"And in consideration of the additional service that may be required of these Officers after the age of 45 years, increased retirement be granted to them on the following scale :

"Engineers qualified for promotion:

"And further that power be reserved to us to sus pend, under circumstances of emergency, the above provision under which an Engineer may at his option retire at the age of 45.

"We do most humbly submit that Your Majesty will be pleased to sanction these our proposals, the expense that may be occasioned by the same being concurred in by the Lords Commissioners of Your Majesty's Treasury."

Her Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of Her Privy Council, to approve of what is therein proposed; and the Right Honourable the Lords Commissioners of the Admiralty are to give the necessary directions herein accordingly. C. L. PEEL.

RETIRING PENSIONS TO CHIEF GUNNERS, CHIEF BOATSWAINS, CHIEF CARPENTERS, AND WARRANT OFFICERS.

Chief and other Gunners, Boatswains, and Carpenters, holding appointments in Her Majesty's Yards, if not entitled to civil superannuation, shall be allowed to count such service as time towards pension, on the above scale.

In the event of the above-mentioned officers having sustained injuries on duty not nearly equivalent to the loss of a limb, or being disabled by sickness contracted in the service, and not from want of proper care on their own part, an increase of not more than 101. a year may be made to whatever Retiring Allowance may be awarded to them under the foregoing scale, provided they have not already received compensation for the same.

For ruptures and minor injuries received on duty gratuities shall be granted under Article 1976 of the Regulations, at the discretion of the Admiralty, instead of the above increase.

Whenever an application for pension on account of age, long service, or disability is made by a Chief or other Gunner, Boatswain, or Carpenter who has received a wound or injury in the service, the Captain will direct the Medical Officer to make a report, which he will forward with the application, for the information of the Admiralty, stating clearly the extent to which the injury affects the applicant, and the degree in which it incapacitates him from contributing towards his own support; if the injury was received before the 30th of August 1870, and no hurt certificate is produced, the

applicant's statement should be supported by any documentary evidence that can be produced.

Special Pensions, or gratuities in excess of the foregoing scale for service may, at the discretion of the Admiralty, be awarded when special services have been rendered requiring special reward; and such lower rates of pension as the Admiralty may think proper may be granted to officers who have been guilty of misconduct.

Time during which an officer shall not have maintained a good character in the ships in which he has served shall not be allowed to reckon as service for Pension.

Chief and other Gunners, Boatswains, and Carpenters may, in such cases as it may be for their advantage, be pensioned on the scale for seamen, their service in the above ranks being allowed to reckon as superior petty time.

Chief Gunners, Chief Boatswains, Chief Carpenters and Warrant Officers who have been dismissed from Her Majesty's service for what may be considered venial offences in the case of seamen, may, at the discretion of the Admiralty, be allowed Naval Pensions on the seamen's scale, provided they have twenty-one years' ser. vice, or are from age or other causes unfit for service as seamen in the Navy.

In such cases the time served as Warrant Officers may be allowed to reckon as superior single petty time under Article 2010.

These Pensions shall not be held in addition to any other Pensions, unless it shall be a Pension conferred for wounds or injuries received in the Service.

Only Captains, Royal Navy, and Colonels and Lientenant-Colonels, Royal Marines, on the Active List shall be eligible for the award of Good Service Pensions; but such Pensions may be granted to Flag Officers on the Retired List, Medical Officers, and to General Officers of Marines, whether on the Active, Reserved, or Retired Royal Lists; provided in the cases of Flag Officers that retirement has taken place after attaining Flag Rank, and that the retired pay together with the Good Service Pension shall not exceed the half-pay of an Admiral of the Fleet.

Good Service Pensions shall be awarded to Flag Officers and Captains for distinguished service at sea, and in determining their claims, preference shall be given, in cases of special gallantry, to officers who have commanded ships in action against the enemy.

Flag Officers and General Officers of Royal Marines in receipt of these Pensions shall be allowed to retain them after being retired; but, in the case of Flag Officers, if the Retired Pay and Good Service Pension together exceed the Half Pay of an Admiral of the Fleet, the Retired Pay shall be reduced so as to make the two together equal to that amount.

Captains retired from that rank shall be allowed to receive, in Retired Pay together with Good Service Pension, a sum not exceeding 6001, a year; but, should the two together exceed that sum, they will be retired on 6007., relinquishing their Good Service Pension.

Captains, Royal Navy, and Colonels and LieutenantColonels, Royal Marines, shall forfeit their Good Service Pensions on promotion to be Flag, or General Officers, on the Active List.

Lieutenant-Colonels and Colonels of Marines to be allowed to receive in Retired Pay together with Good Service Pension a sum not exceeding 6007, a year, but should the two together exceed that sum they will be retired on 600l, a year relinquishing the Good Service Pension.

Should any Flag Officers holding a Good Service Pension be in receipt of, or become entitled to a Civil Pension, exceeding the value of his Good Service Pension, the latter Pension shall be suspended so long as he receives such Civil Pension; and the vacancy thus occasioned may be filled up; but, as a rule, it is not intended that more than one such supernumerary Pension shall be in existence at the same time.

When such employment shall have ceased, the officer shall resume his Good Service Pension, although the List be full, but in such case the next vacancy shall not be filled up.

A Captain shall be allowed to draw his Good Service Pension irrespective of the receipt of Full or Half Pay or Civil Salary.

A Flag Officer shall give up his Good Service Pension if he become Governor of Greenwich Hospital or Naval Aide-de-Camp to Her Majesty.

A Naval Aide-de-Camp to Her Majesty deriving emolument from his office shall not be allowed to hold any Pension, unless it be a pension conferred for wounds or injuries received in the Service.

An Admiral of the Fleet shall not be allowed to hold any Pension, unless it be a Pension conferred for wounds or injuries received in the Service.

An officer promoted to the rank of Admiral of the Fleet on the Retired List under the provisions of the Order in Council of 22nd of February 1870, Section X. para. 7, shall, in consideration of the rank not carrying increase of Retired Pay, be allowed to retain the Good Service Pension, or if not in possession of one shall be eligible for it.

GREENWICH HOSPITAL PENSIONS TO ENGINEER

"Whereas under Your Majesty's Order in Council of 22nd February 1870 and Article 1987 of the Regulations for the government of Your Majesty's Naval Service, the following Pensions out of Greenwich Hospital Funds are established for retired Engineer Officers of Your Majesty's Navy, viz., for Chief Inspectors and Inspectors of Machinery one Pension of Sot, per annum; for Chief Engineers seven Pensions of 501. per annum and whereas we are of opinion that, in consideration of the addition made in 1877 to the Active List of Chief Engineers, and the increased responsibilities devolving on Engineer Officers, a larger number of pensions should be awarded to officers of this class.

The QUEEN'S most Excellent Majesty in Council. WHEREAS there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 12th of January 1878, in the words following, viz. :

"Whereas we have had under our consideration the representations made by the Officers of the Royal Marines (and particularly by the Captains and Subalterns) of the continued stagnation of promotion in the Corps: and whereas it appears to us, after full inquiry, that the only way of meeting the difficulty, with due regard to the interests of the Officers generally and the efficiency of the Service, will be by adopting, as far as possible, in the Royal Marines, the principle of Retirement and Promotion now established in the Army by Your Majesty's recent Royal Warrant, and by extending the system of compulsory retirement established in the Royal Marine Corps by Your Majesty's Order in Council of the 22nd February 1870, we humbly submit for Your Majesty's approval the following Scheme, which we have submitted in the form of Regulations, which have been framed with the object of providing a fair and even flow of promotion throughout the whole Corps of Royal Marines.

"First Entries to be carefully regulated, and a fixed number only, to be determined on actuarial_advice, to be admitted in each year, in order that the officers compulsorily retired on arriving at certain ages may be as few as possible.

"The number to be limited to 16 or 17 appointments in each year for the whole force so long as it remains at its present strength, viz. :

12 or 13 for the Infantry. "4 or 5 for the Artillery. "And in the event of any increase or diminution of the Establishment, the changes to be effected on ac. tuarial advice and in the method least prejudicial to the ultimate interests of Officers on the Active List.

"These gratuities not to be granted without the consent of the Treasury, and only for the purpose of reducing the number of Officers compulsorily retired on 22 years of service; and no addition to the number of fresh entries to be made in consequence.

"The above rates of Retired Pay shall not apply to any Officer who entered the service prior to the 1st April 1870, and all such Officers on their retirement, whether compulsory or voluntary, at the periods stated in these regulations, shall be entitled to receive the Retired Pay which they could have claimed under the Orders in Council of the 22nd February 1870 and 5th February 1872, under the same conditions of age and service.

"12.-Retirement from ill-health, &c.

"Officers incapacitated by illness, &c. after only short service to be granted, instead of temporary half pay as allowed by Order in Council of 4th August 1878, Retired Allowances, by way of Annuity, upon the following conditions, which are the same conditions as those imposed upon Army Officers by the 151 and 152 Articles of the recent Royal Warrant, viz.:

"An Officer who may become unfit for service in consequence of wounds received in action, or of ill-health contracted in and by the performance of military duty, as certified by a Medical Board, may be granted temporary half pay until he shall recover, and until an opportunity shall occur for his re-employment. Except in the case of wounds received in action, the Officer must, however, have served with a commission in Our Marine Forces for three years, unless he shall have been promoted from the ranks, when one year's service only as a Commissioned Officer shall be required. In special cases in which the circumstances may appear to Us to call for exceptional consideration, it shall be sufficient that the disability shall have been contracted in the service.

"In the case of an Officer placed upon temporary half pay in consequence of injuries caused in and by the service, We may, provided a Medical Board report that the Officer is unfit for further service, place such Officer upon permanent half pay, after not less than one year upon temporary half pay. In special cases in which the circumstances may appear to Us to call for exceptional consideration, it shall be sufficient that the disability shall have been contracted in the service.

"But such Retired Allowances, by way of annuity, are only to be granted in special cases, with the consent of the Treasury, and the rates are to be made so as to coincide, as far as may be, with the principle of a pension of 2251. a year at 12 years of age.

13.-All service for the purposes of gratuity, pension, and retirements to count from the age of 20, except in the case of Officers who entered the service prior to the 1st April 1870, who, under the Order in Council of the 5th February 1872, retain the right of counting time from the age of 18 if appointed before that age, and from the date of their Commission if appointed after 18.

"14.-These Regulations are to take effect from the 1st October 1877.

"Whereas by Your Majesty's Order in Council, dated the nineteenth day of June one thousand eight hundred and sixty-eight, it is provided that all officers of the Royal Marines below the rank of Captain shall be required to pass an Examination before they can be considered eligible for promotion to that rank.

"And whereas we consider it advisable that Captains. in the Royal Marine Forces, promoted to that rank since the thirty-first day of October one thousand eight hundred and seventy-one, should also be required to pass an Examination before promotion to the substantive rank of Major, such examination to be similar to that laid down for Captains in Your Majesty's Army.

"We humbly beg that Your Majesty will be graciously pleased by Your Order in Council to make it compulsory on all Captains of the Royal Marines promoted to that rank subsequent to the thirty-first day of October one thousand eight hundred and seventy-one, to pass an Examination similar to that in force for the Army, and to obtain a certificate of qualifications before they can be promoted to the substantive rank of Major, and that we may receive Your Majesty's Authority to establish for the purpose such regulations as we may consider necessary."

"Whereas we have had under our consideration certain cases in which Officers of Your Majesty's Naval and Marine Forces have been dismissed from Your Majesty's Service by Court-Martial for misconduct, or have been allowed to resign their Commissions to avoid trial by Court-Martial: And whereas such Officers are, in some cases after good service for many years, rendered destitute by being thus deprived of all professional re

sources: We do therefore most humbly submit, that we be empowered at our discretion to grant compassionate allowances from this date, both to such Officers and also to those who may hereafter be so removed from the list of Your Majesty's Naval or Marine Forces, provided that such allowance shall in no instance exceed onethird of the amount of half-pay to which the Officer was entitled at the time of such removal, and provided also that such allowance shall not in any case exceed 1007. per annum.

"The Lords Commissioners of Your Majesty's Treasury have signified their concurrence with these proposals."

Her Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of Her Privy Council, to approve of what is therein proposed.

NAVAL RETIREMENT PREVIOUS TO 1870.

1851.

FLAG OFFICERS.

Her Majesty, by Her Order in Council of 25th June 1851, having been graciously pleased to sanction certain arrangements proposed by the Board of Admiralty, with a view to the general benefit of the Naval Service, and, at the same time, the ultimate reduction of the present charge for half-pay, the Lords Commissioners of the Admiralty hereby give notice of the mode in which the arrangements in question will be carried into effect.

The number of Flag Officers will in future be reduced to 99, exclusive of Admirals of the Fleet; of these 21 to be Admirals, 27 Vice-Admirals, and 51 Rear-Admirals: this reduction will be effected as follows, viz. :—

1st. By removing to a Reserved Half-pay List those Officers now on the Active List who have not served for their Flag, under the Order in Council of 30th June 1827. These Officers will receive, as at present, the Half-pay of Rear-Admirals, but they will be allowed the same advan tare of rising in rank as if they had remained on the Active List.

2nd. By awarding ten Retired Service Pensions, of 1501. each, to such Flag Officers as are either above 70 years of age, or are physically incapable of further Active Service, such Officers to be placed on the Reserved List, and the vacancies occasioned by death to be filled up from the Active List. These Pensions will not be held in addition to the Good Service Pension,

1866.

1. Compulsory retirement to be extended to all the Executive Lists.

2. Admirals to be retired on attaining 70 years of age, or when physically unfit for service.

3. Vice-Admirals to be retired on attaining 68 years of age, or when physically unfit for service.

4. Rear-Admirals to be retired on attaining 65 years of age, or when physically unfit for service.

5. Flag Officers, at present on the Active List, who may be retired under these Regulations, will retain all the privileges of rising in rank and pay to which they are now entitled; but no Flag Officer who has not hoisted his Flag will be considered eligible for the appointments of Vice-and Rear-Admirals of the United Kingdom, or promotion to the rank of Admiral of the Fleet. 6. The Active Flag List to be reduced to $5:Admirals of the Fleet and Admirals

This reduction to be made gradually, by only filling up two out of every three vacancies caused by the removal of Flag Officers who accept Greenwich Pensions, and by retirements from age, whether optional or compulsory. Vacancies from all other causes to be filled up as they occur. Vacancies on the List of Flag Officers on Reserved Half-pay in receipt of Service Pensions, and on the List of Flag Officers of Greenwich Hospital, will not be filled up.

7. Flag Officers at present on the Active List, who have hoisted their Flags, or been employed at the Admiralty since their promotion to Flag Rank, are to be allowed to retain their places on the Active List, if they should prefer it, but they may be placed on the Retired List at their own request, with the consent of the Admiralty. Officers coming on the Flag List after this date will be subject to compulsory retirement at the age specified above, whether they have served or not.

C.

1847.

CAPTAINS.

The plan of retirement published in the London Gazette of 1st Sept. 1815, and carried out by Her Majesty's Order in Council of 24th April 1847, provides :

1st. That the rank of Retired Rear-Admirals shall be given, by Seniority, to such applicants from the 148. 6d. Half-pay List as may be willing to accept it, with the pay of 11. 58. per diem, and the corresponding pension to their widows, under the usual restrictions.

2nd. An addition of 78. 6d. per day to be given to applicants, by Seniority, from the 128. d. and 108. 6d. flalfpay Lists, being Captains of not less than 20 years' standing and 55 years of age. Officers from both Lists to be permitted to assume the title of Retired Rear Admiral at the period when they would have obtained the Flag by Seniority had they remained upon the Active List, and (under Order in Council of 17 May 1838) to rise to the higher grades on the Flag List, according to the Seniority which they respectively held on the List of Captains. Their widows to be entitled to a pension of 1107. per annum, and to the pension of Rear-Admiral's widow when the rank of Retired Rear-Admiral has been attained.

3rd. The vacancies upon the 11. List to be filled up, in turn of Seniority, by Officers then accepting the 188. per diem; but no new admissions to the 11. 58. List to be nade until it is reduced below the number of 25, which it is not to exceed afterwards. The permanent Retired List to be reduced to 100, by making one appointment for every two vacancies, the first 25 Officers upon the Lis' receiving 17. 38. per diem, and the remaining 75, 17. per diem, with the right of assuming the rank of Letired Rear-Admiral when entitled to it by Seniority.

1851.

The number of Captains on the Active List will be reduced to a number not permanently exceeding 350, and the reductions shall be effected as follows, viz. :

1st. As vacancies occur on the Active List of Flag Officers, the Captain first in Seniority, who has served for his Flag, will be promoted; reserving, however, Her Majesty's undoubted right of selection. Those Captains will rise to their Flags, and who have not so served, will be placed on the Reserved Half-pay List, rising in rank as at present, but with the Half-pay only of Rear-Ad

mirals.

2nd. By keeping up the Retirement of 1816 to the number of 200, to be effected by permitting Captains who are above 55 years of age, and who have been on the Captain's List for ten years, to be eligible for retirement. The Retirement will be so kept up to 200 until the List of Captains shall be reduced to 350; the Retired List then to be diminished by only retiring one in two vacancies until it shall be reduced to 100.

Srd. By observing the rule of promotion, as it is now in force, of promoting one in three vacancies, except in special and individual cases, until the number is reduced to 30.
