be construed and adjudged to be and enure, as for and concerning the Capital Messuage and Premiffes aforefaid, To the only proper Ufe and Behoof of the faid B. M. his Heirs and Affigns for ever, according to the true Intent and Meaning of these Prefents. In Witness, &c.

A fpecial Grant of an Annuity for Life.

HIS Indenture made, &c. Between Dame

Executrix of the laft Will and Teftament of Sir T. E. Baronet, deceased, of the one Part; and S. W. of, &c. of the other Part. Whereas the faid Sir T. E. in and by his last Will and Teftament in Writing, bearing Date, &c. did give unto the faid S. W. one Annuity or yearly Rentcharge of 30 1. per Annum for and during the Term of his natural Life: And by his faid Will did alfo give and Devife all his real Estate whatfoever unto the faid Dame A. E. and made her fole Executrix thereof, as may appear. And whereas no particular Part of the faid Sir T. E.'s Estate is charged with the faid Annuity, so that the faid S. W. hath no Remedy butin Equity to recover the fame; And therefore the faid S. W. hath requested the faid Dame A. E. to fecure to him the faid Annuity, which the said Dame A. E. hath agreed to do out of the Tenements after-mentioned, being her own Inheritance, fo as the faid S. W. will release the faid Annuity given him by the faid Sir T. E.'s faid Will. Now this Indenture witneffeth, That the faid Dame A. E. in Pursuance and full Performance of the faid Agreement, and in Confideration alfo of the Sum of 5 s. of, &c. to her in Hand paid by the faid S. W. the Receipt whereof is here

by acknowledg'd; the faid Dame A. E. bath given, granted and confirmed, and by thefe Prefents doth give, &c. unto the faid S. W. and his Affigns, one Annuity or yearly Rent-charge of 30 1. of, &c..to be received, taken, had, and to be iffuing out of All that Meffuage or Tenement called, &c. fituate, &c. and now or late in the Tenure or Occupation of, &c. or his Affigns: And alfo out of all that Parcel of Arable Land or Pafture Ground, with its Appurtenances, containing, &c. fituate, &c. with all and fingular Hereditaments and Appurtenances thereunto belonging, or used, as Part or Parcel thereof: To have and to hold the faid Annuity or yearly Rent-charge of 301, abovementioned, and every Part and Parcel thereof, unto the faid S. IV. and his Affigns, for and duging the natural Life of him the faid S. W. payable and to be paid in and upon the 25th Day of September and the 25th Day of March yearly, by even and equal Portions: And if it hall happen the faid Annuity or yearly Rentcharge of 301. or any Part thereof, to be behind and unpaid in Part or in all, by the Space of 21 Days next after either of the faid Days or Times for Payment thereof, whereon the fame fhould, or of Right ought to be paid as aforefaid, that then, and fo often and at any Time thence after, it shall and may be lawful to and for the faid S. W. and his Affigns, into the faid Premiffes, or into any Part thereof, to enter and diftrain, and the Diftrefs and Diftreffes then and there found to take, lead, drive, carry away and impound, and in Pound to detain and keep, until the faid Annuity and the Arrears thereof (if any fhall happen to be), together with all Cofts and Charges thereabout, fhall be

fully paid and fatisfied. And the faid Dame A. E. for her felf, her Heirs and Affigns, doth covenant and grant to and with the faid S. W. his Executors Adminiftrators and Affigns, That she the said Dame A. E. her Heirs and Affigns, fhall and will well and truly pay or caufe to be paid unto the faid S. W, or his Affigns, the faid Annuity or yearly Rent-charge of 30l. abovementioned, at the Days and Times, and in Manner and Form above expreffed, according to the true Intent and Meaning of thefe Prefents. And alfo, That the faid Meffuages, Lands, Tenements and Hereditaments abovemention'd fo to be charged or chargeable with the faid Annuity or yearly Rent-charge. hereby granted, fhall from Time to Time be; and continue overt and fufficient for the Payment of the faid Annuity yearly, during the Life of the faid S. A Grant of an Annuity from a Father to a Son, in Confideration of a Transfer of South-Sea Stack, with a Covenant for the Father to leave: at his Death a further Provision for the Son, if an Estate doth not Defceud to him.

HIS Indenture made, a. Between A. B. of, &c. Efq; of the one Part, and J. B. of, &c. Son of the faid A. B. of the other Part. Whereas the faid A. B. hath agreed with the faid 7. B. in Confideration of 500 l. SonthSea Stock, Transferred and Affigned to him the faid A. B. by the faid 7. B. to grant to him the said . the faid A. B. hath alfo Agreed, as a further. Provifion for the faid 7. B. his Son, (over and above the faid Annuity) to leave to the faid 7. B. at the Time of his Death, in Cafe he the faid A. B. fhall die in the Life-Time of him the faid 7. B. and an Estate called, &c. in the County of, &c. now in the Poffeffion of, &c. Brother to the faid A. B. fhall not on his Death defcend to the faid 7. B. the full and juft Sum or Legacy of 500l. of, &c. Now this Indenture witneffeth, That the faid A. B. in pursuance of the Agreement above-mentioned, and for and in Confideration of the faid 500l. South-Sea Stock, to him Transferred as aforefaid, by the faid . B. his Son, Hath given and granted, and by these Presents doth give and Grant unto the faid 7. B. and his Affigns, one Annuity of 50l. per Annum of lawful Money of Great Britain. To bave and to bold the faid Annuity of 50l. per Annum unto Laid . B. and his Affigns, for and during the natural Life of him the faid A. B. payable and to be paid by the faid A. B. his Executors and Adminiftrators, by and at four Quarterly Payments in the Year, viz. On the 24th Day of June, the 29th Day of September, the 25th Day of December and the 25th Day of March, yearly, by even and equal Portions; the first Payment thereof to begin and be made on the, &c. next enfuing the Date of thefe Prefents." And the faid A. B. for himself his Executors and Administrators, doth Covenant, Promife and Grant to and with the faid 7. B. his Executors Adminiftrators and Affigns, that he the faid A. B. his Executors or Adminiftrators fball and will well and truly Pay or cause to be Paid unto the said 7. B. or his Affigns, the

Annuity or clear yearly Sum of 50 l. per Annum above-mentioned, on the Days and Times and by the four quarterly Payments in the Year above appointed, during the Life of him the faid A. B. in Manner and Form above exprefs'd, according to the true Intent and meaning of thefe Prefents, and the Agreement above recited. And alfo that he the faid A. B. fhall and will at all Times hereafter, upon the Requeft and at the Cofts and Charges of the faid 7. B. and his Affigns, make, do, and Execute, or caufe or procure to be made done and executed, all and every fuch further Acts and Acts, Thing and Things in the Law whatfoever, for the further better and more perfect granting and affuring of the faid Annuity, or clear yearly Sum of 501. per Annum to the faid 7. B. and his Af figns, for and during the Life of the faid A. B. as by the faid 7. B. or his Affigns, or his or their Counsel learned in the Law, fhall be reafonably devifed, advised and required, And the faid A. B. in further purfuance of the Agreement above-mentioned for himself his Executors and Adminiftrators, doth covenant promise and grant to and with the faid 7. B. his Executors, Adminiftrators and Affigns, that he the faid A. B. fhall and will, in cafe of his Death before the faid 7. B. either by his laft Will and Teftament, or by fome other Deed or Writing legally executed by him in his Life-time, give, bequeath, leave and appoint. to and for the only proper Ufe of him the faid 7. B. his Executors Administrators and Affigns, the full and juft Sum of 5001. of lawful Money, &c. to be paid by the Exe-, cutors of the faid A. B. within fix Months
