until the number is reduced to ten, and the addition to the list of Vice-Admirals and Rear-Admirals to be in the proportion of one Vice-Admiral to every two RearAdmirals added to the list; should there be more than seven vacancies in any year the excess not to be filled up in that year, provided the list of Flag Officers is kept up to fifty.

2. That, for the present, we be also empowered to promote annually twelve (and should vacancies occur as many as fifteen) Commanders to thorank of Captain, effecting this by filling every vacancy and supplement ing any vacancies short of twelve at the end of each year, so long as a maximum number of one hundred and seventy-five Captains be not exceeded; should there be more than fifteen vacancies in any year the excess not to be filled up in that year.

"3. That, for the present, we be also empowered to promote annually twenty (and should vacancies occur as many as twenty-five) Lieutenants to the rank of Commander, effecting this by filling every vacancy, and sup plementing any vacancies short of twenty at the end of each year, so long as a maximum number of two hundred and twenty-five Commanders be not exceeded; should there be more than twenty-five vacancies in any year the excess not to b efilled up in that year, provided that the list is kept up to two hundred.

"4. That, for the present, we be authorised to sanction the optional retirement of Flag Officers and Captains at the following ages, viz.:

"Such optional retirement to be subject in each case to our approval, and to be restricted to three Flag Officers and six Captains annually, power being reserved to us, with the sanction of the Lords Commissioners of Your Majesty's Treasury, to extend this option to a larger number hereafter should such a course appear desirable.

"5. That one step in rank, according to seniority, be granted to all Rear-Admirals and Captains who may have been, or who may hereafter be, placed on the Retired List, under the provisions of Your Majesty's Order in Council of twenty-second February, one thousand eight hundred and seventy, irrespective of any qualifying service; such advancement not to carry with it any increase of retired pay.

"We further beg to state that the Lords Commissioners of Your Majesty's Treasury have given their assent to the cost of these proposals."

Her Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of Her Privy Council, to approve of what is therein proposed. And the Right Honourable the Lords Commissioners of the Admiraly are to give the necessary directions herein accordingly. C. L. PEEL.

Present:

The QUEEN'S most Excellent Majesty in Council. WHEREAS there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 27th of November 1879, in the words following, viz.:

"Whereas we have had under our consideration he effect of Your Majesty's Orders in Council of 22nd February 1870 and 5th February 1872, both as regards the limitation of the number of Lieutenants in Your Majesty's Fleet and the restrictions for the promotion of Officers to that rank, and whereas the Navigating Class of Your Majesty's Fleet is being rapidly reduced on account of the special entries for that class having been for some time past discontinued.

"We are of opinion that it is necessary:

"1. To increase the number of Lieutenants for executive duties;

"2. To supplement in addition, but gradually, the List of Lieutenants as substitutes for the Navigating Officers; and

"3. To make better provision for the promotion of Sub-Lieutenants.

"We do most humbly submit that Your Majesty will be pleased to sanction:

"1. That the number of Lieutenants for Executive duties shall be 800.

"2. That we be authorised to increase that number of Lieutenants gradually to 1,000 in proportion as the numbers on the Lists of Staff Commanders and Navigating Lieutenants fall below the number fixed by Order in Council of 1870, viz. 250, so that eventually the List of Lieutenants shall be 800 for Executive duties and 200 for Navigating duties. "3. That we be empowered to promote 75 Sub-Lientenants during the present year without reference to the number on the Lieutenant's List; and in each successive year a number that shall not exceed the number that has been added to the List of Sub-Lieutenants in the previous year. "4. That we be authorised to continue the retirement of Lieutenants on the terms sanctioned in para. 24, Chapter X. of the Order in Council of 22nd February 1870.

"The Lords Commissioners of Your Majesty's Treasury have concurred in these proposals, and we do most humbly submit that Your Majesty will be gra ciously, pleased to sanction the same being carried fato effect."

Her Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of Her Privy Council, to approve of what is therein preposed. And the Right Honourable the Lords Commis sioners of the Admiralty are to give the necessary directions herein accordingly. C. L. PEL.

The QUEEN'S most Excellent Majesty in Council. WHEREAS there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 19th of March 1880, in the words following, viz. :

"Whereas Your Majesty was graciously pleased by Order in Council of the 2nd February 1870, Sec. I Par. 6, to make the following provision as regards officers of Your Majesty's Navy accepting the Regul tions then established, viz.

'Captains retired from that rank to be entitled to rise by seniority to the rank of Retired Rear Admiral if before retirement they had served the time to qualify them for promotion,'

thus restricting the award of Retired Flag Rank to officers qualified for their Active Flag, and whereas under Your Majesty's subsequent Order in Council of the 5th August 1875 all Captains retired from that rank have become entitled to one step in rank, by seniority, irrespective of service, the distinction between officers qualified and not qualified for promotion being thereby abolished; We would humbly represent to Your Majesty that we consider the distinction reasonable, and we are of opinion that it is expedient to grant to Captains qualified for promotion a concession proportionate to that conferred by Your Majesty's Order in Council of 5th August 1875 on unqualified officers.

"We would therefore humbly submit that Your Majesty will be pleased to sanction the following provisions, viz.:

"1. Captains who have been or may be retired from that rank (unless retired on account of non-service) 2 be allowed to rise to the rank of Vice Admiral on the Retired List if before retirement they had or shall have served the time necessary to qualify a Captain for promotion to the rank of Rear Admiral on the Active List. "2. Such advancement to be conferred according to seniority, any officer hereby qualified for Vice Admiral's rank, and who has been debarred from rising above the rank of Rear Admiral by the restrictions of the Order in Council of the 22nd February 1870, to date his promotion to Vice Admiral from the day on which he would have been promoted had such restrictions not been in operation.

"3. Promotion not to confer claim to increase of Retired Pay."

Her Majesty, having taken the said Memorial int consideration, was pleased, by and with the advice of Her Privy Council, to approve of what is therein proposed. And the Right Honourable the Lords Comu sioners of the Admiralty are to give the necessary directions herein accordingly.

RETIREMENT OF NAVIGATING AND CIVIL OFFICERS.

Note. Since this Order in Council the title of Staff Surgeon has been altered to Fleet Surgeon by Order in Council of 4th February 1875; that of Surgeon to Staff Surgeon 2nd Class by Order in Council of 24th March 1873, and to Staff Surgeon by Order in Council of 4th February 1875: that of Assistant Surgeon to Surgeon by Order in Council of 24th March 1873.

hitherto in force, or under this Scheme, are to signify in writing, before the 21st of March, to the Secretary of the Admiralty, the election they have made; stating, moreover, whether they are anxious to be allowed to retire, in order to facilitate the reduction of the Active Lists. Officers not signifying their intentions before that date will be considered to have elected the New Regulations. The subjoined scale will show the age at which Officers will be compulsorily retired, and also that at which they may optionally retire.

reckon towards retirement and for increase of full-pay and half-pay, in the proportion specified in the scales for full and half-pay, herein-after set forth, where it is termed "Junior Service."

5. A number of Navigating Officers, not exceeding in all 3 annually, may be promoted from the ranks of Staff Captain, Staff Commander, Navigating Lieutenant or Navigating Sub-Lieutenant, to be Captain, Commander, Lieutenant or Sub-Lieutenant respectively, under such Regulations as We may prescribe.

6. For the purposes of promotion on the Active List, and of rising in rank on being retired, "Sea Service" to mean Service in Her Majesty's Ships at Sea.

7. Time served while surveying Coasts and Harbours in other than regular Surveying Vessels to count as sea service for all purposes.

8. Time served in the Coast Guard on shore only to count as two-thirds service for the purpose of retirement. 9. No Navigating Officer to be entitled to the rates of pay and half-pay exceeding 158, and 98. a day respectively, unless he shall have qualified for first-class ships under such Regulations as We may prescribe.

10. All Navigating Officers who have not qualified for first-class ships to receive when retired the active halfpay they have earned by service.

1. To be retired at the age of 60 or at any age if they have not served for 5 years.

2. To have the option of retiring at the age of 55, and to be retired, irrespective of age, at Our discretion, if found physically unfit to serve.

3. The Active List of Chaplains, including Chaplains who are also Naval Instructors, to be reduced to 100.

4. Clergymen, duly qualified under such regulations as We may make, to be allowed to take temporary service in the Navy, and will be appointed as "Acting Chaplains for Temporary Service" on such occasions. While so employed, to occupy the same position, receive the same rates of pay, enjoy all the same privileges as ordinary Naval Chaplains, and be subject to the same Regulations, but not to be entitled to half-pay or other advantages at the termination of such temporary service.

5. The regulation under which Chaplains are now allowed to retire on the half-pay earned by service on attaining 15 years' seniority to be abolished."

6. Chaplains accepting any Living to be at once placed on the Retired List.

IV.-As relates to Naval Instructors.

1. To be retired at the age of 60; or at any age if they have not served for 3 years.

2. To have the option of retiring at the age of 55; and to be retired, irrespective of age, at Our discretion, if found physically unfit to serve.

3. The Active List of Naval Instructors, including Chaplains who are also Naval Instructors, to be reduced to 75.

4. The Regulation under which Naval Instructors are now allowed to retire on half-pay, after 15 years' service, to be abolished.

V.-As relates to Medical Officers.

1. Inspectors and Deputy Inspectors of Hospitals and Fleets to be retired at the age of 65; or at any age if they have not served for 5 years.

VI. As relates to Paymasters and Assistant Paymasters. 1. Paymasters to be retired at the age of 60; or at any age if they have not served for 5 years.

2. To have the option of retiring at the age of 55; and to be retired, irrespective of age, at Our discretion, if found physically unfit to serve.

3. The Active List of Paymasters, including Secre taries, to be reduced to 240.

4. The number of Assistant Paymasters, Clerks, and Assistant Clerks to be reduced to 200.

5. All service as Assistant Paymaster to be allowed to reckon towards retirement, and for increase of full-pay and half-pay, in the proportions specified in the scales for full and half-pay, herein-after set forth, where it is termed "Junior Service."

6. No Assistant Paymaster to hold the appointment of Secretary to a Commander-in-Chief, Flag Officer, or Commodore of the First Class.

7. Officers of the above ranks holding, or who may have held civil employment under the Admiralty, not entitling them to civil superannuation, to be restored to, or retained in their places on the Active List, if in all respects qualified for that List; with all advantages as to pay, half-pay, and retirement provided by Section VII, paragraph 3, of these Regulations.

VII.-Definition of Service for the above Ranks.

1. Service to mean service on full-pay.

2. For the purposes of regulating pay, half-pay, promotion, and retirement, there will be no distinction between Sea and Harbour Service, except as provided in Section I. with reference to Navigating Officers, and in Section V. with reference to Medical Officers.

3. Civil employment at or under the Admiralty, or service under any other Department which may be declared by Us, with the consent of the Lords Commis. sioners of Her Majesty's Treasury, to be for this purpose Naval Service, if it does not count for or towards Civil Superannuation, shall count as full service for increase of pay, half-pay, and towards retirement; but it shall not be deemed service for any other purpose.

4. Time on half-pay, with the exception of Civil Service at or under the Admiralty, not to count for increase of full or half-pay, nor for promotion, but to count as one-third of full service for retirement.

VIII.-FULL-PAY

The following SCALE of FULL-PAY for the under-mentioned OFFICERS of HER MAJESTY'S FLEET to be substituted for that now in force.

4. The retired pay of Officers who entered, or who sha!! hereafter enter Her Majesty's service after the age of 5, and in cases of Chaplains or Chaplains and Naval In structors after the age of 30, will not depend on their age, but on their service only. The provisions contained in first and fourth columns of the Scale of Retired Pay will
