Other Penalties.

No Penalty, &c. for Things written in a Book or Roll, &c.

All Writings,
&c. to be written
either on or near
the Stamps, &c.

of Suit.

[Enforced and extended to all other Duties fince im pofed, 6 G.1. c.21. §56.].

III. And it is further enacted by the Authority aforefaid, That every Perfon who fhall (in or upon any Suit or Information which fhall be commenced or brought upon or in purfuance of this Act) be convicted of any the Neglects or Offences hereinbefore mentioned, fhall likewife incur all other Forfeitures and Difabilities which fuch Offender fhould or would have incurred, if he had been convicted of writing contrary to the said Acts, or any of them, the Entry of any Plaint or Action, or any Writ, Bond or other Writing, Matter or Thing on. Vellum, Parchment or Paper, not marked or ftamped according to the faid Acts, nor having any Stamp or Mark thereon refembling any of the Marks or Stamps in the faid Acts or any of them mentioned.

IV. Provided always, and be it further enacted by the Authority aforefaid, That no Officer fhall be fubject to any the Penalties, Forfeitures, Difabilities or Incapacities in this or any of the faid former Acts mentioned, for writing or caufing to be written any of the Matters or Things aforefaid, in any Book or Roll without any Marks or Stamps thereon, which fhall have been firft fhewn to and figned by the Commiffioners for the Time being, appointed to put the faid Acts in Execution, or any three or more of them, or fome Officer or Officers by them, or the major Part of them, for that Purpofe authorized and impowered, to fignify his or their leave of Approbation, that the Matters and Things to be written in fuch Book or Roll, may be therein written without any Marks or Stamps thereon, fo as the Perfon or Perfons, having the Cuftody of fuch Book or Roll, do from Time to Time (when and as often as he or they shall be thereto required) permit the faid Commiffioners, or any of them, or any Officer or Agent by them, or the major Part of them, for that Purpofe appointed, to infpect and view fuch Book or Roll, and do alfo (from Time to Time, when and as often as he or they fhall be thereto required by the faid Commiflioners, or the major Part of them, or any other by them or the major Part of them authorized) pay unto the Receiver General for the Time being of the faid Duties, or fuch other Officer or Perfon as the faid Commiffioners, or the major Part of them, fhall appoint to receive the fame, all fuch Sum and Sums of Money which, according to the true Intent and Meaning of the faid Acts, or any of them, ought to be paid, in respect of all and every fuch Matters and Things as fhall be written in fuch Book or Roll; any Thing herein or in any of the faid former Acts contained to the contrary thereof notwithstanding.

V. And be it further enacted by the Authority aforefaid, That all Writings, Matters and Things (in refpect whereof any of the faid Duties fhall be payable, and which fhall be ingroffed or written, after the faid five and twentieth Day of March One thousand seven hundred three) fhall be written in fuch Manner, that fome Part thereof fhall be either upon, or as near as conveniently may be to the Stamps or Marks, which fhall (in pursuance of the faid Acts, or any of them) be placed on the Vellum, Parchment or Paper, whereupon the fame shall be written or ingroffed, upon Pain that the Perfon who shall write

or ingrofs, or cause to be written or ingroffed, any fuch Writing, Matter or Thing, contrary to the Tenor and true Meaning hereof,

fhall for every fuch Offence forfeit the Sum of ten Pounds, with Penalty. full Cofts of Suit.

VI. And it is hereby further enacted by the Authority afore- Penalties, how faid, That the one Moiety of all the pecuniary Forfeitures, Pains to be difposed of, and Penalties hereinbefore mentioned, fhall be to Her Majefty, Her Heirs and Succeffors, and the other Moiety, with full Cofts of Suit, fhall be to any Perfon or Perfons who fhall inform and fue for the fame, or any of them, in any Court of Record, by Action of Debt, Bill, Plaint or Information, wherein no Effoin, Protection or Wager of Law fhall be allowed.

VII. And whereas fome Doubts have arifen touching the Allowances, which, by virtue of the faid former Acts, ought to be made for prefent Payment of the faid Duties; Be it therefore declared and enacted by the Authority aforefaid, That Allowance on from and after the firit Day of March One thoufand feven hun- prefent Payment of Duties. dred and two, there fhall be allowed and paid to every Perfon, who fhall at any one Time bring to be ftamped, or buy of the faid Commiffioners Paper or Parchment, the Duties whereof fhall amount to ten Pounds or upward, after the Rate of fix Pounds in the hundred Pounds per Annum, for fix Months, upon the prefent Payment of the faid Duties, at the Head Office in London or Weftminster, and not otherwife, nor any other Allowance; any Thing in the faid former Acts contained to the contrary notwithftanding. VIII. And to the end the faid Duties upon Vellum, Parchment and Paper, and all Matters incident thereunto, may be fully and duly answered and accounted for, be it further enacted by the Authority aforefaid, That the Comptroller and Accountant Comptroller of General of the faid Duties, for the Time being, fhall annually Duties to pass pafs a general Account in the Court of Exchequer, of the grofs Produce of all the faid Duties: In which Account there fhall be charged all the Monies becoming due to Her Majefty, Her Heirs or Succeffors, for all the Stamps or Marks, which fhall be impreffed or put upon any Vellum, Parchment or Paper, distinguishing thofe for which ready Money is or fhall be paid at the Head Of fice for the faid Duties in London, from those which shall be deliyered over to be otherwife fold or diftributed, and all the Monies How to be made, which fhall arife to Her Majefty, Her Heirs or Succeffors, for Penalties relating to the faid Duties, and all the Monies which fhall be paid by the Regifters of either of the two Univerfities, or by any Officers of the Law, or others, for Entries made in Books, where the Duty ought to be paid for every Entry therein, and all the Monies arifing for Vellum, Parchment and Paper, which fhall be delivered out by the Commiffioners of the faid Duties, or by their Order, for the better accommodating Her Majefty's Subjects, fo that the Profits arifing thereby, and the Kinds and Quantities fo delivered out, may plainly appear in every fuch Account; and all the Monies which fhall be fecured by any Bonds taken for the faid Duties, or any Part thereof, and all other Monies, Matters and Things whatfoever, which ought to be charged in a general or grofs Account, for the faid Duties, within the Time for which every fuch annual Account

ought to be made; and in the Difcharge of every fuch general Account, there fhall be comprehended all the Monies which fhall appear to have been duly paid or anfwered by the Receiver General of the faid Duties, within the Time of every fuch Account, and all other Salaries and incident Charges which fhall be duly allowed in or for the Management of the faid Revenues, and all the Discounts for prompt Payments, which fhall be duly made out of the faid Duties, and all the Monies which fhall be actually paid for Vellum, Parchment and Paper, bought or provided by the faid Commiffioners or their Order, for accommodating Her Majefty's Subjects, fo that the Kinds and Quantities of all the Vellum, Parchment and Paper fo provided, may alfo plainly appear in every fuch Account, and all other Matters and Things, which by the Courfe of the Exchequer ought to be discharged in an Account of this Nature.

IX. And it is hereby enacted, That all the Debts and Arrears of the faid Duties, which at the End of every fuch Account ought to be charged upon any Receivers, Diftributors or others, fhall be duly fet infuper, upon the feveral Perfons chargeable therewith, to the end the fame may be recovered by the ordinary Procefs of the faid Court, unless the Lord Treasurer, or Commiffioners of the Treasury for the Time being, fhall fee Cause to stay the faid Procefs, against the faid Perfons, or any of them, for giving them Time to pay or anfwer fuch Debts or Arrears, or any of them, and to be difcharged thereof in any fubfequent Account of fuch Comptroller and Accountant General, according to the due Courfe of the faid Court.

X. And it is hereby alfo enacted, That the Stocks of VelVellum, &c. to lum, Parchment and Paper, ftamped or unftamped, which at the End of every fuch Account ought to remain in Her Majesty's Warehoufes, or elsewhere, fhall alfo be fet down and expreffed at the Foot of every fuch Account; and that the firit of the faid general and annual Accounts fhall be for the Year to end on the firft Day of Auguft One thoufand feven hundred and three, and fhall be delivered by the faid Comptroller and Accountant General to the Auditors of Her Majefty's Imprefts and other Accounts, before the five and twentieth Day of December One thousand feven hundred and three, and fhall be fworn to by him to the best of his Knowledge, and be followed and profecuted by him in fuch Manner, that the fame fhall not, by his Negligence or Default, remain unfinished in the Court of Exchequer, beyond the first Day of May One thousand seven hundred and four; and that every fubfequent annual Account fhall in like Manner terminate on the firft Day of August (a), and be delivered to the faid Auditors, or one of them, before the five and twentieth Day of December, and profecuted, fo that the fame may be finished be fore the firft Day of May yearly, during the Continuance of the faid Duties, under the Penalty of forfeiting his Office, and the Sum of one hundred Pounds, one Moiety thereof to the Queen, and the other Moiety to fuch Perfon or Perfons who will inform or fue for the fame, to be recovered in Manner aforefaid (a) [Altered to 5th January, 39 G. 3. c.92.]

XI. Provided always, That if any fuch Comptroller and Ac countant General shall wilfully and knowingly return any Receiver, Distributor, or other Perfon, infuper, for any Monies or Stamps

duly anfwered, paid, or accounted for by fuch Receiver, Diftri-
butor, or other Perfon refpectively, whereby he or they fhall
fuftain any Damage or Prejudice; then and in every fuch Cafe,
fuch Comptroller and Accountant General shall be liable to answer
and pay Treble Damages to the Party grieved, to be recovered Penalty,
by Action of the Cafe, in any Her Majefty's Courts of Record
at Weftminster, with full Cofts of Suit, in which Action no Effoin,
Protection, Wager of Law or more than one Imparlance shall be
granted or allowed.

An Act for raising the Militia of this Kingdom for the Year One thoufand feven hundred and three, notwithstanding the Month's Pay formerly advanced be not repaid.

"THE Queen may draw out Militia before 24th June 1704. § 1.

II. And whereas fome Doubts have arifen concerning one

Militia for the Year One thousand fix hundred ninety nine, although c. 12. § 2. the Month's Pay formerly advanced be not repaid, relating to fuch Perfons as are Contributors to the finding of Horfes,

enacted and declared by the Authority aforefaid, That the faid perpetual. Claufe was intended to be, and fhall be deemed and taken to be perpetual.

III. And whereas by virtue of a Claufe contained in the faid Act made in the tenth and eleventh Years of the Reign of King

Month's Pay formerly advanced be not repaid, the Lieutenant or Lieutenants, or in their Abfence three or more of the Deputy Lieutenants for fuch County, Riding, Divifion or Place where the Eftates of Papifts and reputed Papifts, or other Perfons refufing to take the Oaths mentioned in an Act of Parliament made in the firft Year of King William and Queen Mary, intituled, An A&t for abrogating the Oaths of Allegiance 1 W. & M. and Supremacy, and appointing other Oaths, when lawfully ten- Seff. 1. c. §. dred to them, fhall or do lie, are impowered to nominate and appoint fuch Perfon or Perfons as they shall think most meet and proper to furnish or fet forth one or more Horfes, Horsemen and Arms, or Foot Soldiers and Arms, for the fame Eftates, and are impowered to charge the faid Eftates with the Pay ment of the yearly Sums therein mentioned, to fuch Perfon and • Perfons as fhall furnish and fet forth the fame, with fuch Remedies for the Recovery thereof, as are in the faid Claufe ex preffed: And whereas fome Doubts have arifen concerning the faid Claufe;' Be it therefore enacted and declared by the Au thority aforefaid, That the faid Claufe in the faid Act made in 10 & 11 W. g. the tenth and eleventh Years of the Reign of King William the c. 12. § 3. Third, was intended to be, and fhall be deemed and taken to be perpetual.

And be it further enacted, That the faid Lieutenants, or their Deputies, fhall not iffue out Warrants for the raifing any Trophy Money, till the Juftices of the Peace, or the major Part of fuch Juftices, at their feveral and refpective General QuarterSeffions for their refpective Counties, Ridings, Divifions and Places, fhall have examined, ftated and allowed the Accounts of the faid Money fo raised, levied and collected for the Year then next and immediately preceding, and certified fuch Examination of the said Accounts, under the Hands and Seals of four or more fuch Juftices.
