gers and Retailers of Salt have made great Advantages and • Gain to themselves, and used great Deceit and Wrong to the Buyers, contrary to the true Meaning of the faid A&;' For the explaining and clearing of the faid Doubts, and for Remedy and Prevention of any Deceit by Retailers of Salt for the future, Be it declared and enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament No Retailer, &c. affembled, and by the Authority of the fame, That no Badger, Retailer or other Perfon or Perfons whatfoever, making or dealing in Salt or buying Salt to fell again, fhall, from and after the five and twentieth Day of March One thousand fix hundred ninety eight, fell or put to Sale, exchange or otherwife difpofe of any Salt to any Perfon or Perfons, or in any County, City or Place whatfoever, within the Kingdom of England, Dominion of Wales, and the Town of Berwick upon Tweed, otherwise than by Weight, after the Rate of fix and fifty Pound Weight to the Bufhel, and not by Measure, or in any other Manner, and fo in Proportion for a greater or leffer Quantity, and that every Perfon offending therein, fhall for every fuch Offence forfeit the Sum of five Pounds to the Informer who fhall profecute for the fame. II. And be it further enacted by the Authority aforefaid, That the Forfeitures and Offences made and committed against this Act, or any Thing therein contained, fhall be heard, adjudged and determined by any two or more Juftices of the Peace refiding near to the Place where fuch Forfeiture shall be made, or Offence committed, who are hereby required to hear, adjudge and determine the fame; and if the Party finds him or herfelf aggrieved by the Judgment given by the faid Juftices, the faid Party fhall and may appeal to the Juftices of the Peace at the next General Quarter-Seffions of the Peace to be held for the County, City or Borough, within which the faid Forfeiture was made, and the Offence committed; who are hereby alfo impowered and authorized to hear and determine the fame, whofe Appeal to Sef Judgment therein fhall be final; and all Juftices of the Peace are hereby authorized and required, upon Complaint or Information exhibited or brought to them or any of them, of any Forfeiture made or Offence committed contrary to this Act, to fummon the How Forfeitures Party accufed; and, upon his or her Appearance or Contempt, to proceed to the Examination of the Matter of Fact; and, upon due Proof made thereof by the Oath of two or more credible Witneffes (which Oath any two or more Juftices of the Peace have hereby Power to adminifter) or by the voluntary Confeffion of the Party, to give Judgment or Sentence, according as in and by this Act is directed, and to award and iffue out Warrants under their Hands and Seals for the levying of fuch Forfeitures, as by this Act is impofed, upon the Goods and Chattels of the Offender; and to caufe Sale to be made of the faid Goods and Chattels, if the fame shall not be redeemed within fix Days, rendring to the Party the Overplus, if any be; and for Want of fufficient Diftrefs to imprison the Party offending until Satisfaction be made for the Forfeitures.

And for preventing of Delays, which may happen through the Neglect or Default of any of the Officers appointed for the collecting the faid Duty, to the great Lofs and Damage of fuch Perfons as fhall fhip off or carry by Land any Salt; Be it further enacted by the Authority aforefaid, That whenever any Salt fhall Salt entred and be entred to be put on board any Boat, Ship or Veffel, or carried Duty paid, &c. by Land, and the Duty paid or fecured to be paid, together with all Monies then or before that Time due and payable, by Bond or otherwife, upon Account of Salt before that Time delivered, the Officer with whom fuch Salt fhall be entred, and the Duty paid, or fecured to be paid, as aforefaid, fhall, upon due Notice, by himself or a fufficient Deputy, in the Day Time, between Sun rifing and Sun fetting, attend the weighing out fuch Salt, without any Lofs or Hindrance of Time to the Perfon or Perfons that fhall fhip off or carry the fame; and in case he fhall neglect or refufe fo to do, he fhall for every fuch Neglect Neglecting. or Default forfeit the Sum of forty Shillings, to be fued for, recovered, levied and received or mitigated by the fame Means, Rules,

An Act to prevent the throwing or firing of Squibbs, Serpents and other Fire Works.

W HEREAS much Mifchief hath lately happened by throwing, cafting and firing of Squibbs, Serpents Rockets and other Fire Works, fome Perfons having thereby loft their Lives, others their Eyes, others have had their Lives in great Danger, and feveral other Damages have been sustained by many Perfons, and much more may thereby happen, if not fpeedily prevented: For Remedy whereof for the future, Be it enacted by the King's Moft Excellent Majefty, by and with the. Advice and Content of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the five and twentieth Day of March One thonfand fix hundred ninety eight, it fhall not be lawful for any Perfon or Perfons, of what Age, Sex, Degree or Quality foever, to make or caufe to be made, or to fell or utter, or offer or expofe to Sale, any Squibbs, Rockets, Serpents or other Fire Works, or any Cafes, Moulds or other Implements for the making any fuch Squibbs, Serpents, Rockets or other Fire Works, or for any Perfon or Perfons to permit or fuffer any Squibbs, Serpents, Rockets or other Fire Works, to be caft, thrown or fired from, out of or in his, her or their Houfe or Houfes, Lodgings or Habitations, or from, out of or in any. Part or Place thereto belonging or adjoining, into any publick Street, Highway, Road or Paffage, or for any Perfon or Perfons, of what Degree, Quality or Age foever, to throw, caft or fire, or to be aiding or affifting in the throwing, cafting or firing of any Squibbs, Serpents, Rockets or other Fire Works, in or into any publick Street, Houfe, Shop, River, Highway, Road or Paffage, and that every fuch Offence fhall be, and is hereby adjudged to be a common Nuisance.

II. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons, of what Age, Sex, Degree or Quality foever, from and after the faid five and twentieth Day of March, fhall make or caufe to be made, or fhall fell, give or utter, or offer or expofe to Sale, any Squibbs, Rockets, Serpents or other Fire Works, or any Cafes, Moulds or other Implements for the making of any fuch Squibbs, Rockets, Serpents or other Fire. Works, that then every fuch Perfon or Perfons fo offending, and being thereof convicted before one or more Juftice or Juftices of the Peace of the County, Limit, Divifion, Corporation, Liberty, or Chief Magiftrate of the Place, where fuch Offence fhall be committed, either by the Confeffion of the Party or Parties fo offending, or the Oath of two Witnesses (which Oath the said Juftice or Justices of Peace or Chief Magiftrate is and are hereby impowered and required to adminifter) fhall for every such Offence forfeit the Sum of five Pounds: And if any Perfon or Perfons whatsoever, from and after the faid five and twentieth Day of March, fhall permit or fuffer any Squibbs, Serpents, Rockets or other Fire Works to be caft, thrown or fired from, out of or in his, her or their Houfe or Houfe, Shops, Dwelling, Lodging or Habitation, or from, out of or in any Part thereof, or Place thereto belonging or adjoi ning, into any publick Street, Highway, Road or Paffage, or any other Houfe or Place whatsoever, that then every fuch Perfon or Perfons fo as aforefaid laft offending, and being thereof as aforefaid convicted, fhall for every such Offence forfeit the Sum of twenty Shillings; the faid feveral For feitures to be levied by Diftrefs and Sale of the Goods and Chattels of every fuch Offender, by Warrant under the Hand and Seal of the faid Juftice or Juftices of the Peace or Chief Magiftrate, before whom fuch Conviction or Convictions shall be as aforefaid made; the one Half of the faid Forfeitures to be to the Ufe of the Poor of the Parish where every fuch Offence shall be committed, and the other Half to the Ufe of him or them who fhall profecute, and caufe fuch Offender or Offenders to be, as aforefaid, convicted.

III. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons, of what Age, Sex, Degree or Quality foever, from and after the faid five and twentieth Day of March, fhall throw, caft or fire, or be aiding or affifting in the throwing, cafting or firing of any Squibbs, Rockets, Serpents or other Fire Works, in or into any publick Street, House, Shop, River, Highway, Road or Paffage, that then every Perfon fo offending, and being thereof as aforefaid convicted, fhall for every fuch Offence forfeit the Sum of twenty Shillings to the Ufes aforefaid; and if the Perfon or Perfons fo as aforefaid laft offending, fhall not immediately (upon his, her or their being thereof as aforefaid convicted) pay to the faid Juftice or Juftices of the Peace or Chief Magiftrate, before whom fuch Conviction fhall be as afo efaid made, the faid Forfeiture or Forfeitures, for the Ufes aforefaid, that then every fuch Juftice or Juftices of the Peace or Chief Magiftrate is and are hereby impowered and required, by Warrant under his or their Hands and Seals, to commit every fuch Perfon or Perfons, fo as aforefaid laft offending, to the Houfe of Correction within the County, Divifion, Limit,

Corporation or Liberty, where fuch Offence as is laft mentioned. fhall be committed, there to remain to be fet and kept to hard Labour, without Bail or Mainprize, for any Time not exceeding one Month, unless fuch Offender as is laft mentioned fhall fooner pay fuch Forfeiture or Forfeitures to the said Juftice or Justices of the Peace or Chief Magistrate.

IV. Provided always, and be it further enacted by the Au- Officers of the thority aforefaid, That it fhall and may be lawful to and for the Mafter, Lieutenant or Commiffioners of His Majefty's Ordnance for the Time being, or any other Perfon or Perfons to be by them Works, &c. or any of them authorized, to give Orders and Directions for the making any Sorts of Fire Works, to be ufed and fired according to fuch Orders and Directions as fhall be from Time to Time given by the faid Mafter, Lieutenant or Commiffioners of His Majefty's Ordnance, or any other Perfon or Persons to be by them for that Purpose authorized; any Thing herein contained to the contrary thereof in any wife notwithstanding.

V. Provided always, and be it enacted, That it fhall and may be lawful to and for the Artillery Company of the City of London, or any other Artillery Company or Society of Perfons lawfully met together for the Ufe and Exercife of Arms, the Trained Bands, the Militia of this Kingdom refpectively, to make and ufe any Sorts of Fire Works in the Exercife and Practice of Arms and warlike Exploits only, in fuch Manner as they or any of them might lawfully have done before the making of this Act; any Thing herein contained to the contrary thereof in any wife notwithstanding.

VI. And be it further enacted by the Authority aforefaid, That if any Perfon be at any Time fued for putting in Execution this Act, or any the Powers therein contained, that then fuch Perfon fo fued fhall and may plead the General Iffue of Not General Issue, Guilty, and give the Special Matter in Evidence; and if the Plaintiff in fuch Suit or Action be nonfuit, or a Verdict pass for the Defendant, or if fuch Plaintiff discontinue his Action, or if upon a Demurrer Judgment be given for the Defendant, every fuch Defendant fhall have his full Treble Cofts, to be paid by Treble Cofls, fuch Plaintiff, and the like Execution for the fame, as in any Cafe where Cofts are given at Law for the Defendant.

CA P. VIII.

An Act for explaining an A&t made the last Seffion of Parliament, for granting to His Majefty certain Duties upon Malt, Mum, Sweets, Cyder and Perry.

An Act for explaining an Act made the laft Seffion of
Parliament, intituled, An Act for fupplying fome Defects
in the Larus for the Relief of the Poor of this Kingdom.
WHEREAS in and by a certain Act made in the laft

Seffion of this prefent Parliament, intituled, An A&t for fupplying fome Defects in the Laws for the Relief of the Poor of this Kingdom, it was, amongft other Things therein contained, enacted, That if any Perfon or Perfons whatsoever, that from and after the firft Day of May in the Year of our Lord One thoufand fix hundred ninety feven, fhall come into any Parish or Place (a), there to inhabit and refide, fhould at the fame Time procure, bring and deliver to the Churchwardens or Overseers of the Poor of the Parish or Place where any fuch Person should come to inhabit, or to any or either of them, a Certificate under the Hands and Seals of the Churchwardens and Overfeers of the Poor of any other Parish, Township or Place, or the major Part of them, or under the Hands and Seals of the • Overfeers of the Poor of any other Place where there are no Churchwardens, to be attefted refpectively by two or more credible Witneffes, thereby owning and acknowledging the Perfon or Perfons, mentioned in the faid Certificate, to be an Inhabitant or Inhabitants legally fettled in that Parish, Townfhip or Place; every fuch Certificate, having been allowed of and fubfcribed by two or more of the Justices of the Peace of the County, City, Liberty, Borough or Town Corporate, wherein the Parish or Place from whence any fuch Certificate fhall come doth lie, fhall oblige the faid Parish or Place to receive and provide for the Perfon mentioned in the Certificate, with his or her Family, as Inhabitants of that Parish, whenever he, fhe or they fhall happen to become chargeable to, or be forced to afk Relief of the Parish, Township or Place, to which fuck Certificate was given; and that then and not before, it should and might be lawful for any fuch Perfon, and his or her Children, though born in that Parish, not having otherwise acquired a legal Settlement there, to be removed, conveyed and settled in the Parish or Place from whence fuch Certificate was brought: And whereas fome Doubts have arifen upon Conftruction of the faid Act, by what Acts any Perfon coming to inhabit or refde within any Parith, by virtue of any fuch Certificate as
