are therein mentioned, and thereby granted and continued for the Term of ninety fix Years, to commence from the laft Day of July One thousand seven hundred and ten; and the Duties upon Sweets thereby laid for the Term of ninety nine Years, commencing from the four and twentieth Day of March One thousand feven hundred and fix; and the additional Subfidy of Tunnage and Poundage, and other Duties upon Wines, Goods and Merchandizes, which are commonly called, as aforefaid, the one third Subfidy, by the fame Act granted, and continued for one whole Year, commencing from the Expiration of the ninety eight Years granted therein by the faid former Act; and all the Overplus Monies of the Subfidies, Rates, Duties and other Funds contained in the faid Act of the fourth Year of Your Majefty's Reign, after paying 4 & 5 Ann c. 6. or referving fufficient to pay fo much as fhall be incurred or grown due upon the faid Annuities by virtue of that Act, 6 at or before every Feaft of the Annunciation of the Bleffed Virgin Mary refpectively, the neceffary Charges of paying and accounting for the fame Annuities purchafed thereupon being excepted, are appropriated and made liable to the Payment of certain Annuities purchased upon the faid Act of the fifth Year of Your Majefty's Reign, not exceeding in the whole 5 & 6 Ann. c.17. the Sum of feventy two thousand one hundred eighty feven Pounds ten Shillings per Annum, for ninety nine Years, from the five and twentieth Day of March One thousand seven hundred and feven, payable at the faid Receipt of the Exchequer; and for the better fecuring the quarterly Payments which fhould grow due at or before Michaelmas One thou fand feven hundred and ten, upon the faid Annuities, not exceeding seventy two thousand one hundred eighty feven Pounds ten Shillings per Annum, divers other temporary Provifions are made in the faid Act of the fifth Year of Your Majefty's Reign; and thereby it is alfo provided, That if at the End of any Year of the faid Term of ninety nine years, for which the faid Annuities upon the faid A&t of the fifth Year of Your Majesty's Reign were to be purchased (the firit Computation to be made at Lady Day One thoufand feven hundred and eight, or within fix Days after) the Monies arifing at the Exchequer within fuch Year by the faid Rates, • Duties, Subfidies, Overplus Monies, and other Monies thereby appropriated for Payment of the faid Annuities, pursuant to that Act, fhall exceed all the Monies then due for or upon the fame Annuities, and all Arrearages thereof, then or at any Time or Times before that Time incurred, fo that there fhall be an Excels or Surplus remaining in the Exchequer, fuch Excefs or Surplus fhall be difpofable from Time to Time for the public Ufe and Service, and not otherwife: And whereas by an Act of Parliament made in England in the fourth Year of the Reign of Their late Majellies King William 4 W. & M. c. 3. and Queen Mary, of glorious Memory, (intituled, An Act for granting to Their Majeflies certain Rates and Duties of Excife upon Beer, Ale and other Liquors, for fecuring certain Recompences and Advantages in the faid At mentioned, to fuch Perfons as fhall voluntarily advance the Sum of ten hundred thoufand Pounds towards carrying on the War against France)

certain other Rates and Duties of Excife upon Beer, Ale and other Liquors therein particularly expreffed, were granted to Their faid late Majefties, their Heirs and Succeffors, for the Term of ninety nine Years, from the five and twentieth Day of January One thousand fix hundred and ninety two, and are by that and by feveral other Acts relating thereunto, made liable to the Payment of feveral Annuities, with Benefit of Survivorship, and other Annuities charged thereupon; which Rates and Duties of Excife lait mentioned, do alfo produce annually a confiderable Sum more than fufficient to discharge all thofe Annuities fo charged thereupon, and the neceffary Charges of paying and accounting for the fame; and the Overplus Monies thereby arifing have been and are to be computed on the four and twentieth Day of June yearly, and are comprehended amongst the temporary Provifions made in &6 Ann.c. 19. the faid Act of the fifth Year of Your Majefty's Reign, for

better fecuring the quarterly Payments of the faid Annuities, not exceeding feventy two thoufand one hundred eighty seven Pounds ten Shillings per Annum, which fhould grow due at or before the Feast of St. Michael the Archangel, which fhall be in the Year of our Lord One thousand feven hundred and ten, from which Time the Overplus Monies of the Rates and Duties of Excife laft mentioned do belong to Her Ma jefty for the public Ufe and Service:' Now we Your Majesty's moft dutiful and loyal Subjects, the Commons of Great Britain in Parliament affembled, being defirous to raise a Sum of 640,0col. to be Money not exceeding fix hundred and forty thousand Pounds,

that is to fay, a Sum not exceeding five hundred and forty thoufand Pounds, Part of the Money neceffary to be provided in this Seffion of Parliament for Your Majesty's Supply, and a Sum not exceeding one hundred thousand Pounds to be applied in fuch Manner as is hereinafter mentioned, towards making good the Payment of the Annuities to be purchafed upon this Act, do moft humbly befeech Your Majefty that it may be enacted; and be it enacted by the Queen's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the Feast of the Annunciation of the bleffed Virgin Mary, which shall be in the Year of our Lord One thoufand feven hundred and eight, for and during the full Term of ninety nine Years from thence next and immediately enfuing, the full Sum of forty thousand Pounds of lawful Money of Great Britain by the Year, or so much thereof as fhall be fufficient for paying and difcharging all the Annuities to be purchased upon this prefent Act, fhall be fet apart and appropriated, and the fame is by this Act appropriated for the Payment and Satisfaction of the faid Annuities to be purchased on this Act, in fuch Manner and Form as are hereinafter prefcribed in that Behalf.

II. And for the better raifing, fecuring and eftablishing of the faid Fund, it is hereby enacted by the Authority aforetaid, That the faid Fund or Sum not exceeding forty thousand Pounds per Annum, fhall be charged upon and payable out of all the Overplus or Surplus Monies of the faid Rates, Duties, Subfidies and other Funds fettled for Payment of the said several

Annuities

Annuities purchafed upon the faid feveral Acts of the fourth of Annuities, of and fifth Years of Her Majefty's Reign refpectively, which fhall 4 & 5 Anu. c. 6. from Time to Time remain, after fatisfying or referving in the

Exchequer fufficient to fatisfy fo much as fhall be incurred, or

grown upon thofe Annuities and every of them, and which, 5 & 6 Ann. c. 19. by the faid Act of the fifth Year of Her Majefty's Reign, were left to be difpofed from Time to Time for the publick Ufe and

Service as aforefaid; and fhall alfo be charged upon, and and Overy lus of payable out of all the Overplus Monies which fhall arife after Excise, the thirtieth Day of September One thousand feven hundred and ten, of or for the faid Rates and Duties of Excife granted 4 W. & M. c. 3.. in the faid fourth Year of the Reign of Their faid late Majefties King William and Queen Mary, and which from Time to Time, during the then Remainder of the faid Term of ninety nine Years therein granted, fhall remain, after Payment and Satisfaction of all the Annuities charged thereupon by the faid Act of the fourth Year of Their faid late Majefties Reign, or by any other Act or Acts of Parliament before this Time made for charging any Annuities whatsoever upon the Rates and Duties of Excife laft mentioned; and the Treasurer of the Treasury to Exchequer, or any three or more of the Commiffioners of the compute the Treafury for the Time being, are hereby directed from Time Overglus. to Time, during the Continuance of the faid Subfidies, Rates, Duties and other Funds fettled by the faid feveral Annuity Acts of the fourth and fifth Years of Her Majefty's Reign as aforefaid, and every or any of them, to caufe all the faid Overplus Monies of the fame Subfidies, Rates, Duties and other Funds contained in the faid feveral Annuity Acts of the faid fourth and fifth Years of Her Majefty's Reign, to be juftly and duly computed at the Feast of the Annunciation of the bleffed Virgin Mary in every Year, or within fix Days after; and during the continuance of the faid Rates and Duties of Excife granted by the faid Act of the fourth Year of the Reign of King William and Queen Mary, to caufe all the faid Overplus Monies of the fame Rates and Duties of Excife to be justly and duly computed on the four and twentieth Day of June yearly; and to caufe all the Overplus Monies which shall appear upon fuch feveral and refpective computations as aforefaid, from Time to Time, or fo much thereof as fhall be fufficient, to be fet apart, referved and applied for and towards the Application making good the faid Fund or Sum not exceeding forty thoufand thereot Pounds per Annum, hereby intended and appointed to be fettled and established for the Payment of all the Annuities to be purchafed on this Act, without diverting or mifapplying any of the Monies which by the faid former Acts, or any of them, ought upon every fuch computation to have been referved for Payment of any the Annuities formerly purchafed as aforefaid, if this prefent Act had not been made.

100,000l. referved to make good the quarterly Payment till the 30th of September 1710. § 3.

And to the End there may be no Failure in the Payment of fuch Annuities, or any of them, as fhall be purchased upon this Act at any Time or Times until the full Expiration of the Term of ninety nine Years, for which the fame are intended to be
