PLEASE TAKE NOTICE, that the above named defendants hereby appeal to the Appellate Division of the Supreme Court, Second Department, from an order entered in the above entitled action in the office of the Clerk of the County of Kings, on the 22nd day of January, 1929, enjoining and restraining the defendants from maintaining a certain wall and encumbrances upon the premises of the plaintiff, described in the complaint and known as 307-309 Grand Street, Borough of Brooklyn, City of New York, and further from the order entered in the office of the Clerk of the County of Kings, on the 22nd day of January, 1929, denying the defendants' motion to dismiss the complaint upon the ground that the same fails
