discharge the fame principal monies and intereft accordingly; and of and from the fame, and every part, fhall and will fave, defend, keep harmless and indemnified the faid A. A. his heirs, executors and adminiftrators, and every of them, and his and their, and every of their lands and tenements, goods and chattels. And moreover, the faid A. A. doth hereby for himself, his heirs, executors and adminiftrators, further covenant, promife, grant and agree, to and with the faid I. Earl K. Sir N. N. and R. R. their heirs and affigns, that he the faid A. A. and his heirs, and all and every other perfon and perfons, having or lawfully claiming, or which fhall or may have or lawfully claim any eftate, right, title, truft or intereft, at law or in equity, of, in, to or out of the faid rents, hereditaments and premises, hereby granted, bargained and fold, or mentioned fo to be, or any of them, or any part thereof, from, by or under, or in truft for him or them, or from, by or under the faid A. A. his late brother, E. A. their late father, F. A. G. G. and H. G. or any of them, or any other of the ancestors of the faid A. A. (except the faid Z. Z. his his heirs, executors, adminiftrators and affigns, for and in refpect only to his faid recited mortgage and fecurity) fhall and will from time to time, and at all times hereafter during the space of

years next enfuing the date hereof, upon every reasonable requeft of the faid L. Duchefs of M. or her faid truftees, or any of them, their or any of their heirs and affigns, but at the cofts and charges of her the faid Duchefs, her heirs and affigns, make, do and execute, or caufe or procure to be made, done and executed, all fuch further and other lawful and reasonable acts, deeds, conveyances and affurances in the law whatfoever, be the fame by fine, common recovery, deed inrolled, or otherwife how foever, for the further, better, more perfect and abfolute granting, conveying and affuring of the fame rents, hereditaments and premifes, with their appurtenances, unto the use of the faid I. Earl K. Sir N. N. and R. R. their heirs and affigns for ever, upon the trufts aforefaid, as by the faid L. Duchefs of M. or her faid trustees, or any of them, her, their or any of their heirs or affigns, or her, their or any of their counsel learned in the law, fhall be reafonably advifed, or devifed and required, fo as fuch further affurances contain in them no further or other warranty or covenant than against the perfon or perfons, his or their heirs, who fhall make or do the fame, and fo as the party or parties who fhall be requested to make fuch further affurances, be not compelled or compellable, for making or doing thereof, to go or to travel above miles from his or their then refpective dwellings or places

the year of our Lord 17, and in the second year of our Sovereign Lord George, &c. between A. A. citizen and apothecary of London, of the one part, and B. B. of in the county of yeoman, of the other part, witneffeth, That for and in confideration of the rents, covenants and agreements herein after referved and contained, and which by and on the part and behalf of the faid B. B. his excecutors, administrators and affigns, are to be paid, done and performed, he the faid A. A. has leafed, fet, and to farm let, unto the faid B. B. his executors, adminiftrators and affigns, ALL that meffuage, tenement or farm-house, late in the poffeffion of F. F. and G. G. or their affigns, with the appurtenances, all fituate, ftanding and being in the parishes of — or one of them, in the faid county of together with all and fingular the yards, gardens, orchards, backfides, barns, ftables, outhoufes, edifices and buildings thereunto belonging; And alfo all thofe feveral clofes, pieces or parcels of arable land, lee, meadow, pafture, wood and wood-ground, containing by estimation acres, be they more or lefs, lying and being in the feveral parishes, fields, precincts and territories of and, in the faid county of — to the faid meffuage, tenement or farm-house belonging, and therewith held, occupied and enjoyed as part and parcel thereof, (except and always referved out of this prefent leafe unto the faid A. A. his heirs and affigns, all timber, timber-like trees, fpires, and all other trees whatsoever, but the fruit-trees for their fruit only, and the pollard-trees for their lops and tops only, which now are, or at any time or times hereafter fhall be ftanding, growing and being in, upon or about the faid leafed premises, or any part thereof, with free liberty of ingrefs, egrefs and regrefs, to and for the faid A. A. his heirs or affigns, deputies, fervants and workmen, from time to time, and at all times during the term hereby leafed, the fame to fell, ftock up, cut down, hew and carry away in and through the faid leafed premises, or any part thereof, doing no wilful hurt or damage in the grain or grafs of the faid B. B. his executors, adminiftrators or affigns; and alfo except to the faid A. A. his heirs and affigns, at all times during the term hereby leafed, free liberty to enter upon the premises, and every part thereof, to view the condition

of the repairs thereof;) To have and to hold the faid meffuages, cottages, tenements or farm-houfe, clofes, and pieces and parcels of arable land, ley, meadow, pafture-ground and premifes, with their ap purtenances (except before excepted) unto the faid B. B. his executors, adminiftrators and affigns, from the feast of St. Michael the archan gel next enfuing the date hereof, for and during, and unto the full end and term of years from thence next enfuing, and fully to be compleat and ended; yielding and paying therefore yearly and every year, during the faid term, unto the faid A. A. his heirs or affigns, at or in his now dwelling-houfe, fituate in street, Lon don, the yearly rent or fum of pounds of lawful money of Great Britain, at the two moft ufual feafts or days of payment in the year, that is to fay, the feasts of the annunciation of the bleffed Virgin Mary, and St. Michael the archangel, by even and equal portions; the firft payment thereof to begin and to be made on the feaft day of the annunciation of the bleffed Virgin Mary next enfuing the date hereof; and alfo yielding and paying therefore yearly and every year during the faid term, unto the faid A. A. his heirs and affigns, at the days and places, and in manner aforefaid, (over and above the faid yearly rent of pounds herein before referved) for every acre of meadow, pafture-ground or hedge-greens hereby leafed, that the faid B. B. his executors, adminiftrators or affigns, fhall ear, plough, dig up, or convert into tillage, the fum of pounds of like lawful money, and fo proportionably after that rate for every greater or leffer quantity than an acre; the first payment of the faid

pounds per acre, to be made on the first of the faid feaft-days which fhall next happen after the ploughing or digging up any part of the fame meadow, pafture-ground or hedge-greens. Provided always, and upon condition neverthelefs, that if it fhall happen that the faid yearly rents hereby referved, or either of them, or any part of them, or either of them, or other the occafional payments (if any happen to be) fhall be behind and unpaid by the space of days next over or after either of the faid feafts or days of payment, whereon the fame ought to be paid as aforefaid, (being lawfully demanded at the place of payment aforefaid) or if the faid B. B. his executors, adminiftrators or affigns, or any of them, fhall affign over, or otherwife depart with this indenture, or the premises hereby leafed, or any part therof, to any perfon or perfons whatsoever, (except the two cottages) without the confent of the faid A. A. his heirs and aligns, first had and obtained in writing under his and their hands and feals for that purpose; then and in either of the faid cafes, it shall and may be lawful to and for the said A. A. his heirs or affigns, into the premises hereby leafed, or any part thereof, in the name of the whole wholly to re-enter, and the fame to have again, retain, repoffefs and enjoy, as in his and their firft and former eftate or estates; any thing contained to the contrary thereof in any wife notwithstanding. AND the faid B. B. doth hereby for

himself, his heirs, executors, adminiftrators and affigns, and for every of them, covenant, grant and agree, to and with the faid A. A. his heirs and affigns, in manner following; that is to fay, that he the faid B. B. his heirs, executors, adminiftrators or affigns, fhall and will well and truly pay, or cause to be paid unto the said A. A. his heirs or affigns, the faid yearly rent of pounds, and also the faid rent of pounds per acre per annum, for ploughing up meadows, pasture or hedge-greens as aforefaid, at the days, times and place, and in such manner, as are herein before appointed for payment thereof, according to the respective reservations thereof aforementioned, and the true intent and meaning of thefe prefents. And that he the faid B. B. his executors, adminiftrators and affigns, shall and will, at his and their own proper cofts and charges, well and fufficiently repair, amend, maintain, fcour, cleanfe, preserve and keep in repair the faid meffuages, tenements or farm-house, and all other the houses, outhoufes, edifices, buildings, barns, ftables, dove-houses, gates, pales, rails, ftiles, hedges, ditches and fences belonging to the hereby leafed premises, from time to time during this prefent lease; he the faid A. A. his heirs and affigns, upon reasonable request and timely notice to them made and given in writing, as is herein after mentioned, finding and allowing on the faid premifes, or within

miles distance thereof, all rough timber, brick, lime, tiles, andall other materials whatsoever (except ftraw,) for the doing thereof, to be carried to the hereby leafed premifes, at the charges of the faid B. B. his executors, administrators or affigns, and the fame premifes fo repaired, amended and kept in repair as aforefaid, at the end, expiration, or other fooner determination of this present lease, shall and will leave and yield up into the hands, and quiet poffeffion of the faid A. A. his heirs or affigns. And that he the faid B. B. his executors, adminiftrators or affigus, fhall not nor will, at any time during this prefent lease, crop or fow above two years together, any of the arable lands and clofes hereby leafed, but every third year permit the fame to lie fallow and unfown, according to the cuftom of the country and the feafons thereof; AND that it shall and may be lawful, to and for the faid A. A. his heirs and affigns, with fervants, horfes, ploughs, carts and other neceffaries, at Lady-day next preceding the expiration of this prefent leafe, to enter upon fuch closes and grounds, parcel of the hereby leafed premifes, as then and by the courfe of the feafons ought then to lie fallow and unfown, the fame to plough, fallow and manure, and to have the grafs, herbage, fheep-walks and fheepcommons thereof; and alfo to enter upon the dung that shall be then in the yard or yards, and at the fame time to have the dung in the dove-house, and the hen-dung in the hen-houfe; and alfo to have fome convenient place in the faid dwelling-houfe for his and their fervants to lodge and diet in, and fome convenient place to lay hay and chaff in, and fome convenient ftable-room for his and their horfes to ftand and be in, without extinguishment of any of the yearly

tents herein before referved, and without giving or making any allowance or fatisfaction for the fame. AND further, that he the faid B. B. his executors, adminiftrators and affigns, fhall not, at any time. or times during the laft years of the faid term, fell, give away, or otherwise difpofe of any of the ftraw which fhall be growing and arifing upon the faid leafed premifes, and fhall not burn any of the ftraw, except it be for the neceflary fingeing of his or their hogs, for the use of their own families; and that he the faid B. B. his executors, administrators and affigns, fhall and will lay and inbarn all the crops of corn and grain which shall be growing and arifing upon the faid hereby leafed premifes, in every year of the faid term in the barns and rick-yards belonging to the said premises, and not elsewhere, and the fame there to threfh out, and the straw and ftover that fhall arife therefrom and thereby, turn into the yard or yards, and the fame feed up with his or their cattle, for the better increase and making of dung there, and the dung and foil that fhall arife thereby, lay, fpread and bestow upon the hereby leafed premises in a husband-like manner, and not elsewhere; and fhall and will leave, unto and for the ufe of the faid A. A. his heirs or affigns, all the dung and compoft which fhall be made in the faid yard or backfides belonging to the faid hereby leafed premises, the laft years of

the faid term, which fhall be made of the two last crops of corn and grain, for manuring the premifes, or otherwife to be difpofed of as he the faid A. A. his heirs or affigns, fhall think fit and convenient; and that he the faid B. B. his executors, adminiftrators and affigns, shall fow, the laft years of this prefent leafe, one third part of the edgecrop with peafe or vetches; and that he the said B. B. his executors, adminiftrators and affigns, fhall and will, at all times during the term hereby leafed, endeavour to preferve and keep the dove-houfe with a good flight of pigeons, dove-houfe-like, and at the end, expiration, or other fooner determination of the faid term of -years, fhall

and will leave up the fame fo preferved and kept, into the hands of the faid A. A. his heirs and affigns. And that he the faid B. B. his executors, adminiftrators and affigns, fhall and will, at all times during the faid term of years hereby leafed, bear, pay and difcharge all fuch taxes, levies and affeffments whatfoever, which fhall be taxed, rated, levied and affeffed upon the faid hereby leafed premifes, which fhall belong to a tenant to pay. And that he the faid B. B. his executors, adminiftrators and affigns, fhall not nor will, at any time or times during this prefent leafe, cut, plafh, or new-make any of the hedges belonging to the hereby leafed premifes, but fuch as fhall be years growth, and thofe only at feasonable times in the years, and when the clofes and grounds to which fuch hedges belong fhall be fown with wheat, rye or barley, on a Summer's tilth, or be clofes of old pafture, and after the fame fhall be cut, plafhed or newmade as aforefaid, the fame preferve and keep from biting or deftruction, by cattle or otherwife; and fall and will, at fuch cutting Rr and
