Glafs or Glafs Wares, unlefs the Officer appointed to attend his or their Glafs Honfe be prefent, or without giving or fending Notice to fuch Officer, at the Place where he doth or ought to refide, within the Town or Parish wherein fuch Glafs Houfe is fituated, that the faid Officer, without his own Default, may be prefent at fuch drawing or removing of the faid Glafs, upon Pain that every fuch Maker, for every fuch Offence in not giving Notice, fhall forfeit the Sum of ten Pounds (to wit) one Moiety thereof to the King, and the other Moiety thereof to fuch as will fue for the fame by Action of Debt, or of the Cafe, Bill, Suit or Information, wherein no Effoin, Protection or Wager of Law fhall be al lowed: And it is hereby declared, That all Bottles or other filled, imported, Veffels of Glafs imported, although the fame be filled with Liwhat Duty to quors, are and fhall be liable to the Payment of one Moiety of the Duties that were charged by the faid former Act upon fuch Glafs imported.

IX. And it is hereby further enacted, That upon the Importation of any Whale Fins, Scotch Linen or Tickings hereby charged as aforefaid, an Entry or Entries thereof fhall be made in the Custom-houfe where fuch Goods fhall be imported; and in cafe any fuch Goods fhall be landed or put on Shore, out of any Ship or Veffel, before due Entry be made as aforefaid, and the Duties hereby impofed thereupon fhall be paid or fecured, or without a Warrant for the landing or delivering the fame firft figned by the Commiflioners, Collectors or other proper Officer or Officers of the Cuftoms refpectively, then all fuch imported Goods as fhall be fo landed or put on Shore, or taken out of any Ship or Veffel, contrary to the true Meaning hereof or the Value of the fame, fhall be forfeited and loft, and shall and may be recovered of the Importer or Proprietor thereof (to wit) one Moiety of the faid Forfeitures to the Ufe of the King, and the other Moiety to the Ufe of fuch Person

And be it enacted by the Authority aforefaid, That the Commiffioners faid Duties hereby granted and payable for Whale Fins, and of Cuftoms to fuch Scotch Linen as aforefaid, fhall be from Time to Time under the Management and Government of the Commiffioners of the Customs for the Time being, who fhall cause the fame to be raised, levied, collected and paid to the Hands of the Receiver or Receivers General of the Revenue of the Customs for the Time being: And fuch Receiver or Receivers General fhall from Time to Time bring the Produce thereof (the neceffary Charges of raifing and anfwering the fame only excepted) into the Receipt of the Exchequer: And that the Officers of the faid Receipt of Exchequer for the Time being, to whom it

fhall appertain, fhall from Time to Time iffue, pay and apply, Duties, how to as well the faid Duties upon Whale Fins and fuch Scotch Linens be applied. as aforefaid, arifing by this Act, as alfo fuch Part of the faid Duties upon Glafs and Glafs Wares, as is not taken away by this Act, to and for the Payment and Satisfaction of fuch Principal and Intereft Monies, whereunto the whole Duties upon Glafs and Earthen Wares and Tobacco Pipes, by any Act or Acts of Parliament now in Force, ought to have been applied, if this prefent Act had never been made; and that in fuch Order and Form, and under the like Penalties and Forfeitures, as by any fuch Act or Acts now in Force are or were provided or prefcribed for the iffuing, paying and applying of the faid whole Duties upon Glafs and Earthen Wares and Tobacco Pipes; any Thing in this Act, or any former Act or Acts of Parliament to the contrary notwith ftanding.

CA P. I.

An Act for granting an Aid to His Majefty, for difbanding the Army and other neceflary Occafions.

E it enacted by the King's Moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament assembled, and by the Authority of the fame, That the Army and all the refpective Regiments, Troops, Companies, Officers and Soldiers of the faid Army, within the Kingdom of England, Dominion of Wales and Town of Berwick upon Tweed, fhall, on or before the fix and twentieth Day of March One thousand fix hundred ninety nine, be difbanded, except fuch Regiments, Troops and Companies confifting only of His Majefty's natural-born Subjects, not exceeding feven thousand Perfons, Commiffion and Non-commiffion Officers included, as before the firft Day of March One thousand fix hundred ninety eight, fhall be particularly expreffed in and by His Majefty's Royal Proclamation under the Great Seal of England, in which Proclamation the particular Number only of each Regiment, Troop and Company fhall be expreffed.

II. And be it further enacted and declared, That immediately from and after the faid fix and twentieth Day of March One thousand fix hundred ninety nine, the faid Army, Regiments, Troops and Companies (except as before is excepted) is and are hereby actually difbanded.

III. And be it further enacted by the Authority aforefaid, That immediately from and after the faid fix and twentieth Day of March One thoufand fix hundred ninety nine, all the Regiments, Troops and Companies, Officers and Soldiers, within the Kingdom of Ireland, not being His Majefty's natural-born Subjects, be and are hereby enacted and declared to be actually dif

banded.

IV. And be it further enacted, That all other the Army, Regiments, Troops, Companies, Officers and Soldiers, within the faid Kingdom of Ireland, fhall on or before the first Day of May, One thoufand fix hundred ninety nine, be disbanded,

except fuch Regiments, Troops and Companies confifting only of His Majefty's natural-born Subjects, not exceeding twelve thoufand Perfons, Commiffion and Non-commiffion Officers included, as before the tenth Day of April One thousand fix hundred ninety nine, fhall be particularly expreffed in and by His Majefty's Royal Proclamation under the Great Seal of Ireland, in which Proclamation the particular Number only of each Regiment, Troop and Company fhall be expreffed.

V. And be it further enacted and declared, That immediately from and after the said first Day of May One thousand fix hundred ninety nine, the faid Army, Regiments, Troops and Companies in Ireland (except as before is excepted) is and are hereby actually difbanded. [See 8 G. 3. c. 13.]

VI. And be it further enacted and declared, That all fuch Forces within the faid Kingdom of Ireland, not hereby directed to be disbanded, which fhall be maintained within that Kingdom, fhall be maintained at the fole Charge of the faid Kingdom of Ireland.

VII. And be it further enacted, That all and every Commiffion Officer and Officers who fhall exercife any Power or Authority over the Soldiers in their refpective Regiments, Troops or Companies after fuch Officer or Officers fhall be difbanded, and every Perfon or Perfons that shall wittingly and willingly advife, frame, contrive, counterfign or put in Execu tion any Proclamation, Commiffion, Act, Order or Command whatsoever, for continuing together any of the faid Regiments, Troops or Companies, or Parts of Regiments, Troops or Companies after they fhall be difbanded as aforefaid, he or they fo offending fhall incur and fuftain the Pains, Penalties and Forfeitures limited, ordained and provided in and by the Statute of Provifion and Pramunire made in the fixteenth Year of King Præmunire, Richard the Second; and being thereof lawfully convicted, shall 16 R. 2. c. 5 . from thenceforth be disabled, during his Life, to fue or implead any Perfon in any Action Real or Perfonal in his own Right, or to make any Gift, Grant, Conveyance or other Difpofition of any his Lands, Tenements, Goods or Chattels which he hath to his own Ufe, either by A&t executed in his Lifetime, or by his laft Will or otherwife, or to take any Gift, Conveyance or Legacy to his own Ufe: And none of the faid Soldiers or Non-commiffioned Officers difbanded, as aforefaid, shall, after the Space of two Days after fuch difbanding, continue together above ten in a Company.

IX. Provided always, and be it enacted by the Authority aforefaid, That no Alien, who hath been, or at any Time shall be naturalized within the Kingdom of Ireland, by virtue of any Act of Parliament made or to be made within that Kingdom, or by reason of any A&t or Thing done or to be done in Purfuance thereof, fhall be adjudged or reputed to be His Majesty's natural-born Subject, within the Meaning of this A&t: nor fhall any fuch Perfon fo naturalized, or to be naturalized, be capable of being continued within any Regiment, Troop or Com
