IV. And that the King's Service, or the Bufinefs of particular Perfons, to be tranfacted at the faid Receipt from Time to Time, may not be delayed or prejudiced, Be it further enacted and declared by the Authority aforefaid, That from and after the faid twentieth Day of April One thousand fix hundred ninety feven, the Chamberlains or Deputy Chamberlains, and fuch other Officers, Minifters, Clerks and Deputies, as do belong to the Talley Court, and are neceffary for the levying of Tallies, shall daily, except upon Sundays, and fuch other Holidays as have been commonly obferved at the Receipt of Exchequer, conftantly attend there in their feveral Places, at leaft from eight of the Clock in the Forenoon, till one of the Clock in the Afternoon in every Year from Lady-day to Michaelmas, and from nine of the Clock in the Forenoon till one of the Clock in the Afternoon in every Year from Michaelmas to Lady-day, without abfenting themselves from the fame, unless they refpecIf Sick, &c. his tively be fick, or have Leave of Abfence, to be obtained from the Commiffioners of the Treasury, or the Treasurer or Under Treasurer of the Exchequer for the Time being; in which Cafes of Sickness, or Leave of Abfence, the Room or Place of fuch Perfon fick, or having Leave to be abfent, fhall be fufficiently fupplied in the mean Time as hath been accustomed; upon Pain that any fuch Officer, Minifter, Clerk or Deputy, abfenting himself contrary to this Act, whereby the Bufinefs of the King, or of any others in the faid Receipt, fhall be delayed or obftructed, fhall be liable to anfwer and make good, as well to the King as to the Party that fhall fuffer any Lofs or Damage by fuch Delay or Obttruction, double Damages, befides full Cofts of Suit; and that the Auditor of the faid Receipt, and Writer of the' Tallies and Counter Tallies, the Clerk of the Pells, the four Tellers, and other the Officers and Minifters of the faid Receipt for the Time being, fhall feverally by themfelves, at all Times when their own perfonal Attendance is neceffary and required by the ancient Practice and Usage there, and by themselves, or their refpective Deputies, Clerks or Subftitutes, at fuch Times, and for fuch Matters, wherein they or any of them may act by a Deputy, Clerk or Subftitute, give fuch due and conftant Attendance in their refpective Places, as that His Majefty, His Heirs or Succeffors, or any other Perfon or Perfons, who are to receive Money, or have other lawful Occafions there, may not be delayed or prejudiced, for Want of the due Attendance of fuch Officers, Minifters, Deputies, Clerks or Subftitutes refpectively, under the like Penalty of anfwering double Damages, befides full Cofts of Suit, as aforefaid.

V. And in regard the Bufinefs of the faid Receipt is very • much increased of late Years, and that a confiderable Truft is • repofed in the Chief Clerks there;' It is hereby further enacted by the Authority aforefaid, That the firft Clerk in the Offices of the Auditor of the Receipt, the Clerk of the Pells, and of the four Tellers aforefaid, and every of them (who are and fhall be appointed by thofe Officers refpectively, with the Approbation of the Commiffioners of the Treafury, or the Treasurer of the Exchequer for the Time being) fhall be fworn, and take their corporal Oaths, for the due, juft and faithful Performance of all Matters and Things to be done and performed by fuch Clerks in

the faid Offices respectively; and the Oaths to that Effect shall and By whom admay be adminiftred by the Commiffioners of the Treafury, or any of them, or by the Treasurer or Under Treasurer of the Exche quer, or by the Barons of the Court of Exchequer, or any of them, for the Time being.

VI. And be it further enacted and declared by the Authority By what Authoaforefaid, That none of the Monies which are, or hereafter fhall rity Money to be or remain, in the Receipt of the Exchequer, fhall be thence be iffued. iffued or paid, or be deemed to be lawfully iffued or paid, but by or in pursuance of fome fufficient Grant or Authority from His Majefty, His Heirs or Succeffors, or from fome of His Royal Predeceffors, under the Great Seal of England, or by virtue of fome fufficient Authority under the Privy Seal of His Majefty, His Heirs or Succeffors, or pursuant to fome A&t or Acts of Parliament in that Behalf and not otherwise.

VII. And for the better Satisfaction of fuch Perfons as have A Table to be lent, or shall hereafter lend, any Monies upon the Credit of any Door of the fet up at the Tax, Aid, Impofition or Revenue already granted, or hereafter Auditor's Office, to be granted, to His Majefty, His Heirs or Succeffors, it is thewing the Re hereby further enacted, That there fhall be a Table or Tables payment of the made and fet up continually at the Door of the Auditor of the Loans, faid Receipt by him or his Clerks, fhewing how far the Officers there have proceeded in the Repayment of Loans made upon the Credit of fuch Taxes, Aids, Impofitions or Revenues, and how far the Monies which fhall be paid into the Exchequer by the respective Receivers thereof do extend from Time to Time to difcharge Principal and Intereft upon the faid Taxes, Aids, Impofitions or Revenues refpectively, whereby all Perfons concerned at all fuch Times when the Office ought to be open, may without Trouble or Difficulty fee what Progrefs is daily made in the Repayment of Loans upon the feveral Regifters kept purfuant to any Act of Parliament in that Behalf.

VIII. And be it further enacted by the Authority aforefaid, Duty of the That the faid Auditor of the Receipt for the Time being fhall from Time to Time (for his juft and lawful Fees) duly enter or inroll all Letters Patents, and Letters of Privy Seal, for iffuing of the King's Treasure, and fhall draw the Orders, or make the Debentures for the iffuing thereof, as he fhall be from Time to Time required by the Commiffioners of the Treafury, or the Treafurer of the Exchequer, for the Time being, and fhall keep Entries thereof in Books to be provided and fairly written for that Purpose, and fhall weekly take the Tellers Accounts, and make Certificate to the faid Commiffioners of the Treasury, or the Treafurer for the Time being, of all Receipts, Iffues and Remains of the King's Money there, and fhall make out the Imprest Certificates from Time to Time, of all Monies there iffued upon Account, or by way of Impreft, and fhall tranfmit the ordinary Impreft Rolls Half yearly to the King's Remembrancer, in order to the charging or profecuting of Accomptants, and fhall Half yearly (to wit) at Eafter and Michaelmas, make out and tranfmit to the faid Commiffioners of the Treasury, or the Treasurer for the Time being, the Declaration of the Receipts, Iffues and Remains, at the Exchequer for every Half Year fucceffively; all which Matters and Things, and all other Matters and Things belonging to the Office or Duty of the faid Auditor of the Receipt,

IV. fhall be faithfully and carefully done and performed by the Auditor of the Receipt for the Time being, in fuch Manner as hath been anciently accustomed; and that the faid Clerk of the Pells for the Time being, fhall alfo from Time to Time (for his juít and lawful Fees) duly inroll or record all Letters Patents, and Letters of Privy Seal, for iffuing of the King's Treafure, and truly and fairly enter and record all Receipts and Iffues at the faid Exchequer, and fhall alfo take the Tellers weekly Accounts, and make Certificates to the faid Commiffioners of the Treasury, or Treasurer for the Time being, weekly, of the Receipts, Iffues and Remains, of the King's Money there, and fhalf carefully examine all the Impreft Certificates and Impreft Rolls, and make out and tranfmit to the faid Commiffioners of the Treafury, or the Treafurer for the Time being, Declarations of the Receipts, Iffues and Remains, within every Half Year; and fhall therein, and in all other Matters and Things appertaining to the Office of the Clerk of the Pells, faithfully and carefully obferve, and cause to be obferved, the ancient Course and Method of the faid Receipt; and that they the faid Auditor of the Receipt, and Clerk of the Pells, and all other Officers and Minifters of the faid Receipt, and their Deputies, Clerks and Subftitutes refpectively, fhall, in the Matters aforefaid, and in all other Matters and Things concerning their Offices, demean themselves according to their refpective Duties, and be anfwerable for the fame, as well to our Sovereign Lord the King, as to any Perfon or Perfons who may fuffer or be injured by any Neglect or Failure therein.

IX. And be it further enacted by the Authority aforefaid, That all Penalties and Forteitures for any Qffence againft this Act, fhall and may be recovered by Action of Debt, or of the Cafe, Bill, Suit or Information, in any of His Majefty's Courts of Record, wherein no Effoin, Protection, Wager of Law, or more than one Imparlance, fhall be granted or allowed.

X. Provided always, That this Act, or any Thing herein contained, fhall not extend to leffen or diminish the lawful Power, Order, Rule or Government, which the faid Commiffioners of the Treafury, and the Treasurer for the Time being, have and ought to have over the Officers and Minifters of the faid Receipt, or any other lawful Power which the faid Commiffioners of the Treafury, or Treafurer for the Time being, have and ought to have in the Execution of their Places or Trufts refpectively; any. Thing herein contained to the contrary notwithstanding.

XI. Provided alfo, That this Act, or any Thing herein contained, fhall not extend to alter or change any Method of Receipts or Payments by Bills of Credit in the Exchequer, allowed or to be allowed by Parliament; any Thing herein contained to the contrary notwithstanding.

XII. And be it further enacted and declared by the Authority aforefaid, That all the Money in the faid Receipt fhall be kept in Chefts under three different Locks, with Keys to each Cheft, and that the Tellers, or their Clerks refpectively, fhall keep but one of the faid Keys to each of the faid Chefts, and that another Key of each Cheft thall be kept by the Clerk of the Peils for the Time being, and that the other Key of each Cheil fhall be kept by the eldest of the two Deputy Chamberlains, who are employed in the ftriking of Tallies for the Time being; and that no Orders
