out of, or for the rectory and church of B. in the county of C. h eretofore granted, amongst other things, unto D. D. and E. E. and their heirs for ever, by letters patent of the late King James the first, under the great seal of England, bearing date the

day of in the year of his reign, Sc. under the yearly rent of

pounds, payable at the feasts of the annunci ation of the blessed Virgin Mary and St. Michael the archangel, by equal portions; and the reversion and reverfions, remainder and remainders, and yearly profits and produce of the said rents, hereditaments and premises herein before granted, bargained and fold, or mentioned so to be, and of every of them, and of every part and parcel thereof; and also all the estate, right, title, intereft, equity of redemption, trust, property, claim and demand whatsoever, both at law and equity, of him the said A. A. of, into or out of the same rents, hereditaments and premises, or any of them, or any past or parcel thereof; AND also all powers and remedies whatroever for recovery of the same rents, every or any of them; and also all deeds, evidences and writings, touching or in any wise concerning the same premises or any part thereof, which he the faid A. A. now has in his custody, or can come by without suit in law, together with true copies of all such other deeds, evidences and writings, as concern the same premises or any part thereof, jointly with any other rents, lands or hereditaments; the same copies to be written and taken out at the costs and charges of the said Duchess of M. her heirs or afligns ; To have and to hold the said rents and hereditaments, and all and fingular the premises hereby granted, bargained and cold, or mentioned so to be, with their appurtenances, unto the said I. Earl K. Sir N. N. and R. R. their heirs and afligns, to and for the use and behoof of them the said I. Earl K. Sir N. N. and R. R. their heirs and affigns for ever, upon such trufts nevertheless, and to and for such intents and purposes, as are herein after mentioned, expresied and declared of and concerning the same; (that is to say) Upon trust, that they the said l. Earl K. Sir N. N. and R. R. their heirs and assigns, fhall and do, during the natural life of the said L. Duchess of M. pay, apply and dispose of the aforesaid rents, and the clear yearly produce thereof, as the same shall from time to time arise and be received, unto. such person or persons, and for such ufes and purposes, and in such parts and proportions, manner and form, as the said L. Duchess of M. notwithstanding her coverture, thall by any note or wiiting under her hand direct or appoint; and in default of, and until such direction and appointment, unto the proper hands of her the said Duchess of M. or otherwise, shall and do permit and suffer her to receive and take the same, to and for her fole and separate use and benefit, and her receipt, or the receipts of the person or persons to whom the shall appoint the fame to be paid, under her or their respective hand or bands, Iball from time to time, notwithstanding her coverture, be good and sufficient discharges for

Earl K. or any after taken husband of her the said L. Duchess of M. but only at her own fole and feparate disposal. AND upon this further trust, that they the said 1. Earl K. Sir N. N. and R. R. their heirs and affigns, shall and do convey and dispose of the said rents, hereditaments and premises herein before granted, bargained and fold, or mentioned so to be, and every part thereof, with their appurtenances, unto such person or persons, and for such estate and estates, uses, intents and purposes, and in such parts and proportions, manner and form, with or without power of révocation, as the the said L. Duchess of M. from time to time, notwithstanding her coverture, and whether the shall be sole or married, by any deed or deeds, writing or writings, under her hand and seal attested by three or more credible witnesses, or by her last will and teftament in writing, or any writing purporting her last will and testament, to be by her signed, sealed and published, in the presence of the like number of witnesses, fhall direct, limit, give or appoint the same; and in default of such direction, limitation, gift and appointment, or in case any such shall be, when and fo soon as the eftates and interests thereby limited fhall respectively end and determine; and as to such part or parts of the premises, whereof no such direction, limitation, gift or appointment thall be made, to and to the use of the Right Honourable the Lady F. K. youngest daughter of the faid L. Duchess of M. by the faid I. Earl K. and the heirs and adigns of the said Lady F. for ever. AND the said A. A. doch hereby for himself, bis heirs, executors and administrators, covenant, promise, grant and agree, to and with the said I. Earl K. Sir. N.N. and R. R. their heirs and assigns, in manner and form following ; (that is to say) That for and notwithstanding any act, matter or thing whatsoever, by the said A. A. E. A. bis late brother, E. A. their late father, F. A. G. G. and H. G. or any of them, or by any other of the ancestors of the faid A. A. done, committed, or wittingly or willingly suffered to the contrary, he the faid A. A. now is, and standeth lawfully, rightfully and absolutely feized in bis demeine as of fee, of and in the said rents, hereditaments and premises herein before granted, bargained and sold, or mentioned fo to be, with their appurtenances, of a good, fure, lawful, absolute and indescafible estate of inheritance, in tee-simple, to him and his heirs, without any reversion, remainder, trust, limitation, power or revocation, use or uses, or other matter, restraint or thing whatsoever, to alter, change, charge, revoke, make void, lessen, incumber or determine the lame, (except as is herein excepted ;) and also that he the faid A. A. (for and notwithstanding any such act, matter or thing as aforesaid) now has in himself good right, full power, and lawful and absolute authoQq2

rity to grant, bargain and sell the same rents, hereditaments and premises, with their appurtenances, unto the said I. Earl K. Sir N. N. and R. R. their heirs and assigns, in manner aforesaid, according to the purport, true intent and meaning of these presents; (except as herein after is excepted.) AND further, that it shall and may be lawful to and for the said I. Earl K, Sir N, N. and R. R. their heirs and afligns, from time to time, and at all tim:s, from and after Ladyday now last past, peaceably and quietly to have, hold and enjoy the same rents, hereditaments and premises, with their appurtenances, and to receive and take the same, and the profits and produce thereof, and of every part thereof, upon the trusts aforesaid, without the lawful let, fuit, trouble, denial or interruption of or by the said A. A. his heirs or aligns, or of or by any other person or persons lawfully claiming or to claim any estate, right, title, trust or interest, at law or in equity, of, in, to or out of the same rents, hereditaments and premises, or any part thereof, from, by or under, or in truft for him or them, or from, by or under the said E. A. the said late brother of the faid A. A. the said E. A. their faid late father, F. A, G. G. and H. G. or any of them, their or any of their heirs or affigns, or any other of the ancestors of the faid A. A. (except as is herein after exçepted,) and that free and clear, and freely and clearly acquitted, exonerated and discharged, or otherwise, by the said A. A. bis heirs, executors or administrators, well and sufficiently saved, defended, kept hartless and indemnified, of, from and against all and all manner of former and other gifts, grants, bargains, sales, mortgages, jointures, dowers, uses, trufts, wills, intains, statutes, recognizances, judgments, extents, executions, and of, from and against all and fingular other ettates, titles, troubles, charges and incumbrances whatsoever, had, made, done, committed, occasioned or suffered, or to be had, made, done, committed, occafioned or suffered by the fàid 1. 4. E. d. his late brother, E. A. their late father, F. A. G. G. and H. G. or any of them, their or any of their heirs or affigns, or by any other of the ancestors of the faid A. A. or by any other person or persons law. fully claiming or to claim, from, by or under, or in trust for them, or any of them, or their or any of their acts, means, affent, consent or procurement, (other than and except the said recited mortgage and security, unto the said Z. Z. for the said principal sum of — pounds, and interest ;) which said - pounds, together with all interest which from and and after Lady-day now last part is already grown due, or shall grow due for the same, is to be paid off and discharged by the said L. Duchess of M. her heirs or aßigns, by and cut of her own separate estate as aforesaid. And the said 1. Earl K. doch hereby for himself, his heirs, executors and administrators, covenant, promile and agree, to and with the said A. 1. his heirs, exeeutors and administrators, that the the faid L. Duchess of M. her þeirs, executors, administrators or affigns, shall and will pay off and

discharge the same principal monies and interest accordingly ; and of and from the same, and every part, shall and will save, defend, keep harmless and indemnified the said A. 1. his heirs, executors and administrators, and every of them, and his and their, and every of their lands and tenements, goods and chatcels. And moreover, the said A. A. doth hereby for himfelf, his heirs, executors and administrators, further covenant, promise, grant and agree, to and with the said I. Earl K. Sir N. N. and R. R. their heirs and assigns, that he the faid A. A. and his heirs, and all and every other person and perfons, having or lawfully claiming, or which thall or may have or lawfully claim any estate, right, tiile, trust or interest, at law or in equity, of, in, to or out of the said rents, hereditaments and premises, hereby granted, bargained and sold, or mentioned so to be, or any of them, or any part thereof, from, by or under, or in truft for him or them, or from, by or under the said A. A. his late brother, E. A. their late father, F. A. G. G. and H. G. or any of them, or any other of the ancestors of the faid A. 1. (except the said Z. Z. his his heirs, executors, administrators and afligns, for and in respect only to his faid recited mortgage and security) Thall and will from time to time, and at all times hereafter during the space of years next ensuing the date hereof, upon every reasonable request of the said L. Duchess of M. or her said trustees, or any of them, their or any of their heirs and assigns, but at the costs and charges of her the said Duchess, her heirs and affigns, make, do and execute, or cause or procure to be made, done and executed, all such further and other lawful and reasonable acts, deeds, conveyances and assurances in the law whatsoever, be the same by fine, common recovery, deed inrolled, or otherwise howsoever, for the further, better, more perfect and absolute granting, conveying and assuring of the fame rents, hereditaments and premises, with their appurtenances, unto the use of the said I. Earl K. Sir N. N. and R. R. their heirs and assigns for ever, upon the trufts aforesaid, as by the said L. Duchess of M. or her said trustees, or any of them, her, their or any of their heirs or affigns, or her, their or any of their counsel learned in the law, shall be reasonably advised, or devised and required, so as such further assurances contain in them no furth'r or other warranty or covenant than against the person or persons, his or their heirs, who Thall make or do the sanie, and so as the party or parties who shall be requested to make such further assurances, be not compelled or compellable, for making or doing thereof, to go or to travel above

A Lease for Years, from one to one, of a House and Lands in the

Country, with a great Number of Special Covenants.

HIS Indenture, made the

year of our Lord 174, and in the second year of our Sovereign Lord George, &c. between A. A. citizen and apothecary of London, of the one part, and B. B. of in the county of yeoman, of the other part, witnesseth, That for and in consideration of the rents, covenants and agreements herein after reserved and contained, and which by and on the part and behalf of the said B. B. his excecutors, administrators and assigns, are to be paid, done and performed, he the said A. A. has leared, fet, and to farm let, unto the Said B. B. his executors, administrators and assigns, ALL that mersuage, tenement or farm-house, late in the possesfion of F. F. and G. G. or their alligns, with the appurtenances, all situate, standing and being in the parishes of and or one of them, in the said county of together with all and fingular the yards, gardens, orchards, backsides, barns, stables, outhouses, edifices and buildings thereunto belonging; And also all those several closes, pieces or parcels of arable land, lee, meadow, pafture, wood and wood-ground, containing by estimation acres, be they more or less, lying and being in the several parishes, fields, precincts and territories of

and, in the said county of to the said messuage, tenement or farm-house belonging, and therewith held, occupied and enjoyed as part and parcel thereof, (except and always reserved out of this present leale unto the said A. A. his heirs and assigns, all timber, timber-like trees, spires, and all other trees whatsoever, but the fruit-trees for their fruit only, and the pollard-trees for their lops and tops only, which now are, or at any time or times hereafter shall be standing, growing and being in, upon or about the faid leared premises, or any part thereof, with free liberty of ingress, egress and regress, to and for the said 1. 1. his heirs or asigns, deputies, servants and workmen, from time to time, and at all times during the term hereby leased, the same to fell, ftock up, cut down, hew and carry away in and through the said leased premises, or any part thereof, doing no wilful hurt or damage in the grain or grais of the said B.
