double the Value thereof, to be recovered of the Importer or Pro prietor thereof; to wit, one Moiety thereof to the Queen, the other Moiety thereof to him or them who fhall profecute or fue for the fame. • XV. And whereas the Proprietors who have given Securities at their Works or Pits for the Duty of Salt or Rock Salt bought of them, do often fuffer Damage by Frauda committed in the Exportation without their Privity: For Remedy whereof, be it enacted by the Authority aforefaid, That Salt entred, and where any Salt or Rock Salt fhall, after the first Day of June

One thoufand feven hundred and four, be entred, and Security fhall be given for the Duties, and certified to the Officer, according to the former Laws relating to the Duties on Salt, no fuch Salt or Rock Salt fhall afterwards be entred for Exportation by any Perfon or Perfons, not bound in the Security firft given as aforefaid, until fuch Perfon or Perfons, fo exporting fuch Salt or Rock Salt, fhall give or find fufficient Security for the Duties thereof (which the Officer for the faid Duties at the Port where the fame is fo entred for Exportation is hereby required to take); and the fame Officer fhall deliver gratis, and without Delay, a Certificate of fuch new Security taken, and upon producing fuch Certificate to the Officer of the Place where the Duty of the faid Salt was firft fecured to be paid, such first Security fhall be difcharged.

XVIII And whereas divers Merchants, and other Persons, being Subjects of this Realm of England, do fhip Salt that hath paid the Duty to Her Majefty, to convey it to fome Part of England, and the fame or Part thereof may be loft at Sea, by violent or ftormy Weather, or by being thrown over board for preferving Mens Lives, or the Veffel in which fuch Salt is fhipped, as aforefaid;' Be it therefore enacted by the Authority aforefaid, That from and after the faid firft Day of June One thousand feven hundred and four, in fuch Cafe any Mer chant or Perfon, Owner of the faid Salt, fhall, upon Proof made (by the Oaths of two or more credible Witnefies, whereof the Mafter or Mate of the Veffel to be one, before the Juftices of the Peace at the Quarter-Seffions held for the County, Riding, Divifion or Town wherein he doth inhabit, in open Court) of the Lofs of fuch Salt fo fhipped, and that the fame was not occafioned by any Leakage of the Ship or Veffel, or by any Negligence or Default of the, Mafter or Mariners, receive from the faid Seffions a Certificate that fuch Proof was made before them, and upon producing the faid Certificate to any of the Officers appointed to collect the Duties on Salt, the faid Officer or Officers are hereby required to let fuch Perfons buy the like Quantity of Salt as is expreffed in the Certificate to be loft, without paying to Her Majefty, Her Heirs or Succeffors,

any Duty or Excife for the fame; any Thing in this A& or any other Act contained to the contrary notwithstanding. [This Privilege extended to the Owners of Salt loft within the Limits of Harbours, c. by Storms, &c. 8 G 1. c. 4. §11.]

• XX. And whereas by an A& made in the first Year of the 1 Ann. Stat. 1, Reign of Her prefent Majefty it is enacted, That no Rock e 21. § 10. Salt what foever fhall be refined or made into White Salt in any Place or Places whatfoever, within the Kingdom of England, Dominion of Wales or Town of Berwick upon Tweed, (except in fuch Places as are or fhall be within ten Miles Distance of the refpective Pit or Pits, from whence fuch Rock Salt fhall be taken, or at fuch Places as, on or before the tenth Day of May One thousand feven hundred and two, fhall have been ufed for the refining Rock Salt), under a Penalty therein expreffed And whereas Lawn Marsh, in the County of Carmarthen, hath been an ancient Place used for making Salt from Sea Water; and upon feveral Occafions Rock Salt is very useful to ftrengthen the Brine in the faid Work, when weakened by fresh Water, or other Accidents; but the proper Use of the faid Salt Work not being for the refining Rock Salt, it ⚫ hath been doubted whether Rock Salt might be there used:" For preventing fuch Doubts for the future, be it enacted and Rock Salt may declared by the Authority aforefaid, That Rock Salt may be fo be ufed in ufed in the making Salt from Sea Water in the Salt Works at making Salt at Lawn Marb aforefaid; any Thing in the faid Act or in any fo as the Duties other Law or Statute to the contrary notwithstanding; fo as be paid. Her Majesty's Duties for all the Salt proceeding as well from the faid Rock Salt, as from the Sea Water, be duly charged, anfwered and paid to Her Majefty's Ule.

WHEREAS by an Act of Parliament made in the twelfth 12 & 13 W. H

• William the Third (of glorious Memory), intituled, An Aăt for appropriating three thousand feven hundred Pounds, weekly out of certain Branches of Excife, for publick Ufes, and for making a Provifion for the Service of His Majesty's Houfhold and Family and other his neceffary Occafions; It was amongst other Things enacted, That in lieu and difcharge of certain perpetual annual Payments, and of all Arrears thereof, granted by His late Majesty King Charles the Second to the refpective Patentees therein named, the Hereditary Revenue of Excife, in the faid Act mentioned, fhould from and after the twenty fixth Day of December, One thoufand feven hundred and five, be and ftand charged for ever with the Payment of annual Sums after the Rate of three Pounds per Centum per Annum, for the principal Sums mentioned in the

faid refpective Letters Patent, to be iffued and paid out of the faid Revenue, by quarterly Payments, out of the Receipt of the Exchequer, by the Officers of the fame, unto the refpective Owners and Proprietors of the feveral annual Sums, and to their Heirs and Affigns for ever, without any further < or other Warrant, to be fued for, had and obtained in that Behalf; the faid annual Payments, after the Rate of three Pounds per Centum, to be fubject nevertheless to be redeemed, on Payment of a Moiety of the principal Sums mentioned in the faid refpective Letters Patent: And whereas by an Act of Parliament made in the firit Year of the Reign of Her prefent Majesty, intituled, An Act for the better Support of Her Majefty's Houfbold, and of the Honour and Dignity of the Crown, it is (among other Things) enacted, That from and after the Expiration of the Term of five Years therein mentioned, fo much Money as, together with the faid Payments, after the Rate of the Pounds per Centum per Annum, fhould make up the Sum of three thousand seven hundred Pounds for every Week, during Her Majefty's Life, fhould and might be taken out of the faid Hereditary Duties of Excife, and out of the Duties of Excise thereby granted for Her Majefty's Life, and either or any of them; and the faid Payments, after the Rate of three Pounds per Centum per Annum, being deducted out of the Hereditary Part thereof, the Refidue of the faid three thousand feven hundred Pourds a Week fhould be applied and difpofed of to and for the publick Ufe and Service: 2 & 3 Ann. c. 3. Direction of the Act of Parliament above recited in that Behalf; and from and after Her Majefty's Decease, then the like, full, clear, entire and weekly Sum of three thousand feven hundred Pounds, of lawful English Money, out of all the Monies to arife by the faid Hereditary Duties of Excife, and < every or any of them, from Time to Time for ever, fhall be brought and paid into the Receipt of the Exchequer and that out of the Monies of the faid Hereditary Duties of Excife, arifing in or by fuch weekly Payments at the Exchequer, as aforefaid, the faid annual Sums, after the Rate of three Pounds per Centum per Annum, prefcribed by the faid Act, made in the Parliament holden in the twelfth Year of the Reign of His late Majefty King William the Third, fhall be fatisfied and paid, according to the Directions therein contained, and subject to the Power of Redemption therein mentioned, as by the faid feveral Acts, Relation being thereunto had, more at large may appear: Now for the better and more regular paying and

Auditor to certify to the Lord Treasurer the Names of Perfons intitled to Annuities at 31. per Centum per Anuum. § 1. "Every Person to have a Warrant for Payment. Payments to "be made quarterly. An Act for the Discharge out of Prifon fuch Insolvent

WHEREAS by an Act of Parliament, made in the first 1 Ann, Stat. z. Year of Her prefent Majefty's Reign, intituled, An c.25. Alt for the Relief of poor Prifoners for Debt, it was intended. and defigued by virtue thereof to fupply Her Majefty with Recruits both by Sea and Land, during this prefent War, as well as to relieve the faid poor Prifoners; but by reason no Prifoners could be discharged by virtue of the faid Act, who ⚫ were indebted above the Sum of Twenty Pounds, befides Cofts of Suit: and for that by the faid Act there was no particular Direction how they fhould lift or enter themselves in Her Majefty's Service, the fame did not answer the Intent for which it vas made: Wherefore to fupply the Defects which did obftruct the good Ends and Purposes of the faid Act,' be it enacted by the Queen's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall and may be lawful to and for the Juftices of the Peace of any County, City, Town or Liberty within the Kingdom of England, Dominion of Wales and Town of Berwick upon Tweed, where any Perfon or Perfons, being actually a Prifoner or Prifoners on the eighth Day of November, One thousand feven hundred and three, for any Debt or Damages, or for or upon any Action or Actions, or upon any Mefne Procefs for Debt or Damage, or who may have Judgment or Judgments entred upon Record againft him, her or them, or are charged in Execution, or imprifoned upon Contempts or Attachments for Debt, or upon Outlawries before or after Judgment, or upon any other Process whatfoever, for any Debt, Sum or Sums of Money, contracted before the eighth Day of November One thoufand feven hundred and three, who fhall be found or become fo poor, that he or she hath not wherewith to maintain him or herself in Prifon, without being burthenfome to their respective

fpective Relations, or the Counties, Cities or Parishes where fuch Prisoners are, then and in fuch Cafe it fhall and may be lawful Juftices of Peace to or for any of the faid Juftices of the Peace,, upon the Petition of any poor Prifoner or Prifoners, to fummon the Perfon or Perfons at whofe Suit or Suits he, fhe or they are detained in Prison, their Executors, Adminiftrators or Affigns, and alfo the Gaoler or Keeper of the Prifon where fuch poor Prifoner or Prisoners are or fhall be committed or detained, to bring fuch Debtor or Prifoner before the Juftices of the Peace at their General Seffions in open Court, with a Copy of his, her or their Caufes of Commitment. And in cafe fuch Prisoner fhall take an Oath to the Effect following, viz.

A. B. do, upon my corporal Oath, folemnly profefs and declare before Almighty God, that I have not any Eftate, Real or Perfonal, in Poffeffion, Reverfion or Remainder, of in Truft, of the Value of ten Pounds in the whole, or fufficient to pay the Debt or Damage for which I am imprisoned; and, that I have not directly or indirectly fold, leafed or otherwife conveyed, difpofed of or intrufted all or any Part of my Eftate, thereby to fecure the fame, to receive or expect any. • Profit or Advantage thereof, or to defraud or deceive any Cre⚫ditor or Creditors whatsoever, to whom I stand indebted."

II. Which Oath the faid Juftices of the Peace, at their General or Quarter-Seffions in open Court, are hereby impowered to adminifter, and to examine upon Oath the Prifoner, or any other Perfon, about the Prifoner's Poverty, if they fee Caufe; and alfo the Summoner, of the true Service and Notice given to the Creditor or Creditors, their Executors, Adminiftrators or Affigns, Gaoler or other Perfon: And after the taking the faid Oath, fuch Creditor or Creditors fo fummoned, fhall fhew Caufe why fuch poor Prifoner or Prisoners fhall not be difcharged from his, her or their Imprifonment; and if fuch Creditor or Creditors, at whofe Suit or Suits fuch poor Prifoner is detained, do infift or defire the Prifoner to be kept in Prifon, the Juftices in open Court, or any two or more of them, are hereby required and impowered to caufe fuch Creditor or Creditors to provide a Maintenance for the faid poor Prisoners, not exceeding Four pence per Day, which fhall be paid to the Prifoner himself, and not to the Gaoler, Keeper or any other Perfon for him: And if within the Space of three Months after fuch Allowance by any Creditor, no Eftate of the Prifoner's fhall be discovered or made out, before two Juftices of the Peace of the County where the Prifoner is kept in Prifon; or if the Creditor or Creditors neglect Payment of fuch daily Allowance for the Space of thirty Days, or upon the Default of the Appearance of the Creditor or Creditors fo fummoned, the Juftices of the Peace in open Court may discharge the Perfon only of fuch Prifoner, from his or her Imprifonment, from all or any Debts contracted before the faid eighth Day of November; which Order of Difcharge, being figned and fealed by any two or more of the faid Juftices, fhall fave harmless every Sheriff, Gaoler and Prifoner having a Duplicate thereof

III. Provided always, That the Discharge of the Prifoner or Prisoners shall not discharge his, her or their Debt or Debts, nor
