then the Warehouse-keeper or Warehouse-keepers, fo offending
therein, shall not only forfeit and lose the Value of the faid Goods Penalty.
fo carried out, as aforefaid, and be for ever difabled from any
publick Employment for the future, but fhall also forfeit the Sum
of five hundred Pounds for every fuch Offence, to be recovered
and divided in Manner as aforefaid.

VII. Provided always, and it is hereby enacted, That this Act Not to extend to fhall not extend to any Silks, Bengals, Stuffs, mixed with Silk Apparel, &c. or Herba, or painted, dyed, printed or ftained Calicoes manufactured in Perfia, China, or Eaft India, which fhall have been made up and used in any Sort of Apparel or Furniture, before the faid twenty ninth of September One thousand seven hundred and one. [Applied to Furniture and Household Stuff made up before 25th December 1722, by 10 G. 1. c. 11.; and fee on this Section and Sections 1 and 2. 12 & 13 W. 3. c. 12. § 16.]

VIII. Provided always, and be it further enacted, That it shall Provife, and may be lawful to and for the Proprietor or Proprietors of the faid Goods fo lodged in any Warehouse or Warehouses, as aforefaid, to affix one Lock to every fuch Warehouse or Warehouses, the Key of which fhall remain in the Cuftody of the faid Proprietor or Proprietors; and that he or they may view, fort or deliver the faid Goods, in order for Exportation, as aforefaid, in the Prefence of the faid Warehoufe-keeper or Warehoufekeepers, who is and are hereby obliged, at feasonable Times, to give Attendance for that Purpofe.

An Act to repeal an Act made in the ninth Year of His Majefty's Reign, intituled, An Act for rendring the Laws more effectual for preventing the Importation of Foreign Bone Lace, Locm Lace, Needle-work, Point and Cut-work, three Months after the Prohibition of the Woollen Manufactures in Flanders fhall be taken off.

THEREAS great Complaints are daily made of the Decay of the Woollen Manufactures in this Kingdom, to the Impoverishment of many thoufands of poor Families: And whereas by Experience it is found, that an Act made in the ninth and tenth Years of His now Majefty's Reign, intituled,

An Act to punifh Governors of Plantations in this Kingdom, for Crimes by them committed in the Plantations.

THEREAS a due Punishment is not provided for feveral Crimes and Offences committed out of this His Majefty's Realm of England, whereof divers Governors, Lieutenant Governors, Deputy Governors, or Commanders in Chief, of • Plantations and Colonies within His Majesty's Dominions beyond the Seas, have taken Advantage, and have not been deterred from oppreffing His Majesty's Subjects within their refpective Governments and Commands, nor from committing feveral other great Crimes and Offences not deeming themfelves punishable for the fame here, nor accountable for fuch ⚫ their Crimes and Offences to any Perfon within their refpective • Governments and Commands:' For Remedy whereof, Be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in Parliament affembled, and by the Authority of the fame, That if any Governor, Lieutenant Governor, Deputy Governor, or Commander in Chief of any Plantation or Colony within His Majefty's Dominions beyond the Seas, fhall after the first Day of Auguft One thoufand feven hundred, be guilty of Oppreffion of oppreffing any of His Majesty's Subjects beyond the Seas, within Governors, their refpective Governments or Commands, or fhall be guilty of &c. of any Colo. y, &c. beyond any other Crime or Offence, contrary to the Laws of this Realm, Sea, or in Force within their respective Governments or Commands, fuch Oppreffions, Crimes and Offences, fhall be enquired of, heard and determined in His Majefty's Court of King's Bench may be tried in here in England, or before fuch Commiffioners, and in fuch County of this Realm, as fhall be affigned by His Majefty's Commiffion, and by good and lawful Men of the fame County, and that fuch Punishments fhall be inflicted on fuch Offenders, as are usually inflicted for Offences of like Nature committed here in England.

IX. And whereas by an Act made in the tenth and eleventh To what Things Years of His Majefty's Reign, intituled, An Act to prevent the, 10 & 11 W. 3. Exportation of Wooll out of the Kingdoms of Ireland and Eng- c. 10. §1. land into foreign Parts, and for the Encouragement of the Woollen, not to extend. Manufactures in the Kingdom of England, it is enacted and declared, That no Wooll, Woollfells, Shortlings, Mortlings, Wooll-flocks, Worfted Bays, or Woollen Yarn, Cloth, Serge, Bays, Kerfeys, Says, Frizes, Druggets, Cloth-Serges, Shalloons, or any other Drapery, Stuffs or Woollen Manufactures whatsoever, made up or mixed with Wooll or Wooll-flocks, fhall be exported, tranfported, fhipped off, carried or conveyed out of or from the faid Kingdom of Ireland into any foreign Realm, States or Dominions, or into any Parts or Place 'whatsoever, other than the Parts within the Kingdom of England, or the Dominion of Wales, under feveral Penalties andForfeitures in the faid A&t mentioned: And whereas feveral Difputes have arifen concerning the true Intent and Meaning thereof;' Be it therefore enacted and declared by the Au thority aforefaid, That neither the faid Act, nor any Thing therein contained, fhall be conftrued to extend to fubject any Perfon or Perfons, or any Ship or Veffel, to any of the Pains, Penalties or Forfeitures in the faid Act contained, for or touching fuch Wooll-fells, Shortlings or Mortlings, as fhall be neceflary for the Ufe of the Gunner or Boatswain's Stores for the Ship or Veffel only, and as for fo much Cloth, Serge, Bays, Kerleys, Says, Frizes, Druggets, Cloth-Serges, Shalloons, or other Dra peries, Stuffs or other Manufactures, as fhall be for the proper Ufe for Clothes only of any Mariner or Paffenger, for his or her wearing Apparel or Furniture on board fuch Ship in the Voyage, and fhall not exceed in the whole, for any one Mariner" VOL. An Act for the afcertaining the Measures for retailing Ale

WHE

and Beer.

HEREAS by the Laws and Statutes of this Realm all Inn-keepers, Alchoufe-keepers and Victuallers, ought to utter and fell their Ale and Beer by the Ale Quart, ac cording to the Standard thereof, remaining in the Cuftody of the Chamberlains of His Majefty's Exchequer: the neglecting the Observance whereof, and felling and retailing their Ale ⚫ and Beer in uncertain Measures, much less than the faid Standard, is found to be of evil Confequence in hindring the Confumption of malted Corn, and leffening His Majefly's Revenues of Excife, and a great Wrong and Prejudice to wayfaring Men, Travellers, Manufacturers, Labourers and others, and alfo to fuch poor People whofe Neceffities force them to buy Ale and Beer from them: For remedying whereof, may it pleafe Your Moft Gracious Majefty that it may be enacted, and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by Retailers of Ale Authority of the fame, That from and after the four and twenand Beer to fell tieth Day of June One thousand feven hundred, all Inn-keepers, Alehoufe-keepers, Sutlers, Victuallers and other Retailers of Ale or Beer, and every Perfon and Perfons keeping any publick. house, and retailing and felling Ale or Beer in any City, Town Corporate, Borough, Market Town, Village, Hamlet, Parish, Part or Place whatsoever, within the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed, faall retail, utter, and fell their Ale and Beer, in and from their refpective Houses, by a full Ale Quart or Ale Pint, according to the faid Standard, or in Proportion thereunto, in a Vessel made of Wood, Earth, Glafs, Horn, Leather, Pewter, or of fome other good and wholefome Metal, made, fized and equalled unto the faid Standard, and figned, ftamped or marked to be of the Content of the faid Ale Quart or Ale Pint, according to the faid Standard, either from the faid Exchequer, or from the City of London, or from fome City, Town Corporate, Borough or Market Town, where a Standard Ale Quart or Ale Pint, made from the faid Standard, fhall be kept for that

Purpose, and fhall not retail and utter any Ale or Beer to any
Perfon or Perfons in any other Veffel not figned and marked as
aforefaid, on Pain to forfeit a Sum not exceeding forty Shillings, Penalty.
nor less than ten Shillings, for every fuch Offence, to be reco-
vered as hereinafter is provided.

11. And be it further enacted by the Authority aforefaid, Retailer felling That if any Inn-keeper, Alehoufe-keeper, Victualler, Sutler, Ale, &c. in Vefor other Retailer aforefaid, fhall from and after the nine and fels not marked, twentieth Day of September One thousand seven hundred, retail, utter, or fell any Ale or Beer in any Veffel not figned, stamped or marked as aforefaid, to any Traveller, or other Perfon or Perfons, or if in giving any Account or Reckoning in Writing or otherwise, such Inn-keeper, Alehoufe-keeper, or other Retailer as aforefaid, fhall refufe or deny to give in the particular Number of Quarts or Pints of Ale or Beer, for which Demand is made in fuch Account, it fhall not be lawful for any fuch Inn-keeper, Alehoufe-keeper, or other Retailer as aforefaid, for Default of Payment of fuch Reckoning, to detain any Goods, may not detain or other Thing or Things belonging to the Perfon or Perfons for Reckoning. from whom fuch Reckoning fhall be due, but shall be left to his

Action at Law for the fame; any Custom or Usage to the con trary in any wife notwithstanding.

III. And for the better Execution of this Act, and to the Intent that Veffels containing the faid Ale Quart and Ale Pint refpectively, may be from Time to Time fized and equalled according to the faid Standard, and figned, ftamped and marked as aforefaid, by the Mayor or other chief Officer of each City, Town Corporate, Borough and Market Town in England, Wales, and Town of Berwick upon Tweed, for all Inn-keepers, Alehousekeepers, Victuallers, and other Retailers as aforefaid, procuring and defiring the fame; Be it further enacted by the Authority aforefaid, That the Sub Commiffioners or Collectors of His In what Cafe Majefty's Revenues of Excife, within their respective Circuits or Ale Quarts and Ale Pints of Divifions, fhall forthwith provide and procure a fubftantial Ale Brafs Standard Quart and Ale Pint, according to the Standard + of the Measures Measure, to be aforefaid remaining in the faid Exchequer, of Brafs, to be made, provided for fealed and certified from the faid Chamberlains of the faid Mayor, &c. of Exchequer, without any Fee or Reward, for the Mayor or chief City, &c. + Sic. Officer in each City, Town Corporate, Borough and Market Town within his faid Divifion, in which there is not already a Brafs Standard Ale Quart and Ale Pint, made and certified either from the faid Exchequer, or from the Lord Mayor of the City of London, in the Cuftody or Power of fuch Mayor or chief Officer, and fhall, on or before the faid four and twentieth Day of June, cause the fame to be delivered unto the Mayor or other chief Officer in every City, Town Corporate, Borough. and Market Town within his faid Divifion (which chief Officer is hereby required to give a Receipt for the fame; and the fzid Standard Measures fhall be delivered to every fucceeding Officer) in which there is not already fuch Brafs Standard Ale Quart and Ale Pint as aforefaid, to be by them refpectively fafely kept for the Purposes aforefaid; on Pain that each Sub- Penalty. Commiflioner or Collector, for every Default herein, fhall forfeit the Sum of five Pounds, to be recovered as aforefaid.
