Mr. HENRY HAYES VOWLES, solicitor, has been apppointed to be Clerk to the Justices of Gloucester in succession to the late Mr. G. S. Blakeway. Mr. Vowles was admitted in 1900.

Mr. SIDNEY RIACH FIELD, solicitor, has been appointed to be Clerk of the Peace to the Warwickshire Standing Joint Committee. Mr. Field was admitted in 1908, and is a member of the firm of Messrs. Field and Sons, of Leamington Priors. He has been Deputy Clerk of the Peace since 1913.

(26). Wages During Illness.—I shall be glad to know whether any of your readers could refer me to any authority on the question of whether a domestic or other employee is entitled to wages and board during a temporary illness, when such employee is in receipt of sick benefit under the National Health Insurance Acts. Niblett v. Midland Railway Company (1907, 96 L. T. Rep. 462) hardly seems to be in point. OLD ROSSALLIAN.

27. CONVEYANCE-PRECEDENT STAMP DUTY.-In 1924 A. agrees to buy a house from B. for £420, pays £230 deposit, and takes possession by consent of B. In March 1926 the assignment being still incompleted, A. learns the house was mortgaged to C. by B. before the contract for sale was entered into, and C. threatened to eject A. and sell owing to non-payment of interest by B. To avoid this, A. has taken a transfer of mortgage from C., paying £250 principal, interest and costs which together with £230 deposit paid shows a balance of £60 due to A. from B. on the transaction. B. now wishes to assign to A. the equity of redemption and B. will pay A. the £60 owing to him. Will any reader suggest a precedent? Will stamp duty be paid on the original contract price? T. P.

28. PURCHASE BY INSTALMENTS.-FORM OF CONVEYANCE.— A. B. has bought a freehold house for £1000, and has agreed with the purchaser to pay £500 on completion and the balance at £1 per week. Can any of your readers suggest where a suitable precedent for this form of conveyance could be found? What are the usual clauses and who will retain the deeds? If the vendor, will he have to give an acknowledgment for production of the conveyance, or should the purchaser have an attested copy thereof?

29. ADMINISTRATION.-A. died in 1926 intestate, without issue. As neither of his relatives are available to join his widow in obtainng administration, a bank has been asked to do so. The bank informs the writer that "in cases of this kind the bank's capital fees cannot, they understand, be met out of the estate." Kindly quote authority for this. Is it suggested that these fees must come out of the widow's "portion ? M. T. O.

18. PROPERTY ON TRUST.-VESTING.-A., a widow, with the financial help of her sons B. and C., purchased in 1925 a freehold house, and took the conveyance in her name alone. A. subsequently executes a declaration of trust to the effect that she holds same on behalf of herself and B. and C. as tenants in common in equal shares. In 1925 A. makes a will bequeathing her share of the freehold house to her said sons B. and C. and appoints her sons C. and D. executors. A. died in 1926, and it is desired by B. and C. and the executors, C. and D., to vest the entirety of the premises in C. How can this desire most simply be given effect to, and who should be the parties to the requisite deed? Can your readers refer us to any precedent for any such deed? A. R. M.

On the 1st Jan. 1926 the legal estate in the house vested in A. to be held upon the statutory trusts: (See the Law of Property Act 1925, Sched. I., Part IV., par. 1 (1). On A.'s death the legal estate passed to C. and D. as her executors, the beneficial interests being vested in B. and C. as tenants in common. In order to vest the entirety in C. the following deed should be executed. The parties should be C. and D. of the first part, B. of the second part, and C. of the third part. There should be full recitals explaining how the beneficial interests arise, then C. and D. should as trustees by the direction of B. convey, and B. as beneficial owner should confirm, release and convey unto C. all the property to hold unto C. in fee simple to the intent that C. may henceforth stand seised of the entirety freed from any estate or right of B. therein and freed from the trust for sale (See Prideaux's Precedents in Conveyancing, 22nd edit., vol. 1, p. 560; the Encyclopædia of Forms and Precedents, 2nd edit., vol. 15, p. 614). The effect of the conveyance and trust declaration of 1925 was that on the 1st Jan. 1926 A. held the entirety of the property on the statutory trusts: (Law of Property Act 1925, First Schedule, Part IV., s. 1 sub-s. 1 (b). Her will did not take effect until her death in 1926, and she could not then dispose of any part of property which she held upon trust. Her personal representatives

should appoint new trustees for sale (Trustee Act 1925, s. 36). Then new trustees should, in the deed, admit that they hold upon the statutory trusts. The proposed vesting of the entirety cannot be carried out, but the new trustees will hold upon the statutory trusts as defined in the Law of Property Act 1925, s. 35.

G. O. S. 19. UNDIVIDED SHARES-CONVEYANCE-VESTING.-By his will A. appointed B. and C. his executors. A. died in 1915 seised in fee simple of six equal undivided seventh shares in an estate, Whiteacre. A.'s will was proved by C. only. In 1921 the remaining one equal undivided seventh share in Whiteacre was conveyed unto and to the use of B. and C. as joint tenants. B. and C. have now contracted to sell the whole estate in Whiteacre. It is clear that, having regard to the new Property Acts, B. and C. cannot convey as tenants in common nor, it is thought, can they convey as joint tenants holding as they do both in different capacities and in different shares. Can the difficulty be overcome by means of a vesting deed to be executed by B. and C. vesting the property in themselves? Alternatively, is there any objection to the personal representative C. causing an assent to himself and his co-trustee B. to be executed on the proceeds thereof enabling B. and C. to convey six shares as trustees and the remaining seventh share as joint tenants and beneficial owners? On the 1st Jan. 1926 the legal estate of the entirety of the land vested in the Public Trustee under the Law of Property Act 1925, Sched. I., Part IV., par. 1 (4). In order to sell B. and C. must appoint new trustees in the place of the Public Trustee. The assent of incumbrancers, if any, must be obtained to the appointment: (see par. 1 (4) (iii.). If B. and C. are in fact absolutely and beneficially entitled to the property they can appoint themselves trustees; if they are not, it would be wiser to appoint some other persons. The land will vest in the trustees so appointed as joint tenants upon the statutory trusts. B. A. B. On the 1st Jan. 1926 the entirety of Whiteacre vested in the Public Trustee : (Law of Property Act 1925, First Schedule, Part IV., s. 1, sub.-s. 4). B. and C. can request him to act or can appoint new trustees in his place (proviso (iii.) to sub-s. 4 (sup.) as amended in the Schedule to the Law of Property (Amendment) Act 1926). The Public Trustee or the new trustees can then sell Whiteacre.

20. MORTGAGE-Registration-Search.-(1) Must a first mortgagee, who subsequently makes a further advance secured by a further charge, register such charge in the Land Registry? The first mortgage was not made for the purpose of securing further advances, and the first mortgagee has received no notice of any second mortgage. He has, of course, the title deeds. (2) Must the first mortgagee search in the Land Registry for puisne mortgages before he makes the further advance? ANNUAL SUBSCRIBER.

(1) A mortgage whether legal or equitable protected by the deposit of documents relating to the legal estate does not require to be registered as a land charge. (2) As the first mortgage was not made for the purpose of securing further advances and the mortgagee is not under an obligation to make further advances the mortgage is not within those protected by sect. 94 of the Law of Property Act 1925. The first mortgagee must therefore search for puisne mortgages. Under sect. 198 registration of any instrument under the provisions of the Land Charges Act 1925 is deemed to constitute actual notice of such instrument or matter. A.

(1) No, I think not, as he holds the title deeds: (Law of Property Act 1925, s. 94, sub-s. 1 (b); s. 205 (xvii.). (2) A search for puisne mortgages might be advisable, for registration constitutes actual notice: (sect. 198 of above-mentioned Act; but see sub-sect. 2 of sect. 198). G. O. S.

21. AFFILIATION ORDER-ENFORCEMENT.-How can affiliation order be enforced against a man who has gone to Australia to avoid proceedings? Under what Acts may his salary be attached there, and what is the procedure? It is presumed that the service of the affiliation order itself may be made by leaving it at his last known place of abode in England, or is it possible and necessary to serve in Australia? A. F.

There is no procedure for enforcing this order in Australia. The Maintenance Orders (Facilities for Enforcement) Act 1920, s. 10, expressly excepts an affiliation order from the operation of that Act. G. O. S.

22. Mortgage Re-conveyanCE.—In 1924 a mortgage was made between A. B. (therein described "as mortgagor ") of the one part and Florence Ada S. (therein described as mortgagee ") of the other part. The following year a reconveyance was executed by Ada Florence S. (therein described as mortgagee ") of the one part, her correct Christian names, and A. B. (therein described " mortgagor ") of the other part. In the reconveyance it was not stated that the Christian names of the mortgagee had been erroneously described in the mortgage deed, and the mortgagee executed the reconveyance in the name of Ada Florence S., her correct name. The property has now been sold, and the purchaser's solicitors insist upon a statutory declaration being made at the vendor's expense, stating that Florence Ada S. and Ada Florence S. are one and the same person. It will be observed that the Christian names were inverted and the surname was correctly given. (1) Can the

purchaser's solicitors insist upon a statutory declaration being made at the vendor's expense; (2) Does the inversion of the Christian names in the aforesaid deeds prevent the legal estate from passing to the mortgagor on the reconveyance. (2) Assuming the legal estate was outstanding owing to the inversion of the Christian names, would not this have been got in by virtue of the Law of Property Act 1925, which says that all legal estates outstanding on the 1st Jan. 1925 shall be deemed to have been extinguished: (see paragraph of Part 2 of the First Schedule of Law of Property Act 1925; see also 1 Prest, 62, where it is stated: "Where a person or a corporation is once properly described, a subsequent error in referring to the name is immaterial, unless it be from uncertainty, by producing a doubt as to who is the grantor or grantee.").

ENQUIRER.

(1) I do not think that the purchaser can insist on a statutory declaration being made at the vendor's expense. The declaration falls within the Law of Property Act 1925, s. 45 (4) (b), replacing the Conveyancing and Law of Property Act 1881, s. 3 (6) (see Re Edwards and Rudkin, 1888, 58 L. T. Rep. 789), and is one of the expenses which must be borne by the purchaser where he requires it to be incurred. (2) As there is in this case no doubt as to who are in fact the parties, I think the mistake is immaterial and the reconveyance vested the legal estate in the mortgagor. Evidence can be produced to show that the deed was in fact executed by the proper parties. (See Re Howgate and Osborn, 86.L. T. Rep. 180; (1902) 1 Ch. 451.) (3) If this is not so, the legal estate was got in by the Law of Property Act as suggested. DE P.

(1) Upon the principle of the decision in Re Howgate and Osborn's Contract (86 L. T. Rep. 180; (1902) 1 Ch. 451) the description "Florence Ada S." is a misdescription and ought to be corrected by a statutory declaration. (2) There is a difficulty in finding out in whom the legal estate was vested at the time of the reconveyance. (3) The wording of Part II. of the First Schedule to the Law of Property Act 1925 suggests that the persons there referred to must be able to show that they are entitled to the legal estate. The Schedule is not a cure for all ills. The passage in 1 Prest. 62 seems inapplicable. The error is not subsequent, but precedent. It occurred in the mortgage which preceded the reconveyance. G. O. I think the answer to the purchaser's solicitors is to refer them to Part II. of the First Schedule of the Law of Property Act 1925, s. 3 (d) and decline to do anything further. JOHN BOYD.

23. PURCHASE ON TRUST.-LETTERS OF ADMINISTRATION.— W. W. purchased a farm in 1920. The conveyance was taken in the name of his wife, M. J. W., but the purchase money was paid by W. W. out of his own moneys. M. J. W. died intestate in Aug. 1925. Letters of Administration to the estate of M. J. W. deceased have not been taken out. W. W. states that it was not his intention to make a gift of the farm to his wife M. J. W. (1) Did M. J. W. hold the farm as trustee for her husband, as if so, the legal estate in the farm would, under the Law of Property Act 1925 become vested in W. W.? (2) If not, should W. W. take out letters of administration to the estate of M. J. W., deceased, as otherwise the legal estate will be outstanding? W. W.

Where a husband purchases property in his wife's name there is a primâ facie presumption of an intention to advance the wife. This is capable of being rebutted. If there was in fact no intention to advance the wife I think the legal estate in the property vested in W. W. on the 1st Jan. 1926 under the Law of Property Act 1925, Sched. I., Part II., 3.

The question arises as to how the purchase money was expressed to be paid in the conveyance. If it was expressed to be paid by the wife the ordinary presumption of advancement can be rebutted by parol evidence, and it would not be necessary to take out administration. If the wife accounted to her husband for the profits this would be evidence that she was a bare trustee, and the legal estate would on the 1st Jan. 1926 vest in the husband, unless the wife was a trustee for sale (Law of Property Act 1925, First Schedule, Part II., par. 3). G. O. S. 24. TITHES-RATING.-Are tithes, owned by a lay impropriator, subject to full poor rate, as buildings are, or only to one-fourth, as agricultural land is? As they issue out of land, I consider the one-fourth rate is applicable. In the Encyclopædia of Laws, p. 65, it is stated (under the heading of "Rating") that "the Courts have held that the tithe owner is rateable for them as if they were land in his occupation." This seems to favour the one-fourth view. ENQUIRER.

The Agricultural Rates Act 1923, s. 4, gives relief to any land which is " agricultural land " within the meaning of the Agricultural Rates Act 1896, and such land pays rates in the proportion only of one quarter. The Act of 1896 defines (sect. 9) agricultural land as any land used as arable, meadow, or pasture ground only, cottage gardens exceeding one quarter of an acre, market gardens, nursery grounds, orchards or allotments." I do not think this definition can be held to cover tithes, even though the tithe issues out of such lands. There is nothing to suggest such an extension anywhere in either of the Acts. I think, therefore, tithes are subject to the full rate. DE P.

Tithe rentcharge is rated at the full value, the rateable value being such sum as the rentcharge would let for to a tenant

from year to year, free from all tenants' rates and taxes and Ecclesiastical dues (R. v. Capel, 12 A. & E. 382; R. v. Goodchild, Re Hackney Tithe Commutation Rent Charges, E. B. & E. 1). JOHN BOYD.

25. ANNUITY-RELEASE-STAMP DUTY.-A. is entitled to an annuity of £4000 during the lifetime of B., and at B.'s death will be entitled to the whole of the income from the settled funds. B. during his lifetime is entitled to the residue of the income of the settled funds after payment of A.'s annuity. B. wishes to release his life interest in £80,000, part of the settled funds, on condition that A. will give up his annuity. What stamp duty would such a transaction attract? LANCASTER.

There is not sufficient information furnished for it to be possible to say what is the best method of carrying out this transaction. Primâ facie ad valorem duty is payable on the value of the annuity. There ought, however, to be some means of avoiding this. Would the case be met by B. directing the trustees to appropriate the £80,000 to the payment of A.'s annuity, and A. consenting to this and to the exoneration of the rest of the fund from the annuity? This transaction would not attract stamp duty. A.

It seems to me that the consideration which A. pays is the capital value of his annuity during B.'s life, and this will be based on the age of B., and can be ascertained from the Government Tables (see Table 1, 16 & 17 Vict. cap. 51). The duty should be adjudicated. Possibly a 10s. deed stamp would be sufficient, as the transaction is scarcely a sale. JOHN BOYD.

STAMP ON APPOINTMENT.—With reference to the article which appeared on p. 4 of vol. 162 of the LAW TIMES, July 3, relating to the stamp on appointment of new trustees, we desire to say that after reading this article we tendered for adjudication an appointment of statutory trustees in the place of the Public Trustee which did not contain a vesting declaration. This appointment had been stamped with 10s. in May, and we specifically pointed out to the Adjudication Department the point at issue. We have just received the document back adjudicated as correctly stamped with 10s. It seems, therefore, that the stamp authorities do not agree with the writer of the article referred to that the document requires stamping with £1 when there is no express vesting declaration. H. S. OBITUARY

Mr. ALBERT HENRY BULLOCK, solicitor, of Whitchurch, Glamorgan, died at Cardiff on the 14th inst. at the age of fifty-nine years. Mr. Bullock was admitted in 1899 and practised in Cardiff and Whitchurch, being one of the best-known practitioners in the county. He was much interested in local affairs. Mr. Bullock was a member of the Law Society.

Mr. ALEXANDER JOHNSTON CARRUTHERS, solicitor, of 31, Great James-street, W.C., died at his residence, 4, Elmfield-avenue, Teddington, Middlesex, on Sunday, the 18th inst., after a short illness of pneumonia. Mr. Carruthers was admitted in 1901.
