18 States that you are twenty-one years old; that you have 19 resided in this State for twelve months, and in this county 20 (city or town) for the three months next preceding this elec21 tion; and that you are not disqualified from voting by the 22 Constitution or laws of this State; that your name is (here 23 insert the name given); that in such name you were duly 24 registered as a voter of this election district; that you are now 25 an actual resident of the same; that you are the identical per26 son you represent yourself to be, and that you have not voted 27 in this election at this or any voting place. So help you God." 28 If he refuses to take said oath his vote shall be rejected, but 29 if he takes said oath then his ballot shall be received and 30 name written thereon and placed in the ballot-box, and after 31 the polls are closed the evidence pertaining to his right to 32 vote shall be heard and the judges of election shall then de33 termine whether or not said vote shall be rejected and 34 Provided, that each city and county shall be divided into 35 precincts so that allowing each qualified voter two minutes 36 in which to vote there shall be time for all the registered 37 vote of the precincts to vote between sunrise and sunset of 38 the day of the election and

39 Provided, that it shall be made the duty of the judges 40 of election to see that there is nothing in the ballot-box at 41 the opening of the polls, and that nothing is allowed to be 42 placed therein during the time of holding the elections, ex43 cept the ballots of the duly qualified electors of the pre44 cinct who apply to vote, and to see that every duly qualified 45 elector at said precinct who applies to vote shall be allowed 46 to vote and shall keep a list of all voters who vote at the 47 precinct, and as soon as the polls are closed to count the 48 votes cast, and ascertain the number of votes cast for each 49 candidate, and make and sign a certificate showing number 50 of votes cast for each candidate at the precinct and 51 Provided, that after the ballots have been canvassed and 52 counted at any voting place that said ballots and the poll53 books and certificate showing the result of the election shall 54 be put under separate covers and sealed, and shall be con55 veyed by one of the judges of election, to be selected by 56 lot, to the clerk of the circuit court of the county or city in 57 which the election has been held, and the clerk to whom the 58 ballots are delivered shall, without breaking the seal, keep 59 same safely in his office for twelve months, and he shall not 60 allow same to be inspected, except in cases of contested 61 elections, and unless they become necessary to be used in 62 evidence: and,

63 Provided, further, that at the time the circuit court ap64 points the judges and clerks of election for the various

65 precincts of the counties and cities that it shall designate 66 five of the judges so appointed as commissioners to ascer67 tain the result of the election in the county or city from the 68 returns from the different precincts, and where there are 69 political parties in the said county or city, then two of the 70 judges so named to act as commissioners, shall be desig71 nated from the judges recommended by the chairman of the 72 Executive Committee of the political party of the county or 73 city that cast the greatest number of votes in said county or 74 city at the last preceding election, and two of said commis75 sioners shall be designated from the judges recommended 76 by the chairman of the political party of the county or city, 77 which cast next to the greatest number of votes in said 78 county or city at the last preceding election.

REPORT OF COMMITTEE ON JUDICIARY, IN REFERENCE TO THE JUDGE OF THE CORPORATION

COURT IN CITIES HAVING LESS THAN

FIVE THOUSAND INHABITANTS.

To the Convention:

The Committee on Judiciary, to whom the resolution introduced by Mr. Anderson, of Rockbridge, in reference to the judges of cities having less than five thousand inhabitants, was referred, has had that matter under consideration, and begs leave to recommend that the following section be adopted as an independent section, to be incorporated in the Constitution by the Committee on Final Revision, in its appropriate place:

Section. The judge of the corporation court of any 2 corporation having a city charter, but less than five thousand 3 inhabitants, may reside outside its corporate limits; and 4 the same person may be judge of such corporation court 5 and judge of the corporation court of some other city having 6 less than ten thousand inhabitants.

AN ORDINANCE

To provide for the registration of voters under this Constitution, and prior to the year nineteen hundred and four (1904).

It is ordained as follows: Until the first day of January, nineteen hundred and four, all voters shall be registered in accordance with the requirements of this ordinance, as follows:

Section 1. Registration shall be conducted in each magisterial district of every county, and in each ward of every city, by a board of registrars, composed of three competent citizens, resident in such district or ward, appointed as hereinafter provided, each of whom shall qualify by signing and filing with the clerk of the county court of their respective counties, or the corporation court of their respective cities, as the case may be, a paper signifying their acceptance of their appointment, and who shall hold office until the first day of January, nineteen hundred and four; except that in the city of Bristol there shall be only one board, composed of three competent citizens thereof.

The board shall organize by electing one of its members chairman and another secretary of the board.

If any person appointed refuse or fail to qualify by the first day of August, nineteen hundred and two, or to serve, or if a vacancy occur in such board, the judge of the county court of the county, or of the corporation court of the city, shall by appointment supply the place or fill such vacancy; and such appointees shall qualify in the same manner as those appointed by this ordinance.

For attendance upon the sessions of the board, each member shall receive a compensation of two dollars per day. While actually engaged in the discharge of his official duties as to registration, each member of any such board shall have the authority and powers of conservators of the peace as defined by laws existing at the time this ordinance becomes operative.

Sec. 2. Prior to the fifteenth day of October, nineteen hundred and two, and again prior to the fifteenth day of October, nineteen hundred and three, there shall be a general registration in each of the counties, cities, and towns of the State; and each board of registrars for each district and ward, prior to each of the foregoing dates, shall convene and sit at some place and time to be designated by it in each precinct in its district or ward, at least one day, from eight o'clock in the morning to sunset in the counties, and from twelve o'clock noon to nine o'clock P. M. in cities and towns, and at such other places within the district or ward as may be convenient and necessary to complete the registration of the
