S. his heirs or affigns, and the vicar and churchwardens of aforefaid for the time being, were to make choice of four godly and able minifters in their rooms, who fhould preach the faid four fermons yearly, in manner as is therein expreffed; AND WHEREAS all the four minifters therein named are long fince dead, and the faid S. S. is alfo dead, and T. S. is grandfon and heir of the faid S. S. NOW KNOW YE, That the faid T. S. and B. C. now vicar of &c. and S. R. and P. P. churchwardens of the faid parish, do hereby choose, nominate, and appoint, F. F. of &c. to preach a fermon yearly in the parish church of &c. on &c. and J. H. of &c. to preach &c. and R. B. of &c. (as above) and G. M. to preach &c. and that each of them fhall and ought to have and receive 21. 2 s. a piece for fuch his fermon, pursuant to the aforefaid gift or will of the faid R. S. the donor. S. by virtue of a power or powers referved in and by two feveral pair of indentures quadripartite, bearing day of -, 1770, and by virtue of all and every other power and powers, DO hereby make and ordain my last will and teftament, and this writing purporting my laft will and teftament; and do hereby, pursuant to the faid power and powers, and to all and every other power and powers whatsoever, order, direct, give, limit, and appoint in manner following; that is to fay, firft, I give and appoint unto A. S. ALSO I further give and appoint to fuch poor of the faid parish of S. as my faid husband IV. S. and the churchwardens of the fame parifh fhall approve of and think fit, the fum of, to be difpofed and diftributed in fuch proportions as my faid husband and the faid churchwardens fhall think fit. ALSI give and appoint &c. Several other fums of money to feveral perfons and their children.) ALSO I do hereby appoint and direct, That none of the faid legacies or fums of money hereby given or appointed to any perfon or perfons who shall be under age at the time of my deceafe, fhall become

due or payable to any fuch perfon or persons, if males, until they fhall respectively attain the age of years, and, if females, until their respective marriages, or age of years; and that if fuch perfon or perfons fhall die before fuch legacy or fums of money fhall, by virtue hereof, become payable to them refpectively, every fuch legacy, or fum of money hereby given to fuch perfon fo dying, fhall ceafe and be void. AND LASTLY, I do hereby give and appoint all the rest of my real and perfonal eftate, whatsoever and wherefoever, unto my faid dear husband. S. his heirs, executors, adminifrators, and affigns; and I do hereby revoke, and make void all former wills and appointments by me made; and do hereby constitute and appoint the faid W. HIS INDENTURE &. BETWEEN the right honourable P. Earl of C. of the one part, and C. S. of &c. Efq; and T. B. of &c. Gent. of the other part, WHEREAS by an indenture, bear, ing date &c. and made &c. between the faid P. Earl of C. and the right honourable P. Lord S. (eldeft fon and heir apparent of the faid Earl) of the one part; and the right honourable G. Lord Marquis of H. of the other part (reciting as therein is recited) the faid P. Earl of C. and P. Lord S. (for the confiderations therein mentioned) did grant, remife, release, and confirm, unto the faid Lord M. of If, and his heirs, all that &c. to the ufe of the faid P. Earl of C. for his life, fans wafte, remainder to the ufe of the faid P. Lord S. his heirs and affigns for ever; in which indenture (amongst other things) are contained the powers or provifos in the words, or to the effect following, that is ta Tay, provided always, and the true intent and meaning of thefe prefents, and the parties to the fame was, that the faid P. earl of C. fhould have full power and authority, and that it should and might be lawful for him, from time to time, and at any time then after during his natural life, by any deed or deeds in writing, to be by him fealed and delivered in the prefence of two credible witneffes at the least, or by his laft will and teftament in writing by him fubscribed, fealed, and publifhed, in the prefence of two credible witneffes at the leaft, to charge all or any part of the faid manors, lordships, meffuages, lands, tenements, hereditaments, and premifes, therein before granted and released, or mentioned, or intended to be granted or releafed, in fuch manner as he should think fit, with the payment of any fum or fums of money not exceeding in the whole, for the portion and portions of the daughters and younger fon of him the faid P. Earl of C. by the right honourable the Lady E. D. deceafed, (eldest daughter of the right honourable C. Earl of C.) his late wife, to be paid in fuch proportions, and at fuch times, and in fuch manner, and with fuch powers, ways and means, by mortgage, fale, or otherwife, for

Earl of C. fhall think fit and appoint, any thing therein &e notwithstanding; provided always, and the true intent and meaning of these presents, and the parties to the fame was, that if the said P. Earl of C. fhould pay, or cause to be paid, any fum or fums of money for the portions of the faid daughters and younger fon, according to the purport of the above faid firft provifo, any other way or ways than by raising the fame by the faid provifo, or fuch ways or means as are therein mentioned, fhould be empowered to raise out of, or by means of the faid premifes, to his own use, so much money, not exceeding in the whole for or towards the payment and fatisfaction of such money as he should fo pay, or cause to be paid as aforefaid, any thing &c. notwithstanding, as by the faid recited indenture (relation &c.) more at large may appear. AND WHEREAS the honourable Lady M. S. and Lady K. S. were the daughters, and the honourable C. S. was the younger fon of the faid Earl of C. by the faid Lady E. D. and upon the marriage of the faid Lady M. with T. C. Efq; the faid Earl of C. paid as and for her portion; and upon the marriage of the faid Lady K. with G. L. Efq; the faid Earl of C. paid the fum of as for her portion; and the faid Earl paid to the faid C. S. the fum of for his part and portion of the afore mentioned sum of —; and the faid Earl of C. intends the fum of shall be raised out of or by the premises to his own use, towards the payment and fatisfaction of the faid two feveral fums of , paid by him for portions as aforesaid, he having appointed, and by thefe prefents appointing the faid fum of to have and be the portions of his faid daughters and younger fon. NOW THIS INDENTURE WITNESSETH, That the faid P. Earl of C. by this his deed in writing, fealed and delivercd in the prefence of credible witneffes, whofe names are hereon indorfed, by virtue and in pursuance of the faid powers and authosities given and referved to him by the faid recited indenture, and of all other powers and authorities at any time to him given, or referved, or now vefted in him, touching the charging the faid manors, lordships, meffuages, rectory, advowfons, tenements, and hereditaments, with the payment of any fum or fums of money, not exceeding &c. DOTH charge and make chargeable the faid manors &c. with the payment of the faid fum of -- to him the faid P. Earl of C. his executors, adminiftrators, or affigns; AND for and in confideration of the fum of — of &c. to him the faid Earl in hand paid by the faid C. S. and T. B. their executors and adminiftrators, he the faid P. Earl of C. in pursuance of the aforefaid power and powers, authority and authorities, hath leafed, bargained, fold, limited, and appointed, and by these prefents DOTH leafe, bargain, fell, limit, and appoint, unto the faid C. S. and T. B. their executors, adminiftrators, and affigns, ALL those the said manors &c. which in and by the said recited indenture were or are mentioned to be granted, remifed, releafed, and confirmed, with their and every of their rights, members, and appurtenances, TO HAVE AND TO HOLD the fame manors &c. unto the faid C. S. and T. B. their executors &c. from the

day next before the day of the date of thefe prefents, for and during, and unto the full end and term of -years, from thence next enfuing, and fully to be complete and ended, without impeachment of wafte; YIELDING AND PAYING therefore the rent of one pepper corn only, on the feaft day of St. Michael the Archangel, if the fame fhall be lawfully demanded; PROVIDED ALWAYS, and it is hereby declared and agreed, by and between the faid parties to thefe prefents, that if the faid P. Lord S. his heirs, executors, or adminiftrators, or fuch perfon or perfons, to whom the next and immediate reverfion or remainder of the faid premises, expectant upon the determination of the faid term of years, fhall, for the time being, belong, DO and fhall well and truly pay, or caufe to be paid, unto the faid C. S. and T. B. their executors, adminiftrators, or affigns, at or in &c. the full fum of — of &c. upon the day

next enfuing the date of these prefents, with intereft for the fame, after the rate of per cent. per. annum, by half-yearly payments, without making any deductions or abatements out of the fame fum, for or in refpect of any taxes, charges, duties, or affeffments, charged or impofed, or to be charged or impofed on the faid premises, or any part thereof, or for, or in respect of any other reprifal, matter, or thing whatfoever, then the demife hereby made, and every thing herein contained, fhall ceafe, determine, and be utterly void; PROVIDED ALSO, and it is hereby further declared and agreed, by and between the faid parties to thefe prefents, that until default fhall be made of or in payment of the faid fum of, or of fome part thereof, contrary to the tenor and true meaning of the provifoes herein before mentioned for payment thereof, the faid manors and premises fhall and may be held and enjoyed, and the rents, iffues, and profits thereof, be received and taken, according to the ufes and eftates therein limited, in and by the faid recited indenture, without the let, fuit, or interruption of the faid C. S. and T. B. or either of them, their or either of their executors, administrators, or affigns. In witness &c. Sealed &c.

B. by the name of her grand-daughter E. B. for her fole ufe and benefit, so as no husband whom the fhould thereafter marry hould have any thing to do therewith, and directed that her receipt alone, though married, fhould be a good difcharge to her executors for the fame, and appointed that her faid grand-daughter, after receipt of the faid fhould put the fame out at intereft in fome friend's name, IN TRUST, for her feparate ufe, and receive the intereft of it; and that if fhe died and left any child or children, then
