ment thereof; NOW THIS INDENTURE WITNESSETH, That the said C. B. for and in confideration of the said fum af of lawful money of Great Britain, to and for the said C. B. paid, laid out, and advanced as aforesaid, by him the said D. 7. at or before the fealing and delivery hereof, the receipt and payment whereof be the said C. B. doth hereby acknowledge, and of and from the fame, and every part and parcel thereof, doth hereby for ever acquit, release, and discharge the said D. 7. his executors, administrators, and af. signs, HE the said C. B: HATH bargained, fold, afligned, transferred, and set over, and by these presents DOTH bargain, sell, allign, transfer, and set over unto the said D. J. his executors, administrators, and asigns, (to and for his and their own proper ufe and behoof for ever) the said in part recited judgment, and the said fum of thereby recovered, and all the benefit and advantage which can or may be had or obtained by reason or means thereof, or of any action, execution, or extent thereupon, to be had, sued out, or taken, and all his the said C. B.'s estate, right, title, and intereft, claim, and demand whatsoever, of, in, and to the faid judgment, or any fun or sums of money, lands, tenements, or other things, which by virtue of any execution, process, or proceeding thereupon, to be made or sued out, shall or may be had, gotten, obtained, or recovered ; AND the said C. B. for the consideration aforesaid, doth hereby make, ordain, authorize, constitute, and appoint, him the said D.J. his executors, administrators, and assigns, his true and lawful attorney and attornies irrevocable for him the faid C. B. and in his name, place, and stead, to sue and prosecute any execution, action, or extent, upon the said judgment, and to acknowledge, make, and give full fatisfaction, release, and discharge for the same. And also to do and perform, all and every other lawful acts and things whatroever, which shall be necessary to be done in and about the premifes, as fully and effe&tually as he the said G. B. may, might, can, or could do, if personally present ; AND doth hereby for himself, his executors, and administrators, ratify, confirm and allow, all legal acts, matters, and things whatsoever, to be done and accomplished by the said D. 7. his executors, administrators, and assigns, in and touching the premises, at his and their proper costs and charges in the law: AND the said C. B. for himself, his executors and adminiftrators, doth hereby covenant, promise, and agree, to and with the faid D. 7. bis executors, administrators, and affigns, that he the said C. B. hath not, at any time heretofore, any ways released, vacated, or discharged the said judgment so recovered as aforesaid, or any part thereof, and that neither he, nor his executors, or administrators, shall or will, at any time or times hereafter, unless at the request in writing, of the said D. J. or in pursuance of some rule or order of some court of law or equity, release, vacate, discharge, or enter satisfaction on the record of the said judgment, nor cause, nor procure the fame to be released, vacated, or discharged, or satisfaction to be en. tered thereon, or revoke, annul, make void, or countermand, any power, authority, ar clause, berein þefore granted or contained ; AND
ALSO, that he the faid C. B. hath in himself good right, full power, and lawful and absolute authority to bargain, sell, and assign, the said judgment unto the said D. y. in manner aforelaid ; AND that the fame now is, and so fhall remain, continue, and be free and clear, and freely and clearly acquitted, exonerated and discharged, of, from, and againit all and all manner of former and other bargains, sales, mortgages, and assignments thereof, and other incumbrances whatroever, SAVE and EXCEPT one indenture of assignment or mortgage thereof, dated on or about the - of - last, made by him the said C. H. having humbly besought his said Majesty, in regard to the disa posing of his faid commission of guidon and major, which mighe meet with difficulties and delays, and could not be accomplished before his said Majesty's departure for ----, that his said Majelty would be graciously pleased to grant his warrant for continuing him on the muster rolls of his faid Majesty's troops, until he could meet with a person to purchase the said post, who was fitly qualified to fucceed him therein ; and in case that he should die before his faid commiflion could be difposed of, that it might be then fold for the fole use and benefit of the faid A. B. (by the name of A. B. Gent.) and bis executors, he the said A. B. having advanced a confiderable sum of money towards the purchase for the said poft ; which request bis Majesty taking into his royal consideration, was graciously pleased to grant, and by his faid warrant further graciously declared his will and pleasure to his said commissary general, and deputy of his said musters, fignified as aforefaid, that they should pass and allow the said 7.
