THIS INDENTURE made, &c. between T. S. the wife of R. S. of, &c. which faid T. S. before her intermarriage was called T. D. fpinfter, and was the youngest daughter of, &c. of the one part, and C. J. of, &c. L. L. of, &c. of the other part.

AND whereas by certain other indentures of leafe and release bearing date refpectively the days of laft paft, the release being of three parts, and made, &c. between R. S. and T. his wife, of the firft part; G. and W. of the fecond part; and C. T. and T.A. of the third part; all and fingular the meffuage, &c. confifting of the feveral particulars, and then called or known by the feveral names, and defcriptions following, (that is to fay,) all that, &c. all which laft mentioned premifes are comprifed in an indenture of bargain and fale of — last, and the common recovery fuffered and executed in pursuance thereof, as are mentioned and particularly recited in the faid now reciting indenture; and all houses, &c. and also all that undivided moiety or half part of the whole, into two equal parts to be divided, of them, R. S. and T. his wife, of and in all that the manor of, &c. and of and in all houses, &c. and the reverfion and reverfions, remainder and remainders, yearly and other rents, iffues and profits, of all and fingular the faid hereditaments thereby granted, and released, or mentioned or intended fo to be, were directed, limited, and appointed, granted, released, and conveyed, To the ufe of R. S. and his affigns, for and during the term of his natural life, without impeachment of waste, remainder to G. and W. and their heirs, during the natural life of the faid R. S. upon truft, to preferve contingent remainders, remain der to the faid T. and her affigns, for and during the term of her natural life, without impeachment of wafte, remainder to faid G. and W. and their heirs, during the life of the faid T. S. upon truft, to preferve contingent remainders, and remainders after the decease of the furvivor of them, the faid S. and T. to the aforefaid C. T. and T. during and unto the full end and term of

portions of the daughters and younger fons of the
faid R. S. and T. his wife, in manner therein men-
tioned, with remainder to the faid other fons of
the body of the said R. S. on the body of the faid
T. S. begotten or to be begotten fucceffively in
tail male, remainder to all and every the daughter
and daughters of S. on the body of T. his wife,
begotten or to be begotten, as tenants in common,
in tail general, with crofs remainders between
them and their iffue, as tenants in common, in tail
general, with divers remainders over. And it is
by the faid indenture of release now in reci-
tal, Provided, declared, and agreed. [Reciting
power verbatim, enabling wife to raise £-
AND it is by the faid indenture of release now in
recital, declared and agreed by and between the
faid parties, that the aforefaid G. and W. and their
heirs, fhould from thenceforth ftand and be feifed
of the undivided moiety or half part of them, the
faid S. and T. his wife, of and in the site and ca-
pital meffuages of the manor of —, and of the rec-
tory of, and all other the meffuages, &c. com-
prised in the said indenture of lease of—, men-
tioned and comprised with the appurtenances,
upon fuch and the fame trufts, and to and for
fuch and the fame ufes, intents, and purposes, and
under and fubject to fuch and the fame powers,
provifos, limitations, declarations, and agreements,
as were in the faid indenture of release now in re-
cital, before limited, expreffed, and declared of and
concerning the freehold meffuages, lands, tene-
ments, moiety, and hereditaments thereinbefore
mentioned to be thereby limited and appointed,
granted and released, or as near thereto as the na-
ture and tenure of the faid leafehold premises and

MORTGAGE. the other rules of law and equity will permit, or fuch and fo many of them as fhould be capable of taking effect. And it is hereby particularly declared and agreed, that the faid undivided moiety or half part of them, the faid R. S. and T. his wife, of and in the faid fite and capital meffuage of the faid manor of -, and of the rectory of-, and all the other meffuages, lands, tenements, and hereditaments, in the parish of -, comprised in the faid recited indenture of leafe and release of the day of, should as well as the faid meffuages, lands, hereditaments, moiety, and tenements thereby limited and appointed, granted and released, be fubject and liable to the faid power of charging by appointment, demife, or otherwise, with £ and intereft, before given to the faid T. S. as aforefaid, as in and by the said several hereinbefore recited indentures, and the record of the aforefaid fine, reference, &c. AND whereas the faid T. S. is minded and defirous in execution of the aforefaid power given and reserved to her in and by the faid last hereinbefore recited indenture of release, to charge as well the faid meffuages, lands, tenements, moiety, and hereditaments, in and by the fame indenture limited and appointed, granted and released, as alfo the faid undivided moiety or half part of them the faid R. S. and T. his wife, of and in the faid fite of the manor of and of the capital meffuage and rectory of, and all and other the meffuages, &c. in, comprised, &c. with the payment of the full fum of, with intereft, at the rate, at the time, in the manner, and upon and for the trufts, intents, and purposes hereinafter mentioned.
