G. at or before the enfealing and delivery hereof, the receipt whereof is hereby acknowledged, he the faid A. A. has granted, bargained, fold and demifed, and by these prefents doth grant, bargain, fell and demife unto the faid I. I and K. G. their executors, administrators and affigns, all that brick meffuage or tenement, being a corner meffuage, fituate on the North fide of and the Eaft fide of fome time heretofore erected and built by P. P. or his affigns, and alfo all thofe other brick mesfuages or tenements adjoining to the faid firft mentioned mefluage, and fituate on the Eaft fide of aforefaid. ALL which faid feveral mefluages or tenements, ftables, coach-houses and premifes, are fituate, lying and being on the North fide of faid, the Eaft fide of faid, and the North fide of aforefaid, in the feveral parishes of St Stephen and St. Thomas, or one of them, in the county of and now are, or late or fome time were in the feveral tenures, poffeffions or occupations of them the faid P. P. &c. or fome of them, their or fome of their respective under-tenants or affigns, by virtue of feveral leafes to them thereof respectively made for feveral terms for years yet in being, at and under feveral yearly ground-rents, amounting in the whole to the yearly fum of pounds, or thereabouts, and alfo all thofe meffuages or tenements, with the gardens, yards, backfides, alleys, courts, ways, paffages and appurtenances thereunto belonging, or therewith ufed, occupied, poffeffed or enjoyed, fituate, lying and being within the faid feveral parithes of St. Stephen or St. Thomas, or either of them, in the faid county of, with their appurtenances, and the reverfion and reverfions, remainder and remainders, rents, iflues and profits of the faid feveral mefluages or tenements, hereditaments and other the premifes, and of every of them, and of every part and parcel thereof; To have and to bold the faid feveral meffuages or tenements, ground, hereditaments, and all and fingular other the premises, with their appurtenances, unto the faid I. I. and K. G. their executors, adminiftrators and affigns, from the day next before the day of the date hereof, for and during the full time and term, and unto the full end and term of years, from thence next enfuing and fully to be compleat and ended, without impeachment of wafte, upon the truft, and under and fubject to the provifo and agreements herein after mentioned, expreffed and declared, of and concerning the fame. And whereas, NOW this indenture farther witneffeth, that for the confideration aforefaid, and in confideration of the farther fum of fhillings of like money to him the faid A. A. in hand paid by the faid I. I. and K. G. at or before the enfealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the faid A. A. has granted, bar

G. their executors, adminiftrators and affigns, all and every the faid feveral pieces or parcels of ground, meffuages or tenements, hereditaments and other the premises, in and by the faid three several recited indentures of leafe, or any of them, demifed and leafed, or mentioned or intended to be thereby demifed and leafed, with their and every of their appurtenances, and the reverfion and reverfions, remainder and remainders, rents, iffues and profits thereof, and of every part and parcel thereof, and all the eftate, right, title, intereft, term and terms of years yet to come and unexpired, truft, property, claim and demand whatsoever, both in law and equity, of him the faid A. A. of, in, to or out of the faid feveral pieces or parcels of ground, meffuages or tenements, hereditaments and other the premises laft mentioned, or any of them, or any part or parcel thereof, by force or virtue of the faid three feveral recited indentures of leafe, or the mefne affignments thereof, or any of them, or otherwife howfoever; To have and to hold the faid feveral laft mentioned pieces or parcels of ground, meffuages or tenements, hereditaments, and all and fingular other the premises hereby, or mentioned or intended to be hereby affigned, with their and every of their appurtenances, unto the faid I. I. and K. G. their executors, administrators and affigns, from henceforth, for and during all the reft and refidue yet to come and unexpired of the said three several terms of years, years and years therein refpectively; upon the trufts nevertheless, and under and fubject to the provifo and agreements herein after mentioned, expreffed and declared, of and concerningthe fame. AND It is hereby declared and agreed, by and between all the faid parties to thefe prefents, and it is the true intent and meaning of them, and of thefe prefents, that the aforefaid demife and affignment hereby made or mentioned to be made of the faid feveral pieces or parcels of ground, meffuages or tenements, hereditaments and other the premises, unto the faid I. I. and K. G. their executors, adminiftrators and affigns refpectively as aforefaid, are and were fo made, Upon this special truft and confidence, and to the intent and purpose, that in cafe the faid annuity, yearly rent or fum of -pounds, or any part thereof, fhail happen to be behind or unpaid to her the faid D. D. D. or her affigns, by the fpace of days next over or after any of the faid feafts or days of payment, wherein the fame is herein before appointed to be paid as aforefaid, then and fo often as they the faid I. I. and K. G. their executors, adminiftrators and affigns, thall and may, by and out of the yearly rents, iffues and profits of the faid meffuages or tenements, ground, hereditaments and premifes, fo to them demifed and aßigned refpectively as aforefaid, by fale or mortgage of the faid terms hereby demifed or affigned, of and in the aforefaid premises, or of and in any or a competent part thereof, or by fuch other ways or means as they the faid truftees or the furvivor of them, or the

executors or adminiftrators of fuch furvivor shall think fit, raise and levy such sum and fums of money, as fhall be fufficient from time to time, to pay and fatisfy unto her the faid D. D. D. and her affigns, during her natural life, the faid annuity, or yearly rent or fum of pounds, or fo much thereof as fhall from time to time so happen to be in arrear and unpaid; together alfo with all fuch cofts, charges, damages and expences, as the the faid D. D. D. or the faid I. I. and K. G. her trustees, their executors and adminiftrators, or any of them, fhall fuftain, expend or be put unto, for or by reason of the non-payment thereof at the days and times, and in manner first herein before in that behalf mentioned, and fhall and do pay, apply and difpofe of the fame accordingly. Provided always nevertheless, that it is hereby declared and agreed, by and between all the faid parties to thefe prefents, that from and after the decease of her the said D. D. D. and payment of all arrears which fhall be then due of the faid annuity, yearly rent or fum of pounds, (if any fuch fhall then happen to be) together with all cofts, charges, damages and expences attending the execution of the aforefaid truft, then and at all times from thenceforth the aforefaid demife and affignment hereby made or intended to be made of the faid meffuages or tenements, grounds, hereditaments, and other the premises refpectively as aforefaid (faving only as to fuch part or parts of the premifes as fhall or may be fo mortgaged or fold as aforefaid, for the railing of any arrears of the faid annuity, if any fuch mortgage or fale then fhall be) fhall ceafe, determine and be utterly void, to all intents and purposes; any thing herein contained to the contrary notwithstanding. And the faid A. A. doth for himfelf, his heirs, executors and adminiAtrators, further covenant, promife, grant and agree, to and with the faid D. D. D. her executors, adminiftrators and affigns, in manner following; that is to fay, that he the faid A. A. has at the time of the enfealing and delivery of these presents, in himself good right, full power, and lawful and abfolute authority to grant, bargain, fell and confirm unto her the faid D. D. D. for her natural life, the faid annuity, yearly rent or fum of pounds in manner aforefaid; meffuages or tenements,

and alfo to demife and affign the faid ground, hereditaments, and other the premises herein before mentioned, or intended to be hereby demifed and affigned respectively as aforefaid, with their appurtenances, unto the faid I. I. and K. G. their executors, adminiftrators and affigns, upon the truft, and fubject to the provifo and agreements aforefaid (except as is herein after excepted.) And further, that the faid meffuages or tenements, pieces or parcels of ground, hereditaments, and other the premifes herein before by thefe prefents demifed and affigned refpectively as aforefaid, or mentioned or intended fo to be, fhall and may from time to time remain, continue and be unto them the faid I. I. and K. G. their executors, adminiftrators and affigns, for all the refidue of the faid several and refpective terms of. years,

years, and years therein refpectively, upon the trufl, and for the intent and purpofe, and under and fubject to the provifo and agreements aforefaid; and fhall and may be accordingly peaceably and quietly had, held and enjoyed, without the lawful let, fuit, trouble, denial, eviction or interruption, of or by the faid A. A. his heirs, executors, adminiftrators or affigns, or any of them, or of or by any other perfon or perfons whomfoever, (except as is herein after excepted) and that free and clear, and freely and clearly acquitted, exonerated and discharged, or otherwife, by him the faid A. A. his heirs, executors or adminiftrators, well and fufficiently faved, defended, kept harmless and indemnified, of, from and against all former and other gifts, grants, bargains, fales, leafes, mortgages, jointures, dowers, ufes, trufts, wills, entails, ftatutes, recognizances, judgments, extents, executions, rents, arrears of rent, and of, from and against all and fingular other the eftates, titles, troubles, charges and incumbrances whatfoever, had, made, done, committed or fuffered, or to be had, made, done, committed or fuffered by the faid A. A. his heirs, executors, administrators or affigns, or by any other perfon or perfons whomsoever, (except the faid eftate for the life of the faid D. D. D. of and in the faid meffuages or tenements, ground, hereditaments and premises herein before mentioned to have been given and devised to her for her life, by the faid Sir A. A. in and by his faid lat will and teftament as aforefaid, and alfo except the feveral leafes of the premises whereupon the feveral ground-rents aforementioned are refpectively referved.) AND moreover, that he the faid A. 4. his heirs, executors and administrators, and all and every other person and perfons having or lawfully claiming, or which shall or may have or lawfully claim any estate, right, title, trust or intereft, of, into or out of the premises mentioned, or intended to be hereby demifed and affigned refpectively as aforefaid, or any of them, or any part thereof, (except the faid D. D. D. for and in refpect only of her faid excepted eftate and intereft for life, of and in fuch part of the premises as were devised to her by the faid Sir A. A. as aforefaid, and also except the tenants or leffees of the premises, their executors, adminiftrators and affigns, for and in refpect only of their faid accepted leafes, whereon the aforesaid ground-rents are referved) fhall and will from time to time, and at all times during the life of her the faid D. D. D. and at her reasonable requeft, make, do and execute, or caufe to be made, done and executed, any further or other lawful and reasonable acts, deeds and things, devifes, conveyances and affurances in the law whatsoever, for the better and more abfolute granting and affuring of the faid annuity, yearly rent or fum of pounds, unto her the faid D. D. D. for her natural life in manner aforesaid, and alfo for the further, better, more perfect and abfolute granting, conveying and affuring of the faid mefluages or tenements, ground, hereditaments and other the premises hereby, or mentioned or intended to be hereby demised and affigned respectively as afore

D. or her counfel learned in the law fhall be reafonably advifed, or devifed and required. And it is hereby declared and agreed, by and between all the faid parties to thefe prefents, that in the mean time, and until default fhall happen to be made of or in payment of the faid annuity, yearly rent or fum of - pounds, or any part thereof, by the space of days next over or after any of the faid feafts or days of payment, whereon the fame ought to be paid as aforefaid, it fhall and may be lawful to and for the faid A. A. his heirs, executors and adminiftrators, peaceably and quietly to have, hold and enjoy, all and every the aforefaid premises, and to receive and take the rents and profits thereof, to and for his and their own ufe and benefit, without the lawful let, fuit, trouble, denial or interruption, of or by the faid D. D. D. I. I. and K. G. or any of them, their or any of their executors, administrators or affigns refpectively. AND whereas it has been agreed between the faid parties to these prefents, that the counterparts of the feveral leafes of the aforefaid premises whereupon the ground-rents aforementioned are refpectively referved, fhould remain and continue in the hands of the faid A. A. his heirs, executors and adminiftrators, for the mutual benefit of the partics to thefe prefents, in confideration whereof the faid A. A. doth hereby for himself, his heirs, executors and adminiftrators, covenant, promise and agree, to and with the faid D. D. D. her executors, adminiftrators and affigns, that he the faid A. A his heirs, executors or administrators, fhall and will at any time or times hereafter, at the request of the faid D. D. D. her executors, adminiftrators or affigns, produce and fhew forth, or caufe to be produced and fhewn forth, unto the said D. D. D. and her trustees, or any of them, in any court of law or equity, or otherwife as occafion fhall be and require, all and every or any the counterparts of the aforefaid leafes of the premifes, or any part thereof, for the better enabling her and them, or any of them, (in cafe default shall happen to be made, of or in payment of the faid annuity, yearly rent or fum of pounds,

or any part thereof, at the days and times, and in manner aforefaid) to demand, fue for, recover and receive, all and every or any the rents referved upon the faid refpective leafes, or any of them, and to take all proper remedies for the fame by way of diftrefs, entry or otherwife, as occafion fhall require, according to the true intent and meaning of thefe prefents.
