Part of the following work was printed before the passing of the late Act, 6 & 7 Vict. c. 85., which has removed the incompetency of witnesses in many instances, and has consequently altered the law as laid down in some of the cases digested and retained in this edition. The Act has been printed in the Appendix, and the reader will therefore easily be able to see the extent to which such cases have become inapplicable to actions commenced since 22d August, 1843.
