CASE.

HE Dean and Chapter of Westminster, by two feveral leafes demifed feveral meffuages in Newgatefireet, to S. G. widow, for the term of forty years, in truft for J. D. and Elizabeth his wife.

15th April, 1720.-By indenture tripartite between the faid f. D. and Elizabeth his wife of the firft part, the faid S. G. of the fecond part, and S. S. of the third part; the faid . D. and Elizabeth his wife, and the faid S. G. in confideration of 1000l. paid by S. S. to 7. D. and his wife, demised the said premises to the faid S. S. for the term of 39 years and 3 quarters of a year, at a pepper corn rent, fubject to redemption upon payment of the faid 1000l. and intereft on the 19th of June then next ensuing.

28th April, 1720.-The Dean and Chapter of St. Paul demifed by lease to the faid S. G. in truft for the faid J. D. and Elizabeth his wife, feveral meffuages lying in Newgate-market, and Warwick-lane, for forty years.

The faid 1000l. not being paid upon the first mortgage, and fome intereft remaining due thereon; 7. D. applied to S. S. to advance him the further sum of 400 l. his wife E. D. being then dead.

15th September, 1725.-By indenture between the faid J. D. of the first part, S. G. of the fecond part, and the faid S. §. and T. B. of the third part, in confideration of 400 /. paid to the faid 7. D. by the faid S. S. and 5 s. by him paid to the faid S. G. fhe the faid S. G. by the direction and appointment of the faid 7. D. and alfo the faid F. D. affigned the faid meffuages and premifes, held of the Dean and Chapter of St. Paul in London, to the faid S. S. for the refidue of the faid term of 40 years, from Michaelmas, 1719, by the faid leafe of the 20th April, 1720, granted, and in confideration of the faid fum of 4001. and of the faid 1000l. and intereft then due to the faid S. S. and of 5 s. to the faid S. G. paid by the faid T. B. the faid S. G. and alfo the faid 7. D. affigned by the nomination and appointment of the faid S. S. unto the faid T. B. the feveral meffuages and heredita+ B ments,

ments, held of the said Dean and Chapter of Westminster, for the refidue of the two feveral terms of 40 years, each commencing at Michaelmas 1719, by the faid two feveral leafes, granted to the faid S. G. by the Dean and Chapter of Westminster, in truft for the faid 8. S. fubject to the provifoe therein contained; whereby it was agreed that if the faid 7. D. fhould pay unto the faid S. S. as well the faid fum of 400l. with intereft at 5 per cent. per annum; as also the said fum of 1000l. with fuch intereft as was then, or fhould become due for the fame, on the 15th of March then next; then the faid S. S. and T. B. fhould affign unto the faid f. D. all the premises thereby affigned to the faid S. S. and T. B. or by the said indenture tripartite demifed to S. S.

The faid 7. D. afterwards died inteftate, and 30th of July, 1729, administration was granted to his daughter A. B-n, wife of J. B-n, who thereby became intitled to the equity of redemption, of the faid mortgaged premises.

The faid S. S. died inteftate, and administration was granted to 7. B-d, and the faid T. B-d, and E. S. his widow, who by virtue thereof, became intitled to the faid monies due on the faid mortgages.

7th December, 1731.-The faid J. B-n, and Ann his wife, having an opportunity to renew the faid two leafes with the Dean and Chapter of Westminster, did for that purpofe apply to the faid J. B-d, T. B-d, and E. S. to furrender the faid two leafes, and to advance out of the eftate of the faid S. S. 100l. to defray the fine and other expences of fuch renewal, and agreed that the faid new leafes fhould be in the name of S. W. in truft for fecuring the money due, and to become due on the faid mortgages, and alfo the faid 100l. with intereft; and that the said meffuages and premifes held of the Dean and Chapter of St. Paul, fhould alfo be a fecurity for the money due on the faid mortgages, and the faid 100l. to be advanced, and upon those terms, the faid J. B-d, T. B-d, and E. S. furrendered, or delivered up the faid two old leafes that had been granted by the Dean and Chapter of Westminster, to the faid S. G. and advanced to the faid 7. B, and Ann his wife, the faid 100l. which was expended in payment of the fine and other charges or expences upon renewing of the two leases. And thereupon the faid Dean and Chapter of Westminster, by their indenture of leafe, dated 7th December, 1731, did demife to the said S. W. all that meffuage or tenement therein mentioned to be fituate in Newgate-freet, London, and wherein G. D. a grocer then dwelt, for the term of forty years, from Michaelmas then laft paft.

7th December, 1731.-The faid Dean and Chapter of Westminster, by one other indenture of leafe, for the confideration therein mentioned, dia demife to the faid S. W. three feveral meffuages, near Newgatemarket, to hold for the term of forty years, from Michaelmas then Jast past.

The faid leafes were fo made to S. W. in truft, and to the intent that the fame might be affigned, to the faid J. B-d, T. B-d, and E. S. the adminiftratrix of the faid S. S. or as they fhould direct, for fes Curing the payment of the principal money and intereft then due,
