Excerpt: ...different periods and under different circumstances; they will of course bespeak the wishes and claims of the people at the time, as well as the agnition and compact on behalf of the sovereign to satisfy and admit them. To comment upon these different forms of oaths, would exceed the intended limits of this publication; I shall only therefore consider with judge Blakiston the effect of the present coronation oath, which is required to be taken by the acts of settlement and union. " However, in what form soever The effect of.., . the present co it be conceived, this is most indisputably a ronation oatb. fundamental and original express contract 5 though doubtless the duty of protection is' impliedly as much incumbent on the sove-reign before coronation as after, in the fame manner as allegiance to the king becomes the duty of the subject immediately on the de-scent of the crown, before he has taken the oath of allegiance, or whether he ever takes it at all. This reciprocal duty of the subject will be considered in its proper place; at pre-sent we are only to observe, that in the king's part of this oiiginal contract are expressed all the duties, that a monarch can owe to his peo-ple, viz. to govern according to law; to exe-cute judgment in mercy; and to maintain the established religion; and, with respect to the latter of these three branches, we may farther remark, that by the act of union, 5 Ann, c. 3. two preceding statutes are recited and cop-firmed; the one of the parliament of Scot-land, the other of the parliament of England; which enact, the former, that every king t his accession shall take and subscribe an oath to preserve the protestant religion, and presby-terian church government in Scotland; the, Blak. b. i. c. 6....
