to a plan thereof hereunto annexed, and of the dimensions following, viz. (bere insert the dimensions of the building, and scantlings of the timber intended to be used in building thereof.) And the faid R. K. for the confiderations aforesaid, doch agree with the said F. G. well and truly to pay, or cause to be paid, unto the said F. G. the full sum of pounds, of lawful money of Great Britain, in manner following, inat is to say, pounds part thereof, as soon as the foundation of the said house is laid, - pounds other part thereof, when the brick-work of the said house fhall be carried up and tiled in, and the remaining pounds, being in full for building the said house, when the same shall be completely finifhed, inside and out, fit for occupation, subject to the approbation of A. B. surveyor to the said R. K. And, lastly, the said R, K. and F. G. do further agree by these presents to execute to each other, with all convenient fpeed, an article of agreement, in the penalty of

For building a koule. ARTICLES OF AGREEMENT, indented, had, made, concluded, and agreed upon, this of

K. his executors, administrators, and assigns, that he the said F.G. or his assigns, his or their servants or workinen, shall, and will, within the space os time of calendar months, next following the day of the date of these presents, find and provide all brick, stone, iron, timber, scaffolding, and all other materials and things, fit and necessary to erect, build, and finish, or cause, and procure to be erected, built, and finished, in a good, sound, substantial, and workman-like manner, ONE brick house or building, on a piece or parcel of wafle ground, fituate, &c. (place where building to be made) according to a plan or section thereof, hereunto annexed, or hereunder written, and of the dimensions and scantlings following (here insert dimensions and scantlings of timber, and cther materials to be used in the laid building). AND the aid R. K. for the confiderations aforesaid, doth for himself, his exccutors, adminiftrators and asngns, covenant, promise, and agree, to and with the said F. HE said y. L. in consideration of the rent, covenants, and contained on the tenant's part to be paid and performed, doth hereby for himself, his executors, adminiftrators, and assigns, covenant, promise, and agree to and with the said S. P. his executors, adminiftra. tors, and asigns, in manner following that is to say), that he the said 7. L. his executors, administrators, or affigns, Ihall, and will, on or before Midsummer-day next ensuing, by a good and sufficient indenture of lease, grant, demise, and let, unto the said S. P. his executors, administrators, and assigns, ALL that messuage, or tenement, and yard behind the same, and other the appurtenances thereunto belonging, fituate, lying, and being in in the parish of now or late in the poffesfion of the said J. L. TO HOLD the same from Midfummer-day aforesaid, for the term of or years, from thence next ensuing, at the option of the said parties, on his or their giving to, or leaving for each other at least - months notice before the end of the faid years, AT and under the yearly rent or sum of pounds, payable quarterly; the first payment whereof is to begin and to be made at or upon Michaelmas-day next ensuing ; AND that the said J. L. his executors, administrators, or asligns, fball, and will, on or before Midsummer-day aforesaid, at his and their own proper costs and charges, repair, or cause the aforesaid premises, with their appurtenances, to be put into good and fufficient tenantable repair and condition.

Item, THE said S. P. in confideration thereof, doth hereby for himfelf, his executor's, administrators, and assigns, covenant, promise, and agree, to and with the said 7. L. his executors, administrators, and alligns, that he the said S, P, his executors, administrators, and

assigns,

assigns, thall, and will, upon the said premises being put into such repair as aforesaid, at or by the time aforesaid, take, and accept of and from the said 7. L. his executors, administrators, or affigns, the aforesaid indenture of lease, grant, and demise of the said premises, for the term, and at the rent payable in manner aforesaid, and also execute a counterpart thereof unto the said y. L. his executors, administrators, or aíñigns.

AND for the true performance of all and every the covenants and agreements aforesaid, each and either of the said parties hereto doth bind and oblige himself, his heirs, executors, and administrators, unto the other of them, his heirs, executors, and administrators, in the penal sum of

pounds, of lawful money of Great Britain. In witness, &c.

HEREAS the above-named G. H. hath agreed to and

with 7. B. for a lease of a messuage of tenement with the appurtenances, situate in

being the first house northward from Court, for the term of years, to commence from the Feast Day of the Annunciation of the Blessed Virgin Mary now next ensuing, at and under the yearly rent of pounds, payable quarterly, free and clear of and from all manner of deductions and abatements for or on account of any taxes whatsoever, parliamentary, parochial, or otherwise howsoever, and to pay to the said 4. B. at the execution of the said lease the sum of - pounds as a fine or good will for the same. NOW THESE PRESENTS WITNESS, that the said 7. B. in consideration of the said sum of - pounds to be to him paid by the said G. H. in manner aforesaid, doth for himself, his executors, and administrators, covenant, promise, and agree, to and with the said G. H. his executors and administrators, that be the said 7. B. bis executors and administrators, thall and will, at the request of the said G. 4. and upon payment of the faid sum of -pounds, make, grant, and execute a good and sufficient lease in the law of the aforesaid premises to the said G. nunciation of the Blefied Virgin Mary now next ensuing, and from thence fully to be complete and ended, AT the yearly rent of pounds, payable quarterly in manner before-mentioned, free and clear of and from all manner of deductions and abatements for taxes whatsoever, or otherwise, at, under, and according to the several covenants he the faid y. B. his executors, administrators, and afigns, are subject to in the lease granted by the city of London, by which he holds the said premises amongst others in the like manner and form as the said 7. B. hath granted leases of the other premises adjoining to the said mesluage or tenement agreed to be demised. AND it is agreed, that he the faid G. H. shall not, nor will remove, take away, or alter the penthouse over the door of the said premises, without the leave of the said J. B. his executors, adminiftrators, or assigns, in writing first had and obtained. AND the said G. H. for himself, his executors and administrators, doth covenant, promise, and agree, to and with the said 7. B. his executors and administrators, that he or they shall and will accept and take such lease of the said premises upon the terms aforesaid, and subject to the said conditions aforesaid, and at the same time execute a counterpart thereof, and at his and their own costs and charges pay for the same. AND the said G. H. doth for himself, his executors and adminiftrators, further covenant, promise, and agree to and with the said J. B. his executors and administrators, that he the said G. H. shall and will, well and truly, pay, or cause to be paid to the said J. B. his executors and administrators, the said sum of pounds at the execution of the said lease above mentioned. AND the said 7. B. for himself, his executors and administrators, doth, in consideration of the premises, covenant, promise, and agree, to and with the said G. H. his executors and administrators, in manner following, that is to say, that he the said 'y. B. fhall and will, on the execution of the said lease, pay, or allow, or cause to be paid or allowed to the said G. H. his executors or administrators, the full sum of

pounds; which said sum of pounds, it is hereby agreed, shall be expended and laid out by the said G. H. his executors, administrators, or assigns, within the space of months now next ensuing, in such alterations, improvements, and other matters and things, in, upon, or about the said premises, as he the said G. H. his executors, administrators, or affigns, fh all think fit and necessary; and which alterations and improvements thall be and remain upon the said premises, and shall not be taken or removed away by him the said G. H. bis executors, administrators, or affigns, after the expiration of the said lease, but shall be and remain a schedule to the same.' AND for the true performance of this agreement, each of the said parties hereto doth hereby bind bimself, his heirs, executors, and administrators, unto the other of them, his heirs, executors, and ad-ministrators, who shall make default in the performance hereof, in the penal sum of pounds, of lawful money of Great Britain, to be recovered against the party, his heirs, executors, or admininistrators, making, such default in the full performance of this agree
