in the county of Middlesex aforesaid, or ellewhere, for any term or number of years as he shall think proper; AND ALSO for me, and in my name, and for my use, to ask, demand, and receive of, and from, all and every, or any person or persons whomsoever, who now is, or are, or at any time, or times hereafter, shall or may be tenant or tenants to me ; ALL fuch rent and rents, or arrears rent, as now is, or are, or at any time or times hereafter, fhall or may become due and payable unto me, from any such person or persons as aforesaid ; AND on receipt thereof, or any part thereof, for me and in my name, or in his own name, acquittances, or other sufficient discharges, for the same, to give, make, seal, and execute; and in default of payment thereof, or any part into and upon all or any of my faid meffuages, or tenements, and premises, with the appurtenances, or any part thereof, to enter, seise, and distrain, all or any goods or chattels that fhall or may from time to rime be found, in or upon the faid premises, or any part thereof, and to make such distress of the premises as the law permits ; AND the direress os distresses so made, to detain until payment of such rent or rents shall be made, or the fame shall be delivered by due course of law; and for non-payment to dispose thereof according to law, or to proceed in my name or otherwise by action, suit, bill, or plaint, or to take such other lawful ways or means for the recovery thereof, as he the said T.C. shall think fit; and to do all and every other lawful and warrantable ait and acts, thing and things, whatsoever, for the purposes aforesaid ; AND I do hereby give and grant unto my said attorney, his fubstitutes and aligns, all my power and authority in the premises for the purposes aforesaid, as fully and effectually as I myself might, or could do, being personally present and did the same; AND one or more attorney or attornies, to make, fubftitute and appoint, and a
his pleasure to revoke; Hereby allowing, ratifying, confirming, and declaring, that I will allow, ratify, and confirm, all and whatfoever my said attorney, his substitutes, and assigns, or any of them, ihall lawfully do, or cause to be done, in and about the premises, by virtue of these presents ; AND I do hereby promise and agree, to save harmless, and keep indemnified, the said 1. -, in the county of Southampton, yeoman, sends greeting : WHEREAS 7. C. of
-, in the county of Surry, yeoman, by indenture of lease, bearing date on or about the day of
year of the reign of our Sovereign Lord King George & c. did, amongst other things, demise and to farm let unto F. D. Jate of
aforesaid, yeoman, deceased, father of the above-named F. D. certain lands called containing by estimation
acres, situate in aforesaid, then or late in the possession of the said J. C. for the term
years, from the Feast of St. Michael the Archangel then last part, before the date of the said indenture, under such yearly rent, and under such exceptions, covenants, and agreements as are therein contained ; in which said indenture is contained a provisie or clause of re-entry for the said J. C. his heirs or asigns, in case he the said F. D. deceased, his executors or administrators, should demise, aflign, or otherwise depart with, or from, the faid demised premises, or any part thereof, to any person or persons whatsoever, without the consent in writing of the said J. C. his heirs or assigns, under his or their hands and seals first had and obtained, as by the said recited indenture of lease, relation being thereunto had, may more fully appear: AND WHEREAS the said F. D. of is fince dead, having first made his last will and testament in writing, and thereof appointed the said F. D. party hereunto, sole executor, whereby he the said F. D. party hereunto, is become legally entitled unto the said farm and leare, for the remainder of the said term of years, which is yet to come and nexpired : AND WHEREAS the iaid F. D. the teftator, in his life, was at great charge and expence
in cultivating and improving the said farm, and the said F. D: party hereunto, doth hold by leale a large farin at
aforesaid, by reason whereof, and of the distance thereof from
he the said F. D. party hereunto, cannot himself manage and use the faid farm, without considerable loss and damage ; AND WHEREAS the said F. D. party hereunto, for the reasons aforesaid, hath applied himself unto the said 7.C. for a licence to let the said farm to an under-tenant; AND WHEREAS ALSO the said F. D. party heretc, hath also offered to surrender up unto the said J. C. the said lease or term, on condition that he the said J. C. would make him the said F. D. party hereto, reasonable fatisfaction for such expence and charge in improving the said farm; AND WHEREAS the faid 7. D. notwithstanding such reasonable request and offer of the said F. D. party hereunto, hath refused not only to give the said F. D. party hereto, leave or licence to let or aflign the said farm to an under-tenant, but hath and doth also refuse to accept his surrender of the said Jease or term on the conditions above-mentioned; NOW KNOW YE, that the said F. D. party hereunto, being willing and desirous to enjoy and reap the benefit of the said lease, and term, in order to be reimbursed the expences and costs that hath been laid out and expended in improving the said farm, and reposing a special confidence in 7. B. late of E. in the said county of Surry, husbandman, hath constituted and appointed, and by these presents doth constitute and appoint the said J. B. his bailiff, for the managing and cultivating the said farm and

H. of ---, in the said county of Middlesex, Gent. the levesal goods and chartels herein after particularly mentioned ; that is to say, two large pier looking glasses, with gilt frames, a large Turkey car
pet, a feather bed and bolster, two marble Nabs and brackets, one large mahogany table &c. And upon receipt of the said goods and chattels, or any of them for me, and in my name, to give and execute to the said W. H. proper acquittances or discharges for the same; and in case the said W. H. on demand to be made by my said attorney as aforesaid, shall and do refuse to deliver to my said attorney the raid goods, and chattels, or any part thereof, I do, in such case, hereby authorise and impower my faid attorney, in my name, and for my use, to commence and profecute one or more action, or actions, at law, in trover, and conversion, or otherwise, against the faid IV. NOW ALL MEN by these presents, that Whereas there now
is, and for some time paft hath been, a cause depending in his Majesty's High Court of Chancery at Westminster, between F. 1. Esq; and S. S. widow and relict of S. S. late of
in the county of Southampton, clerk, deceased; AND WHEREAS the said F. T. is now willing and desirous to put an end to the faid cause, and hath agreed to enter into arbitration bonds, to put all matters in dispute between them to be determined by W. G. Esq; and one of the council of the said F. T. and in case they disagree, then to be left to the master of the said court of Chancery, to whom the same stands referred as an umpire. NOW I the said S. S. in pursuance of the said agreement, and for divers good causes and confiderations me hercunto moving, have conftituted, authorised, and appointed, and by these presents do conftitute, authorise, and appoint, my loving fon S. S. my true and lawful attorney, for me, and in my name and stead, io subscribe the name of me the said S. S. to such arbitration bond or bonds as my council shall think fit and convenient, and the same to deliver as my act and deed : AND MOREOVER, to do and execute, or cause to be done and executed, all and. whatsoever the said S.
